64	64	Section 1. This act may be cited as the "Responsible Gun 39
65	65	Ownership Act." 40
66	66	Section 2. Section 790.0653, Florida Statutes, is created 41

70	70	(1) As used in this s ection, the term: 45
71	71	(a) "Background check" means the process described in 18 46
72	72	U.S.C. s. 922(t) and s. 790.065 of using the National Instant 47
73	73	Criminal Background Check System and other systems to determine 48
74	74	that a person is not prohibited from possessing or re ceiving a 49

88	88	(b) "Family member" means a spouse or any of the following 51
89	89	relations, whether by consanguinity, adoption, or step -relation: 52
90	90	parent, child, sibling, grandparent, or grandchild. 53
91	91	(c) "Firearm" has the same mea ning as in s. 790.001(6) and 54
92	92	includes any handgun, rifle, or shotgun or any completed or 55
93	93	unfinished frame or receiver . 56
94	94	(d) "Licensed dealer" means a person who holds a federal 57
95	95	firearms license issued pursuant to 18 U.S.C. s. 923(a). 58
96	96	(e) "Person" means any individual, corporation, trust, 59
97	97	company, firm, partnership, association, club, organization, 60
98	98	society, joint stock company, or other legal entity. 61
99	99	(f) "Purchaser or other transferee" means an unlicensed 62
100	100	person who wishes or intends to receive a firear m from another 63
101	101	unlicensed person. 64
102	102	(g) "Sale" means the sale, delivery, or passing of 65
103	103	ownership or control of a firearm for a fee or other 66
104	104	consideration. 67
105	105	(h) "Seller or other transferor" means an unlicensed 68
106	106	person who wishes or intends to transfer a fir earm to another 69
107	107	unlicensed person. 70
108	108	(i) "Transfer" means to furnish, give, lend, deliver, or 71
109	109	otherwise provide, with or without consideration. 72
110	110	(j) "Unfinished frame or receiver" means a forging, 73
111	111	casting, printing, extrusion, machined body, or similar item 74

126	126	otherwise converted to function as a frame or receiver; or 77
127	127	2. Marketed or sold to the public to become or be used as 78
128	128	the frame or receiver of a functional firearm, rifle, or shotgu n 79

131	131	However, the term does not include a component designed and 82
132	132	intended for use in an antique weapon. 83
133	133	(j) "Unlicensed person" means a person who is not a 84
134	134	licensed dealer. 85
135	135	(2) All persons involved in fi rearm sales or other 86
136	136	transfers, in whole or in part, shall be subject to background 87
137	137	checks unless specifically exempted by state or federal law. If 88
138	138	the person involved in the firearm sale or other transfer, in 89
139	139	whole or in part, is a corporation or any enti ty other than an 90
140	140	individual person, the principal individual or individuals 91
141	141	involved in such sale or other transfer on behalf of the 92
142	142	corporation or other entity shall be subject to background 93
143	143	checks unless specifically exempted by federal law. A person may 94
144	144	not sell or otherwise transfer a firearm unless: 95
145	145	(a) The person is a licensed dealer; 96
146	146	(b) The purchaser or other transferee is a licensed 97
147	147	dealer; or 98
148	148	(c) The requirements of subsection (3) are met. 99

162	162	other transfer is a licensed dealer, the parties to the 101
163	163	transaction shall complete the sale or other transfer through a 102
164	164	licensed dealer as follows: 103
165	165	(a) The seller or other transferor and the purchaser or 104
166	166	other transferee shall appear jointly with the firearm at a 105
167	167	licensed dealer and request that the licensed dealer conduct a 106
168	168	background check on the purchaser or other transferee. 107
169	169	(b) A licensed dealer who agrees to facilitate a 108
170	170	background check pursuant to this section shall process the sale 109
171	171	or other transfer as if he or she were transferring the firearm 110
172	172	from the licensed dealer's own inventory to the purchaser or 111
173	173	other transferee, complying with all requirements of federal and 112
174	174	state law that would apply if he or she were the seller or other 113
175	175	transferor of the firearm, including all background checks and 114
176	176	recordkeeping requirements. 115
177	177	(c) The seller or other transferor and the purchaser or 116
178	178	other transferee shall each complete, sign, and submit all state 117
179	179	and federal forms necessary to process the backgrou nd check and 118
180	180	otherwise complete the sale or other transfer pursuant to this 119
181	181	section, and the licensed dealer shall indicate on the forms 120
182	182	that the sale or other transfer is between unlicensed persons. 121
183	183	(d) This section does not prevent the seller or other 122
184	184	transferor from removing the firearm from the premises of the 123
185	185	licensed dealer while the background check is being conducted or 124
186	186	during the applicable waiting period, provided that the seller 125

