13	13	An act for the relief of the Estate of Jason Sanchez 2
14	14	by Miami-Dade County; providing for an appropriation 3
15	15	to compensate the Estate of Jason Sanchez for injuries 4
16	16	and damages sustained by Jason Sanchez and his 5
17	17	survivors as a result of the negligence of a Miami -6
18	18	Dade County employee; providing a limitation on 7
19	19	compensation and the payment of attorney and lobbying 8
20	20	fees; providing an effective date. 9

22	22	WHEREAS, on May 13, 2019, Jason Sanchez was lawfully 11
23	23	traveling on his motorcycle northbound on Southwest 107th Avenue 12
24	24	toward the intersection at Southwest 176th Street in Miami -Dade 13
25	25	County, wearing his helmet and traveling at or below the posted 14
26	26	speed limit, and 15
27	27	WHEREAS, a Miami-Dade County employee operating a Miami -16
28	28	Dade County passenger bus failed to stop at the marked 17
29	29	intersection and pulled out in front of Mr. Sanchez in an 18
30	30	attempted left turn, causing a collision, and 19
31	31	WHEREAS, Mr. Sanchez sustained fatal blunt forc e injuries 20
32	32	as a result of the collision, and 21
33	33	WHEREAS, the Estate of Jason Sanchez has alleged, through a 22
34	34	lawsuit filed on September 17, 2019, in the Circuit Court of the 23
35	35	Eleventh Judicial Circuit in and for Miami -Dade County, that the 24
36	36	negligence of Miami-Dade County, through its bus driver, was the 25 

47	47	proximate cause of Mr. Sanchez's death, and 26
48	48	WHEREAS, Jacqueline Abreu, Mr. Sanchez's mother, and Manuel 27
49	49	Sanchez, Mr. Sanchez's father, have suffered significant 28
50	50	financial damages due to the loss of their son's financial 29
51	51	support and have experienced extreme mental anguish and 30
52	52	suffering as a result of the loss of their son, and 31
53	53	WHEREAS, following the filing of the lawsuit, the Estate of 32
54	54	Jason Sanchez and Miami -Dade County have reached a tentative 33
55	55	settlement agreement, pending county approval, in the amount of 34
56	56	$1.25 million, and 35
57	57	WHEREAS, pursuant to the agreement between the parties and 36
58	58	the limits of liability set forth in s. 768.28, Florida 37
59	59	Statutes, the settlement will be partially satisfied by Miami -38
60	60	Dade County in the amount of $300,000, and the satisfaction of 39
61	61	the remainder is contingent upon the passage of a claim bill in 40
62	62	the amount of $950,000, NOW, THEREFORE, 41

64	64	Be It Enacted by the Legislature of the State of Florida: 43

66	66	Section 1. The facts stated in the preamble to this act 45
67	67	are found and declared to be true. 46
68	68	Section 2. Miami-Dade County is authorized and directed to 47
69	69	appropriate from funds of the county not otherwise encumbered 48
70	70	and to draw a warrant in the sum of $950,000 payable to the 49
71	71	Estate of Jason Sanchez as compensation for injuries and damages 50 

83	83	Section 3. The amount paid by Miami -Dade County pursuant 52
84	84	to s. 768.28, Florida Statutes, and the amount awarded under 53
85	85	this act are intended to provide the sole compensation for all 54
86	86	present and future claims arising out of the factual situation 55
87	87	described in this act which resulted in the death of Jason 56
88	88	Sanchez, including injuries and damages to the Estate of Jason 57
89	89	Sanchez and his survivors. The total amount paid for attorney 58
90	90	fees relating to this claim may not exceed $190,000, and the 59
91	91	total amount paid for lobbying fees may not exceed $47,500. 60
92	92	Section 4. This act shall take effect upon becoming a law. 61
