HB 369 2024 CODING: Words stricken are deletions; words underlined are additions. hb0369-00 Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to virtual currency sales tax holiday; 2 defining the terms "convenience store" and "virtual 3 currency"; providing a sales tax exemption during a 4 specified period for the retail sale of tangible 5 personal property and services which is paid in 6 virtual currency and is made by specified 7 establishments; authorizing the Department of Revenue 8 to adopt emergency rules; providing that such rules 9 are effective for a specified period of time; 10 providing an effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Virtual currency transactions; sales tax 15 holiday.— 16 (1) As used in this section, the term: 17 (a) "Convenience store" means a business that is engaged 18 primarily in the retail sale of groceries or motor fuels or 19 special fuels and may offer food services to the public. The 20 term includes businesses providing motor fuels or special fuels 21 to the public which also offer groceries or food service. 22 (b) "Virtual currency" has the same meaning as in s. 23 560.103, Florida Statutes. 24 (2) The tax levied under chapter 212, Florida Statutes, 25 HB 369 2024 CODING: Words stricken are deletions; words underlined are additions. hb0369-00 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S may not be collected during the period of June 1, 2025, through 26 July 31, 2025, on the ret ail sale of tangible personal property 27 or services which is taxable under that chapter if the sale is 28 paid in virtual currency and the sale is made by the following 29 establishments in this state: 30 (a) A retail service station that sells motor fuels or 31 special fuels to the public and is classified under the North 32 American Industry Classification System code 457120. 33 (b) A food service establishment permitted or licensed 34 under chapter 500, Florida Statutes, or a public food service 35 establishment licensed und er chapter 509, Florida Statutes. 36 (c) A grocery store. 37 (d) A convenience store. 38 (e) A cosmetology salon or specialty salon licensed under 39 chapter 477, Florida Statutes; a spa; or a barbershop as defined 40 in s. 476.034, Florida Statutes. 41 (f) A bar or nightclub. 42 (3) The Department of Revenue is authorized, and all 43 conditions are deemed met, to adopt emergency rules pursuant to 44 s. 120.54(4), Florida Statutes, for the purpose of implementing 45 this section.
