2828 Be It Enacted by the Legislature of the State of Florida: 15

3030 Section 1. Paragraph (d) of subsection (4) of section 17
3131 119.071, Florida Statutes, is amended to read: 18

3434 (4) AGENCY PERSONNEL INFORMATION. — 21
3535 (d)1. For purposes of this paragraph, the term : 22
3636 a. "Home addresses" means the dwelling location at which 23

496496 subparagraph 2. must maintain the exempt status of that 327

609609 paragraph, this paragraph is subject to the Open Government 404
610610 Sunset Review Act in accordance with s. 119.15 and shall stand 405
611611 repealed on October 2, 2024, unless reviewed and s aved from 406
612612 repeal through reenactment by the Legislature. 407
613613 Section 2. The Legislature finds that it is a public 408
614614 necessity that the home addresses, telephone numbers, dates of 409
615615 birth, and photographs of current county attorneys, assistant 410
616616 county attorneys, deputy county attorneys, city attorneys, 411
617617 assistant city attorneys, and deputy city attorneys be made 412
618618 exempt from s. 119.07(1), Florida Statutes, and s. 24(a), 413
619619 Article I of the State Constitution. The Legislature further 414
620620 finds that it is a public necessity that the names, home 415
621621 addresses, telephone numbers, photographs, dates of birth, and 416
622622 places of employment of the spouses and children of current 417
623623 county attorneys, assistant county attorneys, deputy county 418
624624 attorneys, city attorneys, assistant city attorneys , and deputy 419
625625 city attorneys, and the names and locations of schools and day 420
626626 care facilities attended by such children, be made exempt from 421
627627 s. 119.07(1), Florida Statutes, and s. 24(a), Article I of the 422
628628 State Constitution. The responsibilities of county att orneys, 423
629629 assistant county attorneys, deputy county attorneys, city 424

643643 regularly involve legal enforcement proceedings related to 426
644644 violations of codes and ordinances. Legal enforcement 427
645645 proceedings have led to retribution and threats by defendants 428
646646 and other persons on numerous occasions. Such attorneys have 429
647647 received death threats and e -mails from disgruntled persons 430
648648 advocating the murder of other attorneys. Other incidents have 431
649649 included the stalking of such attorneys and their spouses and 432
650650 children. The Legislature finds that the release of such 433
651651 personal identifying and location information could place such 434
652652 attorneys and their spouses and children in danger of being 435
653653 stalked or physically and emotionally harmed by a defendant or 436
654654 other person. The Legislature finds that the harm that may 437
655655 result from the release of such personal identifying and 438
656656 location information outweighs any public benefit that may be 439
657657 derived from the disclosure of the information, excep t in the 440
658658 case of a current county attorney, assistant county attorney, 441
659659 deputy county attorney, city attorney, assistant city attorney, 442
660660 or deputy city attorney who qualifies as a candidate for 443
661661 election to public office. 444
662662 Section 3. This act shall take effect July 1, 2024. 445
