2727 Section 1. Section 943.327, Florida Statutes, is created 14

29- 943.327 Forensic Investigative Genetic Genealogy Grant 16
30-Program.— 17
31- (1) As used in this s ection, the term: 18
32- (a) "Forensic investigative genetic genealogy" means the 19
33-combined application of laboratory testing, genetic genealogy, 20
34-and law enforcement investigative techniques. 21
35- (b) "Genetic genealogy" has the same meaning as in s. 22
36-119.071(2)(r)1. 23
37- (2) There is created within the department the Forensic 24
38-Investigative Genetic Genealogy Grant Program to award grants to 25
29+ 943.327 Forensic Genetic Genealogy Grant Program. — 16
30+ (1) As used in this section, the term "fo rensic genetic 17
31+genealogy methods" means any technology used in a forensic 18
32+laboratory capable of producing a forensic genealogy profile 19
33+with a minimum of 100,000 markers and compatible with multiple 20
34+genealogical databases that is available for law enforceme nt use 21
35+for the purposes described in this section. 22
36+ (2) There is created within the department the Forensic 23
37+Genetic Genealogy Grant Program to award grants to law 24
38+enforcement agencies or medical examiner's offices to support 25

51-statewide and local law enforcement agencies and medical 26
52-examiner's offices to support those agencies and offices in the 27
53-processing of DNA samples and in conducting any associated 28
54-genetic genealogy research as specified under subsection (4). 29
55- (3) The department shall annually award to statewide and 30
56-local law enforcement agencies and medical examiner's offices 31
57-any funds specifically a ppropriated for the grant program to 32
58-cover expenses related to using forensic investigative genetic 33
59-genealogy to generate investigative leads for criminal 34
60-investigations of violent crimes and to aid in the 35
61-identification of unidentified human remains. 36
62- (4) Grants may be used in accordance with department rule 37
63-for any of the following purposes: 38
64- (a) The analysis of DNA samples to generate profiles that 39
65-have a minimum of 100,000 markers and that are compatible with 40
66-genetic genealogical databases that permit law enforcement use 41
67-and searching. 42
68- (b) The use of forensic investigative genetic genealogy to 43
69-solve violent crimes and to identify unidentified human remains. 44
70- (5) Each grant recipient must provide to the executive 45
71-director a report no later than 1 yea r after receipt of funding 46
72-under the grant program. This report must include all of the 47
73-following: 48
74- (a) The amount of funding received. 49
75- (b) The number and type of cases pursued using forensic 50
51+local law enforcement agencies in the processing of DNA samples 26
52+as provided for in subsection (4). 27
53+ (3) The department shall annually award to law enforcement 28
54+agencies and medical examiner's offices any funds specially 29
55+appropriated for the grant program to cover expenses related to 30
56+using forensic genetic genealogy methods to generate 31
57+investigative leads for criminal investigations or unidentified 32
58+human remains. 33
59+ (4) Grants may be used for the following: 34
60+ (a) Carrying out DNA analyses of samples collected under 35
61+applicable legal author ity using forensic genetic genealogy 36
62+methods for violent crimes. 37
63+ (b) Carrying out DNA analyses of unidentified human 38
64+remains. 39
65+ (5) Each recipient shall provide to the executive director 40
66+a report no later than 1 year after receipt of funding. This 41
67+report shall include: 42
68+ (a) The amount of annual funding received. 43
69+ (b) The number of cases tested using forensic genetic 44
70+genealogical DNA analysis. 45
71+ (c) The type of forensic genetic genealogical DNA testing 46
72+used, including the name of the laboratory to which such testing 47
73+is outsourced, if any, and the type of equipment used for the 48
74+testing. 49
75+ (d) The result of the testing, such as victim 50

89- (c) The type of forensic investigative genetic genealogy 52
90-methods used, including the name of the laboratory to which any 53
91-testing was outsourced, if applicable, the technology employed, 54
92-the name of the genetic genealogy database used, and the 55
93-identity of the entity conducting any g enetic genealogical 56
94-research. 57
95- (d) The results of the DNA testing including whether or 58
96-not testing was sufficiently successful to permit genetic 59
97-genealogy database searching and the results of any such 60
98-searching and any additional genealogical research, s uch as 61
99-decedent identification, perpetrator identification, or no 62
100-identification. 63
101- (e) The amount of time it took to make an identification 64
102-or to determine no identification could be made. 65
103- (6) The department may adopt rules pursuant to ss. 66
104-120.536(1) and 120.54 to implement and administer this section 67
105-and to establish the process for the allocation of grant funds . 68
106- Section 2. This act shall take effect July 1, 2024. 69
