HB 1275 2023 CODING: Words stricken are deletions; words underlined are additions. hb1275-00 Page 1 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to the Persons with Disabilities 2 Registry; providing a short title; creating s. 402.88, 3 F.S.; defining the term "condition"; authorizing local 4 law enforcement agencies to develop and maintain a 5 registry for a specified purpose; providing for 6 enrollment in and removal from the registry; 7 specifying information the registry may include; 8 authorizing local law enforcement agencies to provide 9 access to the registry and relevant information from 10 the registry to law enforcement officers under certain 11 circumstances; providing an effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. This act may be cited as the "Prot ect Our Loved 16 Ones Act." 17 Section 2. Section 402.88, Florida Statutes, is created to 18 read: 19 402.88 Persons with Disabilities Registry. — 20 (1) As used in this section, the term "condition" means, a 21 developmental, mental, neurological, psychological, emo tional, 22 or cognitive impairment, illness, or disability, including, but 23 not limited to, autism spectrum disorder, Alzheimer's disease or 24 a dementia-related disorder, Parkinson's disease, progressive 25 HB 1275 2023 CODING: Words stricken are deletions; words underlined are additions. hb1275-00 Page 2 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S supranuclear palsy, epilepsy, bipolar disorder, or Down 26 syndrome, which has been diagnosed and certified by a physician 27 or physician assistant licensed under chapter 458 or chapter 28 459, an advanced practice registered nurse licensed under 29 chapter 464, a psychologist licensed under chapter 490, a mental 30 health counselor licensed under chapter 491, or a psychiatrist 31 as defined in s. 394.455. The term does not include conditions 32 manifested by substance abuse. 33 (2) A local law enforcement agency may develop and 34 maintain the Persons with Disabilities Registry databas e, which 35 shall contain a listing of individuals with conditions that may 36 be relevant to their interactions with law enforcement officers. 37 (3) Persons with a condition, as defined in subsection (1) 38 may be enrolled and disenrolled in the Persons with Disab ilities 39 Registry as follows: 40 (a) An adult with a condition may enroll and disenroll 41 himself or herself in the Persons with Disabilities Registry. 42 (b) A minor with a condition may be enrolled and 43 disenrolled in the Persons with Disabilities Registry by his or 44 her parent or legal guardian. The local law enforcement agency 45 must notify the individual of his or her enrollment in the 46 Persons with Disabilities Registry in writing at his or her 47 address of record within 5 business days after he or she reaches 48 18 years of age. 49 (c) An adult with a developmental disability may be 50 HB 1275 2023 CODING: Words stricken are deletions; words underlined are additions. hb1275-00 Page 3 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S enrolled and disenrolled in the Persons with Disabilities 51 Registry by his or her guardian advocate as defined in chapter 52 393. The local law enforcement agency must notify the individual 53 of his or her enrollment in the Persons with Disabilities 54 Registry in writing at his or her address of record within 5 55 business days after enrollment in the registry. 56 (4) A registration in the Persons with Disabilities 57 Registry is valid until the individu al is removed from the 58 registry. Upon a verbal or written request for removal of an 59 individual from the registry, the local law enforcement agency 60 must remove the individual's information from the registry 61 within 5 business days after the request is receiv ed. 62 (5) The Persons with Disabilities Registry may include, 63 but need not be limited to: 64 (a) The enrollee's name, address, contact information, 65 personal identifying information, and condition that may be 66 relevant to interactions with law enforcement offi cers. 67 (b) The name, address, contact information, and personal 68 identifying information of a parent, legal guardian, or guardian 69 advocate who enrolled an individual with a condition pursuant to 70 paragraphs (3)(b) and (c). 71 (c) Any additional information provided, including the 72 certification of the condition. 73 (6) The local law enforcement agency may provide access to 74 the registry and relevant information from the registry to a law 75 HB 1275 2023 CODING: Words stricken are deletions; words underlined are additions. hb1275-00 Page 4 of 4 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S enforcement officer engaged in his or her official duties. 76 Section 3. This act shall take effect January 1, 2024. 77
