A bill to be entitled 1 
An act relating to health insurance identification 2 
cards; amending s. 627.4302, F.S.; requiring certain 3 
prescription drug benefits -identification cards to 4 
include specified information in a certain manner; 5 
providing applicability; authorizing the Department of 6 
Financial Services to adopt certain rules; amending 7 
ss. 627.642, 627.657, and 641.31, F.S.; requiring 8 
certain health insurance and health maintenance 9 
organization identification cards to include specified 10 
information in a certain manner; providing 11 
applicability; authorizing the department to adopt 12 
certain rules; providing an effective date. 13

Be It Enacted by the Legislature of the State of Florida: 15 
 16 
 Section 1.  Paragraph (h) of subsection (2) of section 17 
627.4302, Florida Statutes, is redesignated as paragraph (i), 18 
and a new paragraph (h) is added to that subsection, to read: 19 
 627.4302  Identification cards for processing prescription 20 
drug claims.— 21 
 (2)  Any health insurer or health maintenance organization 22 
and all state and local government entities entering into an 23 
agreement to provide coverage for prescription drugs on an 24 
outpatient basis shall provide a benefits -identification card 25

containing the following information: 26 
 (h)  The type of plan, only if the plan is filed in this 27 
state; an indication that the plan is self -funded; or the name 28 
of the network. 29 
 1.  If the plan is subject to state regulation, the 30 
identification card must include the lett ers "FL" on the back 31 
left-hand corner of the card, under which a quick response (QR) 32 
code must be displayed directing the insured or the subscriber 33 
to the consumer complaint website of the Division of Consumer 34 
Services of the department. 35 
 2.  If the plan is exclusively federally regulated, the 36 
identification card must include the letters "FED" on the back 37 
left-hand corner of the card, under which a QR code must be 38 
displayed directing the insured or the subscriber to the 39 
consumer complaint website of the Cen ters for Medicare and 40 
Medicaid Services. 41 
 3.  This paragraph applies to benefits -identification cards 42 
issued or reissued on or after January 1, 2024. 43 
 4.  The department may adopt rules to implement necessary 44 
changes to the consumer complaint website and h otline of the 45 
Division of Consumer Services to best assist insureds or 46 
subscribers who are at an impasse with their insurers or health 47 
maintenance organizations, respectively. 48

(h) must be provided on the card, unless instruction is provided 51 
on the card for ready access to such information by electronic 52 
means. 53 
 Section 2.  Paragraph (c) of subsection (3) of section 54 
627.642, Florida Statutes, is amended to read: 55 
 627.642  Outline of coverage. — 56 
 (3)  In addition to the outline of coverage, a policy as 57 
specified in s. 627.6699(3)(k) must be accompanied by an 58 
identification card that contains, at a minimum: 59 
 (c)  The type of plan , only if the plan is filed in this 60 
the state;, an indication that the plan is self -funded;, or the 61 
name of the network. 62 
 1.  If the plan is subject to state regulation, the 63 
identification card must include the letters "FL" on the back 64 
left-hand corner of the card, under which a quick response (QR) 65 
code must be displayed directing the insured to the consumer 66 
complaint website of the Division of Consumer Services of the 67

 4.  The department may adopt rules to implement necessary 76 
changes to the consumer complaint website and hotline of the 77 
Division of Consumer Services to best assist insureds who are at 78 
an impasse with their insurers. 79

The identification card must present the information in a 81 
readily identifiable manner or, alternatively, the information 82 
may be embedded on the card and available through magnetic 83 
stripe or smart card. The information may also be provided 84 
through other electronic techno logy. 85 
 Section 3.  Paragraph (c) of subsection (2) of section 86 
627.657, Florida Statutes, is amended to read: 87 
 627.657  Provisions of group health insurance policies. — 88 
 (2)  The medical policy as specified in s. 627.6699(3)(k) 89 
must be accompanied by an id entification card that contains, at 90 
a minimum: 91 
 (c)  The type of plan , only if the plan is filed in this 92 
the state;, an indication that the plan is self -funded;, or the 93 
name of the network. 94 
 1.  If the plan is subject to state regulation, the 95 
identification card must include the letters "FL" on the back 96 
left-hand corner of the card, under which a quick response (QR) 97 
code must be displayed directing the insured to the consumer 98 
complaint website of the Division of Consumer Services of the 99

 (42)  The contract, certificate, or member handbook must be 121 
accompanied by an identification card that contains, at a 122 
minimum: 123 
 (c)  A statement that the health plan is a health 124 
maintenance organization. Only a health plan with a c ertificate 125

of authority issued under this chapter may be identified as a 126 
health maintenance organization. 127 
 1.  If the health plan is subject to state regulation, the 128 
identification card must include the letters "FL" on the back 129 
left-hand corner of the card , under which a quick response (QR) 130 
code must be displayed directing the subscriber to the consumer 131 
complaint website of the Division of Consumer Services of the 132 
department. 133 
 2.  If the health plan is exclusively federally regulated, 134 
the identification car d must include the letters "FED" on the 135 
back left-hand corner of the card, under which a QR code must be 136 
displayed directing the subscriber to the consumer complaint 137 
website of the Centers for Medicare and Medicaid Services. 138 
 3.  Subparagraphs 1. and 2. ap ply to identification cards 139 
issued or reissued on or after January 1, 2024. 140

 Section 5.  This act shall take effect January 1, 2024. 151
