17	17		manufacturer warranties; creating s. 559.956, F.S.; 4
18	18		requiring a manufacturer's warranty for a heating, 5
19	19		ventilation, and air conditioning (HVAC) system to run 6
20	20		with the property; providing that a warrantor 7
21	21		continues to be obligated under the terms of a 8
22	22		manufacturer's warranty agreement regardless of the 9
23	23		property owner and may not charge a transfer fee; 10
24	24		providing that the transfer of a warranty does not 11
25	25		extend the warranty; providing that a warranty is 12
26	26		deemed registered if a contractor licensed under part 13
27	27		I of chapter 489, F.S., meets certain requirements; 14
28	28		requiring certain documentation; providing an 15
29	29		effective date. 16

31	31		Be It Enacted by the Legislature of the State of Florida: 18

33	33		Section 1. Section 559.956, Florida Statutes, is created 20
34	34		to read: 21
35	35		559.956 Registrations and transfers of heating, 22
36	36		ventilation, and air -conditioning system manufacturer 23
37	37		warranties; required contractor documentation. — 24
38	38		(1) If a residential real property that includes a 25

51	51		heating, ventilation, and air -conditioning (HVAC) system as a 26
52	52		fixture to the property is conveyed to a new owner, a 27
53	53		manufacturer's warranty in effect on that system or a component 28
54	54		of that system: 29
55	55		(a) Is automatically transferred to the new owner; and 30
56	56		(b) Continues in effect as if the new owner was the 31
57	57		original purchaser of such system or component, as applicable. 32
58	58		(2) A warrantor continues to be obligated under the terms 33
59	59		of a manufacturer's warranty agreement for a warranty 34
60	60		transferred under this section and may not charge a fee for the 35
61	61		transfer of the warranty. 36
62	62		(3) The transfer of a manufacturer's warranty under this 37
63	63		section does not extend the remaining term of the warranty. 38
64	64		(4) A manufacturer's warranty for an HVAC system is deemed 39
65	65		registered with the manufacturer if a contractor licensed under 40
66	66		part I of chapter 489: 41
67	67		(a) Installs the new HVAC system; and 42
68	68		(b) Provides the manufacturer of the HVAC system with the 43
69	69		date of the issuance of the certificate of occupancy for 44
70	70		installations relating to new construction, or the serial number 45
71	71		of the HVAC system for installations relating to existing 46
72	72		construction, as applicable . 47
73	73		(5) A contractor licensed under part I of chapter 489 who 48
74	74		installs a new HVAC system must document the installation 49
75	75		through an invoice or a receipt and provide the invoice or 50
