An act relating to land and water management; amending 2 
s. 373.421, F.S.; requiring certain buffer zones for 3 
land or water delineations established by a county or 4 
municipality to be acquired by the county or 5 
municipality through eminent domain; creating s. 6 
403.8111, F.S.; preempting regulation of specified 7 
dredge and fill activities to the Department of 8 
Environmental Protection; providing construction; 9 
repealing s. 373.591, F.S., relating to land 10 
management review teams; providing an effective date. 11

Be It Enacted by the Legislature of the State of Florida: 13 
 14 
 Section 1.  Subsection (8) is added to section 37 3.421, 15 
Florida Statutes, to read: 16 
 373.421  Delineation methods; formal determinations. — 17 
 (8)  Buffer zones for land or water delineations 18 
established by a county or municipality that exceed the 19 
delineation determinations for such land or water by the 20 
Department of Environmental Protection or a water management 21 
district must be acquired by the county or municipality through 22 
eminent domain pursuant to chapters 73 and 74. 23 
 Section 2.  Section 403.8111, Florida Statutes, is created 24 
to read: 25

 403.8111  Dredge and fill activities preemption. —The 26 
regulation of dredge and fill activities under this chapter and 27 
chapter 373 is preempted to the department. This section does 28 
not preclude the authority of the department to delegate powers 29 
to water management districts under chapter 373. 30 
 Section 3.  Section 373.591, Florida Statutes, is repealed. 31 
 Section 4.  This act shall take effect July 1, 2024. 32
