2121 Be It Enacted by the Legislature of the State of Florida: 8

2323 Section 1. Subsection (4) of section 790.15, Florida 10
2424 Statutes, is amended to read: 11
2525 790.15 Discharging fir earm in public or on residential 12
2626 property.— 13
2727 (4)(a) Any person who recreationally discharges a firearm 14
2828 outdoors, including target shooting, in an area that the person 15
2929 knows or reasonably should know : 16
3030 1. Is primarily residential in nature ; or and that has a 17
3131 residential density of one or more dwelling units per acre , 18
3232 2. Has a residential density of 1.25 or more acres per 19
3333 dwelling unit and the firearm discharge by the person does not 20
3434 remain within the boundaries of the property in which the 21
3535 discharge takes place, 22

3737 commits a misdemeanor of the first degree, punishable as 24
3838 provided in s. 775.082 or s. 775.083. 25

5151 (b) This subsection does not apply : 26
5252 (a) to a person lawfully defending life or property or 27
5353 performing official duties requiring the discharge of a firearm; 28
5454 (b) If, under the circumstances, the discharge does not 29
5555 pose a reasonably foreseeable risk to life, safety, or property; 30
