422422 of the theft is facilitated by conditions arising from the riot; 277
423423 or within a county that is subject to a state of emergency 278
424424 declared by the Governor under chapter 252, the property is 279
425425 stolen after the declara tion of emergency is made, and the 280
426426 perpetration of the theft is facilitated by conditions arising 281
427427 from the emergency, the offender commits a felony of the second 282
428428 degree, punishable as provided in s. 775.082, s. 775.083, or s. 283
