2020 Be It Enacted by the Legislature of the State of Florida: 7

2222 Section 1. Section 901.001, Florida Statutes, is created 9
2323 to read: 10
2424 901.001 Citizen's arrest. — 11
2525 (1) It is the intent of the Legislature to abrogate any 12
2626 common-law remedy of citizen's arrest. A private person who is 13
2727 not a law enforcement officer, as defined in s. 943.10(1), may 14
2828 not arrest another person for a violation of the laws of the 15
2929 state. 16
3030 (2) This section does not apply to: 17
3131 (a) A person who is a law enforcement off icer, as defined 18
3232 in s. 943.10(1), who is acting outside of his or her 19
3333 jurisdiction. Such an officer may arrest a person who commits a 20
3434 felony in his or her presence or arrest a person when a felony 21
3535 has been committed and when the arresting officer has proba ble 22
3636 cause to believe, and does believe, that the person arrested 23
3737 committed the felony. 24
3838 (b) A person who detains, without use of deadly force, a 25
