HB 489 2024 CODING: Words stricken are deletions; words underlined are additions. hb0489-00 Page 1 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to the right to possess firearms; 2 amending s. 790.23, F.S.; providing that a person must 3 have been adjudicated delinquent for an action 4 committed as a juvenile to cause the person to lose 5 the right to possess a firearm for a specified period; 6 providing an effective date. 7 8 Be It Enacted by the Legislature of the State of Florida: 9 10 Section 1. Paragraphs (b) and (d) of subsection (1) of 11 section 790.23, Florida Statutes, are amended to read: 12 790.23 Felons and delinquents; possession of firearms, 13 ammunition, or electric weapons or devices unlawful. — 14 (1) It is unlawful for any person to own or to have in his 15 or her care, custody, possession, o r control any firearm, 16 ammunition, or electric weapon or device, or to carry a 17 concealed weapon, including a tear gas gun or chemical weapon or 18 device, if that person has been: 19 (b) Adjudicated delinquent in the courts of this state if 20 the delinquent act Found, in the courts of this state, to have 21 committed a delinquent act tha t would be a felony if committed 22 by an adult and such person is under 24 years of age; 23 (d) Adjudicated delinquent Found to have committed a 24 delinquent act in another state, territo ry, or country that 25 HB 489 2024 CODING: Words stricken are deletions; words underlined are additions. hb0489-00 Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S would be a felony if committed by an adult and which was 26 punishable by imprisonment for a term exceeding 1 year and such 27 person is under 24 years of age; or 28 Section 2. This act shall take effect July 1, 2024. 29