200	200	licensed dealer and delivers the firearm to the licensed dealer 127

202	202	(e) A licensed dealer or a seller or other transferor may 129
203	203	not sell or otherwise transfer a firearm to a purchaser or other 130
204	204	transferee if the result s of the background check indicate that 131
205	205	the purchaser or other transferee is prohibited from possessing 132
206	206	or receiving a firearm under federal or state law. 133
207	207	(f) A licensed dealer who agrees to conduct a background 134
208	208	check may charge a reasonable fee not to e xceed the 135
209	209	administrative costs incurred by the licensed dealer for 136
210	210	facilitating the sale or other transfer of the firearm, plus 137
211	211	applicable fees pursuant to federal and state law. 138
212	212	(4) Subsections (2) and (3) do not apply to the following: 139
213	213	(a) A law enforcement officer, as defined in s. 943.10(1) 140
214	214	or corrections agency, or a law enforcement officer or 141
215	215	correctional officer, as defined in s. 943.10(1) and (2), 142
216	216	respectively, vested with the authority to bear arms, acting 143
217	217	within the course and scope of his or her employment or official 144
218	218	duties. 145
219	219	(b) A United States Marshals Service officer, United 146
220	220	States Armed Forces or National Guard member, or federal 147
221	221	official vested with the authority to bear arms, acting within 148
222	222	the course and scope of his or her employment or official 149

236	236	(c) A gunsmith who receives a firearm solely for the 151
237	237	purposes of service or repair who returns the firearm to its 152

239	239	(d) A common carrier, warehouseman, or other person 154
240	240	engaged in the business of transportation or storage , to the 155
241	241	extent that the receipt of any firearm is in the ordinary course 156
242	242	of business and not for the personal use of any such person. 157
243	243	(e) A person who is not prohibited from possessing or 158
244	244	receiving a firearm under state or federal law who has 159
245	245	temporarily transferred a firearm: 160
246	246	1. Solely for the purpose of shooting at targets, if the 161
247	247	transfer occurs on the premises of a sport shooting range 162
248	248	authorized by the governing body of the jurisdiction in which 163
249	249	the range is located, or, if no such authorization i s required, 164
250	250	operated consistently with local law in such jurisdiction, and 165
251	251	the firearm is at all times kept within the premises of the 166
252	252	sport shooting range; 167
253	253	2. While the person is accompanying the lawful owner of 168
254	254	the firearm and using the firearm for law ful hunting purposes, 169
255	255	if hunting is legal in all places where the person possesses the 170
256	256	firearm and the person holds all licenses and permits required 171
257	257	for such hunting; 172
258	258	3. While participating in a lawfully organized competition 173
259	259	involving the use of a firearm; or 174
260	260	4. While in the presence of the seller or other 175

276	276	member knows or has reasonable cause to believe that federal or 179
277	277	state law prohibits the family member from purchasing or 180
278	278	possessing a firearm, or the seller or other transferor knows or 181
279	279	has reasonable cause to believe that the family member is likely 182
280	280	to use the firearm for unlawful purposes. 183
281	281	(g) An executor, administrator, trustee, or personal 184
282	282	representative of an estate or trust that occurs by operation of 185
283	283	law upon the death of the former lawful owner of the firearm. 186
284	284	(h) The temporary transfer of a firearm if such transfer 187
285	285	is to prevent immediate or imminen t death or great bodily harm 188
286	286	to one's self or others, provided that the person to whom the 189
287	287	firearm is transferred is not prohibited from possessing a 190
288	288	firearm under state or federal law and the temporary transfer 191
289	289	lasts no longer than necessary to prevent su ch immediate or 192
290	290	imminent death or great bodily harm. 193
291	291	(i) The sale or other transfer of an antique firearm. 194
292	292	(5) A person who violates this section commits a felony of 195
293	293	the third degree, punishable as provided in s. 775.082, s. 196
294	294	775.083, or s. 775.084. 197
295	295	(6) In addition to any other penalty or remedy, the 198
296	296	investigating law enforcement agency shall report any violation 199

316	316	(1)(a) A person who stores or leaves, on a premise under 207
317	317	his or her control, a loaded firearm, as defined in s. 790.001, 208
318	318	and who knows or reasonably should know that a minor is likely 209
319	319	to gain access to the firearm without the lawful permission of 210
320	320	the minor's parent or the person having charge of the minor, or 211
321	321	without the supervision required by law, shall keep the f irearm 212
322	322	in a securely locked box or container or in a location which a 213
323	323	reasonable person would believe to be secure or shall secure it 214
324	324	with a trigger lock, except when the person is carrying the 215
325	325	firearm on his or her body or within such close proximity 216
326	326	thereto that he or she can retrieve and use it as easily and 217
327	327	quickly as if he or she carried it on his or her body. 218
328	328	(b) A person who stores or leaves, on a premise under his 219
329	329	or her control, a firearm, as defined in s. 790.001, and who 220
330	330	knows or reasonably sho uld know that a prohibited user is likely 221
331	331	to gain access to the firearm, shall keep the firearm in a 222
332	332	securely locked box or container or shall secure it with a 223
333	333	trigger lock, except when the person is carrying the firearm on 224

