24	24	Be It Enacted by the L egislature of the State of Florida: 11

26	26	Section 1. Subsection (15) of section 550.054, Florida 13
27	27	Statutes, is amended to read: 14
28	28	550.054 Application for permit to conduct pari -mutuel 15
29	29	wagering.— 16
30	30	(15)(a) Notwithstanding any other provision of law, a 17
31	31	permit for the conduct of pari -mutuel wagering and associated 18
32	32	cardroom or slot machine licenses may only be held by a 19
33	33	permitholder who held an operating license for the conduct of 20
34	34	pari-mutuel wagering for fiscal year 2020 -2021 or who holds a 21
35	35	permit issued pursuan t to s. 550.3345 or by a purchaser, 22
36	36	transferee, or assignee of a valid permit for the conduct of 23
37	37	pari-mutuel wagering if approved by the commission before such 24
38	38	purchase, transfer, or assignment and provided that the 25

51	51	commission does not approve or issue an additional permit for 26
52	52	the conduct of pari-mutuel wagering; 27
53	53	(b) All permits issued under this chapter held by 28
54	54	permitholders on January 1, 2021, are deemed valid for the sole 29
55	55	and exclusive purpose of satisfying all conditions for the valid 30
56	56	issuance of the permits, if such permitholder held an operating 31
57	57	license for the conduct of pari -mutuel wagering for fiscal year 32
58	58	2020-2021 or if such permitholder held a permit issued pursuant 33
59	59	to s. 550.3345; 34
60	60	(c) Additional permits for the conduct of pari -mutuel 35
61	61	wagering may not be approved or issued by the commission or 36
62	62	former Division of Pari -mutuel Wagering after January 1, 2021; 37
63	63	and 38
64	64	(d) A permit to conduct pari -mutuel wagering may not be 39
65	65	converted to another class of permit. 40
66	66	Section 2. Paragraph (c) of subsectio n (5) of section 41
67	67	849.086, Florida Statutes, is amended to read: 42
68	68	849.086 Cardrooms authorized. — 43
69	69	(5) LICENSE REQUIRED; APPLICATION; FEES. —No person may 44
70	70	operate a cardroom in this state unless such person holds a 45
71	71	valid cardroom license issued pursuant to this section. 46
72	72	(c) Notwithstanding any other provision of law, a pari -47
73	73	mutuel permitholder, other than a permitholder issued a permit 48
74	74	pursuant to s. 550.3345 or a purchaser, transferee, or assignee 49
75	75	holding a valid permit for the conduct of pari -mutuel wagering 50

88	88	approved pursuant to s. 550.054(15)(a) , may not be issued a 51
89	89	license for the operation of a cardroom if the permitholder did 52
90	90	not hold an operating license for the conduct of pari -mutuel 53
91	91	wagering for fiscal year 2020 -2021. In order for an initial 54
92	92	cardroom license to be issued to a thoroughbred permitholder 55
93	93	issued a permit pursuant to s. 550.3345, the applicant must have 56
94	94	requested, as part of its pari -mutuel annual license 57
95	95	application, to conduct at least a full schedule of live racing. 58
96	96	In order for a cardroom license to be renewed by a thoroughbred 59
97	97	permitholder, the applicant must have requested, as part of its 60
98	98	pari-mutuel annual license application, to conduct at least 90 61
99	99	percent of the total number of live performances conducted by 62
100	100	such permitholder dur ing either the state fiscal year in which 63
101	101	its initial cardroom license was issued or the state fiscal year 64
102	102	immediately prior thereto if the permitholder ran at least a 65
103	103	full schedule of live racing or games in the prior year. 66
104	104	Section 3. Paragraph (d) of subsection (1) of section 67
105	105	550.01215, Florida Statutes, is amended to read: 68
106	106	550.01215 License application; periods of operation; 69
107	107	license fees; bond.— 70
108	108	(1) Each permitholder shall annually, during the period 71
109	109	between December 15 and January 4, file in writing with the 72
110	110	commission its application for an operating license for a pari -73
111	111	mutuel facility for the conduct of pari -mutuel wagering during 74
112	112	the next state fiscal year, including intertrack and simulcast 75

125	125	race wagering. Each application for live performances must 76
126	126	specify the number, dates, and starting times of all live 77
127	127	performances that the permitholder intends to conduct. It must 78
128	128	also specify which perform ances will be conducted as charity or 79
129	129	scholarship performances. 80
130	130	(d) Notwithstanding any other provision of law, other than 81
131	131	a permitholder issued a permit pursuant to s. 550.3345, a pari -82
132	132	mutuel permitholder may not be issued an operating license for 83
133	133	the conduct of pari-mutuel wagering, slot machine gaming, or the 84
134	134	operation of a cardroom if the permitholder did not hold an 85
135	135	operating license for the conduct of pari -mutuel wagering for 86
136	136	fiscal year 2020-2021. This paragraph does not apply to a 87
137	137	purchaser, transferee, or assignee holding a valid permit for 88
138	138	the conduct of pari-mutuel wagering approved pursuant to s. 89
139	139	550.054(15)(a). 90
140	140	Section 4. This act shall take effect upon becoming a law. 91
