22 | 22 | | Section 1. Section 901.001, Florida Statutes, is created 9 |

24 | 24 | | 901.001 Citizen's arrest. — 11 |
---|
25 | 25 | | (1) It is the intent of the Legislature to abrogate any 12 |
---|
26 | 26 | | common-law remedy of citizen's arrest. A private person who is 13 |
---|
27 | 27 | | not a law enforcement officer, as defined in s. 943.10(1), may 14 |
---|
28 | 28 | | not arrest another person for a violation of the laws of the 15 |
---|
29 | 29 | | state. 16 |
---|
30 | 30 | | (2) This section does not apply to: 17 |
---|
31 | 31 | | (a) A person who is a law enforcement off icer, as defined 18 |
---|
32 | 32 | | in s. 943.10(1), who is acting outside of his or her 19 |
---|
33 | 33 | | jurisdiction. Such an officer may arrest a person who commits a 20 |
---|
34 | 34 | | felony in his or her presence or arrest a person when a felony 21 |
---|
35 | 35 | | has been committed and when the arresting officer has proba ble 22 |
---|
36 | 36 | | cause to believe, and does believe, that the person arrested 23 |
---|
37 | 37 | | committed the felony. 24 |

38 | 38 | | (b) A person who detains, without use of deadly force, a 25 |