349	349	this section, the term "prohibited user" means any person who is 228
350	350	prohibited by state or federal law from possessing the firearm. 229
351	351	(2) Except as provided in paragraphs (b) and (c), It is a 230
352	352	misdemeanor of the second degree, punishable as provided in s. 231
353	353	775.082 or s. 775.083, if a person violates subsection (1) : 232

471	471	(b) The sale of a firearm to a person who that presents to 314
472	472	the licensed dealer one of the following: 315
473	473	1. A trigger lock or other device designed to disable the 316
474	474	firearm and prevent the discharge of the firearm together with a 317
475	475	copy of the purchase receipt for the licensed dealer to keep. A 318
476	476	separate trigger lock or device and a separate purchase receipt 319
477	477	shall be is required for each firearm purchased. 320
478	478	2. A gun case or storage container that can be secured to 321
479	479	prevent unauthorized access to the firearm together with a copy 322
480	480	of the purchase receipt for the licensed dealer to keep. A 323
481	481	separate gun case or storage container and a separate purchase 324
482	482	receipt shall be is re quired for each firearm purchased. 325

496	496	(5) Upon the sale of a firearm, a licensed dealer shall 327
497	497	sign a statement and require the purchaser to sign a statement 328
498	498	stating that the sale is in compliance with subsections (1), 329
499	499	(3), and (4). The dealer shall retain a copy of the signed 330
500	500	statements and, if applicable, a copy of the receipt prescribed 331
501	501	in paragraph (4)(b), for at least 6 years. 332
502	502	(6)(a) This section does not create a civil action or 333
503	503	liability for damages arising from the use or misuse of a 334
504	504	firearm or ammunition for a person, other than a licensed 335
505	505	dealer, who produces a firearm or ammunition. 336
506	506	(b) A licensed dealer is not liable for damages arising 337
507	507	from the use or misuse of a firearm if the sale complies with 338
508	508	this section, any other applicable law of this state, and 339
509	509	applicable federal law. 340
510	510	(7)(3) Any person or business knowingly violating a 341
511	511	requirement to provide warning under this section commits : 342
512	512	(a) For a first violation, a misdemeanor of the second 343
513	513	degree, punishable as provided in s. 775.082 or s. 775.083. 344
514	514	(b) For a second violation, a misdemeanor of the first 345
515	515	degree, punishable as provided in s. 775.082 or s. 775.083. 346
516	516	(c) For a third or subsequent violation, a felony of the 347

692	692	(c) Except by operation of law, a person who does not have 463
693	693	a valid federal license to manufacture firearms may not sell or 464
694	694	transfer ownership of a firearm that the person manufactured or 465

696	696	(7)(a) A person may not to sell, offer to sell, or 467
697	697	transfer a three-dimensional printer or computer numerical 468
698	698	control (CNC) milling machine that has the p rimary or intended 469
699	699	function of manufacturing or assembling firearms or completed or 470
700	700	unfinished frame or receivers to any person who does not have a 471
701	701	valid license to manufacture firearms. 472
702	702	(b) A person may not purchase or receive a three -473
703	703	dimensional printer or CNC milling machine that has the primary 474

722	722	printer has been marketed or sold to the public in a manner that 481
723	723	advertises that the machine or printer may be used to 482
724	724	manufacture firearms or completed or unfinished frames and 483
725	725	receivers, or in a manner that knowingly or recklessly promotes 484
726	726	the machine's use in manufacturing firearms or completed or 485
727	727	unfinished frames and receivers by individuals who are not 486
728	728	licensed firearms manufacturers, regardless of whether the 487
729	729	machine or printer is otherwise described or classified as 488
730	730	having other functions or as a general -purpose machine or 489
731	731	printer. 490
732	732	Section 6. This act does not prohibit the sale of an 491
733	733	unfinished frame or receiver or firearm that is not imprinted 492
734	734	with a serial number to a firearms importer or manufacturer or a 493
735	735	licensed dealer before January 1, 2024. As used in this section, 494
736	736	the term "licensed dealer" means a person licensed as a dealer 495
737	737	in firearms issued pursuant to 18 U.S.C. s. 923(a). 496
738	738	Section 7. This act shall take effect October 1, 2023. 497
