| 23 | 23 | | Section 1. Sections 1 and 6 of section 3 of chapter 2000 -12 |

| 25 | 25 | | Section 1. Purpose. —There is hereby created in Okaloosa 14 |
|---|
| 26 | 26 | | County an independent a dependent special district for the 15 |
|---|
| 27 | 27 | | purpose of planning, constructing, oper ating, and maintaining a 16 |
|---|
| 28 | 28 | | bridge transversing Choctawhatchee Bay. The governmental body 17 |
|---|
| 29 | 29 | | shall be known as the Mid -Bay Bridge Authority, hereinafter 18 |
|---|
| 30 | 30 | | referred to as "authority." 19 |
|---|
| 31 | 31 | | Section 6. Budget.— 20 |
|---|
| 32 | 32 | | (1)(a) Prior to preparation of the annual budget as 21 |
|---|
| 33 | 33 | | provided in paragraph (b), the authority shall develop an annual 22 |
|---|
| 34 | 34 | | proposed budget according to the provisions set forth in this 23 |
|---|
| 35 | 35 | | section by May of each year, for a public hearing before the 24 |
|---|
| 36 | 36 | | citizens of Okaloosa County. 25 |

| 47 | 47 | | (b) The authority, in each fiscal year, shall prepare an 26 |

| 48 | 48 | | annual budget for operating revenue accounts and operating 27 |
|---|
| 49 | 49 | | expense accounts and such other accounts as it the board of 28 |
|---|
| 50 | 50 | | county commissioners shall prescribe, for its operations in the 29 |
|---|
| 51 | 51 | | ensuing fiscal year and, on or before the first day of June of 30 |
|---|
| 52 | 52 | | each year, the chair of the authority shall submit such budget 31 |
|---|
| 53 | 53 | | to the board of county commissioners. The fiscal year for the 32 |
|---|
| 54 | 54 | | authority shall be concurrent with the fiscal year of Okaloosa 33 |
|---|
| 55 | 55 | | County. At the time the authority prepares its annual budget , it 34 |
|---|
| 56 | 56 | | shall adopt a resolution determining and finding the estimated 35 |
|---|
| 57 | 57 | | amounts to be expended by the authority in the ensuing year, 36 |
|---|
| 58 | 58 | | exclusive of any bonds or other obligations of the authority, 37 |
|---|
| 59 | 59 | | for acquiring, establishing, constructing, enlarging, operating, 38 |
|---|
| 60 | 60 | | and maintaining the system, including the bridge and bridge 39 |
|---|
| 61 | 61 | | facilities and other facilities related thereto, or for any 40 |
|---|
| 62 | 62 | | other corporate purpose of the authority. A certified copy of 41 |
|---|
| 63 | 63 | | the resolution shall be submitted to the board of county 42 |
|---|
| 64 | 64 | | commissioners at the same time that it submits its annual budget 43 |
|---|
| 65 | 65 | | referred to above. 44 |
|---|
| 66 | 66 | | (c) The board of county commissioners shall examine the 45 |
|---|
| 67 | 67 | | budget and the certified copy of the resolution, and may 46 |
|---|
| 68 | 68 | | increase or reduce the total amount requested under the 47 |
|---|
| 69 | 69 | | provisions in the budget and resolution for the expenditures in 48 |
|---|
| 70 | 70 | | such an amount as the board of county commissioners deems 49 |
|---|
| 71 | 71 | | advisable in its sole discretion. Thereafter, the board of 50 |

| 84 | 84 | | (d) Any budget amendment adopted by the authority that 53 |

| 85 | 85 | | increases the total budget shall be approved by the board of 54 |

| 86 | 86 | | county commissioners prior to becoming effective. 55 |

| 87 | 87 | | (e) All anticipated revenues to be derived from the 56 |
|---|
| 88 | 88 | | operation of the system, including the bridge and bridge 57 |
|---|
| 89 | 89 | | facilities shall be included in the budget of the authority. 58 |
|---|
| 90 | 90 | | However, any amounts of money, including funds in the 59 |
|---|
| 91 | 91 | | authority's budget for the preceding fiscal year, that remain 60 |
|---|
| 92 | 92 | | unexpended from the rev enue derived under the budget for the 61 |
|---|
| 93 | 93 | | preceding fiscal year may, by resolution duly adopted by the 62 |
|---|
| 94 | 94 | | authority and approved by the board of county commissioners, be 63 |
|---|
| 95 | 95 | | set aside in a separate fund, to be known and described as a 64 |
|---|
| 96 | 96 | | "Renewal and Replacement Fund," and accumulated in said fund 65 |
|---|
| 97 | 97 | | from year to year for the purpose of purchasing real and 66 |
|---|
| 98 | 98 | | personal property, and building and constructing permanent 67 |
|---|
| 99 | 99 | | improvements, replacements, alterations, buildings, and other 68 |
|---|
| 100 | 100 | | structures, and such funds may be disbursed from time to time 69 |
|---|
| 101 | 101 | | out of the renewal and replacement fund, upon proper resolution 70 |
