A bill to be entitled 1 
An act relating to political advertisements for 2 
nonpartisan office; amending s. 106.143, F.S.; 3 
providing that a political advertisement paid for by a 4 
candidate for nonpartisan office may include a certain 5 
statement; deleting provisions that prohibit political 6 
advertisements for candidates running for nonpartisan 7 
office from disclosing the candidates' political party 8 
affiliation and that prohibit such ca ndidates from 9 
campaigning based on party affiliation; providing an 10 
effective date. 11

Be It Enacted by the Legislature of the State of Florida: 13 
 14 
 Section 1.  Subsections (1) and (3) of section 106.143, 15 
Florida Statutes, are amended to read: 16 
 106.143  Political advertisements circulated prior to 17 
election; requirements. — 18 
 (1)(a)  Any political advertisement that is paid for by a 19 
candidate running for partisan office , except a write-in 20 
candidate, and that is published, displayed, or circulated 21 
before, or on the day of, any election must prominently state: 22 
 1.  "Political advertisement paid for and approved by 23 
...(name of candidate)..., ...(party affiliation)..., for 24 
...(office sought)..."; or 25

 2.  "Paid by ...(name of candidate)..., ...(party 26 
affiliation)..., for ...(office sought)...." 27 
 (b)  Any political advertisement that is paid for by a 28 
candidate running for nonpartisan office, except a write -in 29 
candidate, and that is published, displayed, or circulated 30 
before, or on the day of, any election must includ e the 31 
statement required under paragraph (a), but may state 32 
"nonpartisan" in lieu of party affiliation. 33 
 (c)(b) Any political advertisement that is paid for by a 34 
write-in candidate and that is published, displayed, or 35 
circulated before, or on the day of, any election must 36 
prominently state: 37 
 1.  "Political advertisement paid for and approved by 38 
...(name of candidate)..., write -in candidate, for ...(office 39 
sought)..."; or 40 
 2.  "Paid by ...(name of candidate)..., write -in candidate, 41 
for ...(office sought)... ." 42 
 (d)(c) Any other political advertisement published, 43 
displayed, or circulated before, or on the day of, any election 44 
must prominently: 45 
 1.  Be marked "paid political advertisement" or with the 46 
abbreviation "pd. pol. adv." 47 
 2.  State the name and addres s of the persons paying for 48 
the advertisement. 49 
 3.  State whether the advertisement and the cost of 50

production is paid for or provided in kind by or at the expense 51 
of the entity publishing, displaying, broadcasting, or 52 
circulating the political advertiseme nt. 53 
 (e)(d) Any political advertisement made pursuant to s. 54 
106.021(3)(d) must prominently state the name and address of the 55 
political committee or political party paying for the 56 
advertisement. 57 
 (3)  Any political advertisement of a candidate running for 58 
partisan office shall express the name of the political party of 59 
which the candidate is seeking nomination or is the nominee. If 60 
the candidate for partisan office is running as a candidate with 61 
no party affiliation, any political advertisement of the 62 
candidate must state that the candidate has no party 63 
affiliation. A political advertisement of a candidate running 64 
for nonpartisan office may not state the candidate's political 65 
party affiliation. This section does not prohibit a political 66 
advertisement from st ating the candidate's partisan -related 67 
experience. A candidate for nonpartisan office is prohibited 68 
from campaigning based on party affiliation. 69 
 Section 2.  This act shall take effect July 1, 2023. 70
