5050 (2) PREEMPTION OF OCCUPATIONAL LICENSING TO THE STATE. β€”The 25
5151 licensing of occupations is expressly preempted to the state, 26
5252 and this section supersedes any local government licensing 27
5353 requirement of occupations with the exception of the following: 28
5454 (a) Any local government that imposed licenses on 29
5555 occupations before January 1, 2021. However, an y such local 30
5656 government licensing of occupations expires on July 1, 2024 July 31
5757 1, 2023. 32
5858 Section 2. Subsection (6) of section 489.113, Florida 33
5959 Statutes, is amended to read: 34
6060 489.113 Qualifications for practice; restrictions. β€” 35
6161 (6)(a) The board shall, by rule, designate those types of 36
6262 specialty contractors which may be certified under this part. 37
6363 The limit of the scope of work and responsibility of a specialty 38
6464 contractor shall be established by the board by rule. However, a 39
6565 certified specialty contractor category established by board 40
6666 rule exists as a voluntary statewide licensing category and does 41
6767 not create a mandatory licensing requirement. Any mandatory 42
6868 statewide construction contracting licensure requirement may 43
6969 only be established through specific sta tutory provision. 44
7070 (b) By July 1, 2024, the board shall, by rule, establish 45
7171 certified specialty contractor categories for voluntary 46
7272 licensure for all of the following: 47
7373 1. Structural aluminum or screen enclosures. 48
7474 2. Marine seawall work. 49

107107 person to obtain a license , issued by the local government or 70
108108 the state, for a job scope which does not substantially 71
109109 correspond to the job scope of one of the contractor categories 72
110110 defined in s. 489.105(3)(a) -(o) and (q) or authorized in s. 73
111111 489.1455(1), or the job scope of one of the certified specialty 74

125125 local government may n ot require a state or local license to 76
126126 obtain a permit for such job scopes . For purposes of this 77
127127 section, job scopes for which a local government may not require 78
128128 a license include, but are not limited to, painting; flooring; 79
129129 cabinetry; interior remodeling when the scope of the project 80
130130 does not include a task for which a state license is required ; 81
131131 driveway or tennis court installation; handyman services; 82
132132 decorative stone, tile, marble, granite, or terrazzo 83
133133 installation; plastering; pressure washing; stuccoing; caulking; 84
134134 and canvas awning and ornamental iron installation. 85
135135 2. A county that includes an area designated as an area of 86
136136 critical state concern under s. 380.05 may offer a license for 87
137137 any job scope which requires a contractor license under this 88
138138 part if the county imposed such a licensing requirement before 89
139139 January 1, 2021. 90
140140 3. A local government may continue to offer a license for 91
141141 veneer, including aluminum or vinyl gutters, siding, soffit, or 92
142142 fascia; rooftop painting, coating, and cleaning above thre e 93
143143 stories in height; or fence installation and erection if the 94
144144 local government imposed such a licensing requirement before 95
145145 January 1, 2021. 96
146146 4. A local government may not require a license as a 97
147147 prerequisite to submit a bid for public works projects if th e 98
148148 work to be performed does not require a license under general 99
