2222 Be It Enacted by the Legislature of the State of Florida: 9

2424 Section 1. Section 812.0146, Florida Statut es, is created 11
2525 to read: 12
2626 812.0146 Theft from a nonprofit organization; 13
2727 reclassification of offenses. — 14
2828 (1) Whenever a person is charged with committing theft 15
2929 from an organization that he or she knows or has reason to 16
3030 believe is qualified as charitable un der s. 501(c)(3) of the 17
3131 Internal Revenue Code, the offense for which the person is 18
3232 charged shall be reclassified as follows: 19
3333 (a) If the funds, assets, or property involved in the 20
3434 theft from an organization qualified as charitable under s. 21
3535 501(c)(3) of the Internal Revenue Code is valued at $50,000 or 22
3636 more, the offender commits a felony of the first degree, 23
3737 punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 24
3838 (b) If the funds, assets, or property involved in the 25

5151 theft from an organization qua lified as charitable under s. 26
5252 501(c)(3) of the Internal Revenue Code is valued at $10,000 or 27
5353 more, but less than $50,000, the offender commits a felony of 28
5454 the second degree, punishable as provided in s. 775.082, s. 29
5555 775.083, or s. 775.084. 30
5656 (c) If the funds, assets, or property involved in the 31
5757 theft from an organization qualified as charitable under s. 32
5858 501(c)(3) of the Internal Revenue Code is valued at $300 or 33
5959 more, but less than $10,000, the offender commits a felony of 34
6060 the third degree, punishable as pro vided in s. 775.082, s. 35

6262 (2) A person who is convicted of theft of more than $1,000 37
6363 from an organization that he or she knows or has reason to 38
6464 believe is qualified as charitable under s. 501(c)(3) of the 39
6565 Internal Revenue Code shall be ordered by the sentencing judge 40
6666 to make restitution to the victim of such offense and to perform 41
6767 up to 500 hours of community service work. Such restitution and 42
6868 community service work shall be in addition to any fine or 43
6969 sentence which may be imposed an d shall not be in lieu thereof. 44
7070 Section 2. This act shall take effect October 1, 2024. 45
