53- (1)(a) No later than July 1, 2026, each public school, 28
54-including charter schools, must have at least one operational 29
55-automated external defibrillator on school grounds. The 30
56-defibrillator must be available in a clearly marked and 31
57-publicized location. Schools must maintain the defibrillator 32
58-according to the manufactu rer's recommendations and maintain all 33
59-verification records for such defibrillator. 34
60- (b) The location of each defibrillator must be registered 35
61-with a local emergency medical services medical director. 36
62- (c) The use of defibrillators by school employees an d 37
63-volunteers is covered under ss. 768.13 and 768.1325. 38
64- (2) Annually, beginning June 30, 2027, each school 39
65-district and charter school must report to the Commissioner of 40
66-Education the number of instances a defibrillator was used on 41
67-school grounds and the survival rate of individuals experiencing 42
68-cardiac arrest. 43
69- (3) Compliance with the requirements of s. 1006.165 does 44
70-not constitute compliance with this section. 45
71- (4) Subject to an appropriation, the department may 46
72-reimburse each school district and chart er school up to 50 47
73-percent of the total automated external defibrillator purchase 48
74-price. 49
75- (5) The State Board of Education shall adopt rules to 50
51+protocols and plans relating to the use of 26
52+defibrillators in schools; requiring the State Board 27
53+of Education to adopt rules; providing a n effective 28
54+date. 29

56+Be It Enacted by the Legislature of the State of Florida: 31

58+ Section 1. This act may be cited as the "HeartCharged 33
59+Act." 34
60+ Section 2. Section 1003.457, Florida Statutes, is created 35
61+to read: 36
62+ 1003.457 Automated external defibrill ators on school 37
63+grounds. 38
64+ (1)(a) In addition to the requirements of s. 1006.165, 39
65+each public school must have at least one operational automated 40
66+external defibrillator on school grounds. Each defibrillator 41
67+must be stored in a location that is easily acce ssible to anyone 42
68+at any time during the school day and any other time students 43
69+are on school grounds, including outside of the school year. 44
70+Such defibrillator may not be placed in the school's athletic 45
71+facilities. Each defibrillator must have appropriate 46
72+accompanying signage, including, but not limited to, signage at 47
73+the defibrillator's exact location directing responders to the 48
74+building or room where the defibrillator is routinely kept. Each 49
75+defibrillator and all of its components must be maintained 50

89- Section 3. This act shall take effect July 1, 2024. 52
88+according to the manufacturer's instructions and kept in proper 51
89+working order. Each school is encouraged to have or work towards 52
90+acquiring and placing a sufficient number of defibrillators on 53
91+school grounds, as determined by the Department of Education, to 54
92+allow a person to retrieve a defibrillator within 3 minutes 55
93+after a cardiac or medical emergency in which the use of a 56
94+defibrillator is needed anywhere on school grounds. Each school 57
95+is encouraged to establish public and private partnerships and 58
96+seek grants, gifts, and other donations to cover the costs 59
97+associated with the purchase, placement, and training in the use 60
98+of a defibrillator. 61
99+ (b) Each charter school and private school is encouraged 62
100+to have at least one operational defibrillator on school grounds 63
101+and to meet the requirements of paragraph (a). A charter or 64
102+private school that elects to comply with this section may 65
103+utilize the statewide contracts under subsection (3) and will be 66
104+provided with all protocols for the deployment and 67
105+administration of defibr illators in schools as disseminated 68
106+pursuant to subsection (4). 69
107+ (2) The use of defibrillators or cardiopulmonary 70
108+resuscitation by school employees or students is covered under 71
109+ss. 768.13 and 768.1325. 72
110+ (3) The Department of Education shall enter into st atewide 73
111+contracts for defibrillators, pursuant to the updated 74
112+technologies and conveniences of available defibrillators on the 75

125+market, to provide statewide discounts to schools and school 76
126+districts. 77
127+ (4) The Commissioner of Education, at his or her sole 78
128+discretion, shall create and disseminate all of the following: 79
129+ (a) The protocols for the deployment and administration of 80
130+defibrillators in schools. 81
131+ (b) A comprehensive emergency action plan for the use of a 82
132+defibrillator. 83
133+ (c) An education plan, which must include annual training 84
134+for school employees and students in the use of a defibrillator. 85
135+ (5) The State Board of Education shall adopt rules to 86
136+administer this section, including those necessary for the 87
137+protocols and plans created and disseminated u nder subsection 88
138+(4). 89
139+ Section 3. This act shall take effect July 1, 2024. 90
