Collier County; amending chapter 2001 -298, Laws of 3
Florida, as amended; amending district boundaries to 4
add new lands; providing that the boundary expansion 5
was approved at referendum; providing an effective 6

Be It Enacted by the Legislature of the State of Florida: 9
10
Section 1. Section 1 of section 3 of chapter 2001 -298, 11
Laws of Florida, as ame nded by chapter 2004 -425, Laws of 12
Florida, is amended to read: 13
Section 1. Minimum charter requirements. —In accordance 14
with section 189.031(3) 189.404(3), Florida Statutes, the 15
following subsections shall comprise the minimum required 16
charter provisions for Collier Mosquito Control District: 17
(a) The District is organized and exists for all purposes 18
set forth in this act and chapter 388, Florida Statutes, as they 19
may be amended from time to time. 20
(b) The powers, functions, and duties of the District 21
regarding ad valorem taxation, non -ad valorem assessments, bond 22
issuance, other revenue -raising capabilities, budget preparation 23
and approval, liens, foreclosure of liens, use of tax deeds and 24
tax certificates, and contractual agreements shall be as set 25

forth in chapters 170, 189, 197, 200, and 388, Florida Statutes, 26
this act, or any other applicable general or special law, as 27
they may be amended from time to time. 28
(c) The District was created by the petition process 29
formerly contained in chapter 390, Flor ida Statutes, 1949. 30
(d) The District's charter may be amended only by special 31
act of the Legislature, unless otherwise provided by chapter 32
189, Florida Statutes, or chapter 388, Florida Statutes, as 33
amended from time to time. 34
(e) In accordance with sec tion 388.101(2), Florida 35
Statutes, the District is governed by a five -member board. The 36
membership and organization of the board shall be as set forth 37
in this act and chapter 388, Florida Statutes, as they may be 38
amended from time to time. 39
(f) Board members may be paid a salary in accordance with 40
this act and chapter 388, Florida Statutes, as they may be 41
amended from time to time. Notwithstanding section 388.141(1), 42
Florida Statutes, board members may also receive benefits, such 43
as medical insurance or ac cidental death and dismemberment 44
insurance, in addition to the maximum salary allowed under 45
general law. Each additional benefit will be granted by 46
unanimous resolution of the District with all members present. 47
(g) The administrative duties of the Board of 48
Commissioners shall be as set forth in this act and chapter 388, 49
Florida Statutes, as they may be amended from time to time. 50

(h) Requirements for financial disclosure, meeting 51
notices, reporting, public records maintenance, and per diem 52
expenses for officers and employees shall be as set forth in 53
chapters 112, 189, 286, and 388, Florida Statutes, as they may 54
be amended from time to time. 55
(i) The procedures and requirements governing the issuance 56
of bonds, notes, and other evidence of indebtedness by the 57
District shall be as set forth in chapters 189 and 388, Florida 58
Statutes, and applicable general laws, as they may be amended 59
from time to time. 60
(j) The procedures for conducting District electio ns and 61
for qualification of electors shall be pursuant to chapters 189 62
and 388, Florida Statutes, and applicable general laws, as they 63
may be amended from time to time. 64
(k) The District may be financed by any method established 65
in this act, chapter 189, Florida Statutes, or chapter 388, 66
Florida Statutes, or any applicable general laws, as they may be 67
amended from time to time. 68
(l) Pursuant to section 388.221, Florida Statutes, as it 69
may be amended from time to time, the District's authority to 70
levy upon all of the personal and real taxable property in the 71
District a special tax during each year as maintenance tax is 72
preserved. 73
(m) The method for collecting non -ad valorem assessments, 74
fees, service charges, or state matching funds shall be as set 75

(n) The District's planning requirements shall be as set 78
forth in chapters 189 and 388, Florida Statutes, as they may be 79

(o) The District's geographic boundary limitations shall 81
