32-Be It Enacted by the Legislature of the State of Florida: 19

34- Section 1. Section 790.501, Florida Statutes, is created 21
35-to read: 22
36- 790.501 Enhanced firearms training facilities. - 23
37- (1) For purposes of this section, the term: 24
38- (a) "Department" means the Department of Agriculture and 25
16+facilities; creating s. 790.501, F.S.; exempting from 3
17+local government specified restrictions for the 4
18+location of licensed enhanced firearms training 5
19+facilities; providing definitions; establishing 6
20+procedures for licensure; requiring certain sheriffs 7
21+to provide an affidavit; specifying the duration of a 8
22+license; specifying conditions under which a license 9
23+is revoked; authorizing an enhanced firearms training 10
24+facility to provide training and certification to the 11
25+guardian program; requiring the Department of 12
26+Agriculture and Consumer Services to adopt rules; 13
27+providing an effective date. 14

29+Be It Enacted by the Legislatu re of the State of Florida: 16

31+ Section 1. Section 790.501, Florida Statutes, is created 18
32+to read: 19
33+ 790.501 Enhanced firearms training facilities; licensing. - 20
34+ (1) Notwithstanding any law to the contrary, a facility 21
35+that is licensed under subsection (2) as an enhanced firearms 22
36+training facility is exempt from any local government planning 23
37+and zoning or public works restrictions. 24
38+ (2) For purposes of this section, the term: 25

52- (b) "Enhanced firearms training facility" means a facility 27
53-located on land zoned for agri cultural use or the equivalent 28
54-which is used to train people in the use of firearms and 29
55-personal safety. 30
56- (c) "Owner" means a person who: 31
57- 1. Holds the legal title to the agricultural land and 32
58-facilities upon which the enhanced firearms training facilit y 33
59-will be licensed; or 34
60- 2. Holds a percentage interest in the agricultural land 35
61-and facilities that is equal to or greater than the other 36
62-persons who also hold a legal interest, if the legal title is 37
63-held in the name of two or more people. 38
64- (2) The department is authorized to issue a license to 39
65-designate a facility as an enhanced firearms training facility. 40
66-To receive such a license, the owner must complete and submit an 41
67-application to the department and must: 42
68- (a) Successfully complete a Level 2 backgro und screening 43
69-as provided in s. 435.04(2). The applicant must submit a full 44
70-set of fingerprints to the department or to a vendor, an entity, 45
71-or an agency authorized by s. 943.053(13). The department, 46
72-vendor, entity, or agency shall forward the fingerprints to the 47
73-Department of Law Enforcement for state processing and the 48
74-Department of Law Enforcement shall forward the fingerprints to 49
75-the Federal Bureau of Investigation for national processing. 50
51+ (a) "Enhanced firearms training facility" means a facility 26
52+located on land zone d for agricultural use or the equivalent 27
53+which is used to train people in the use of firearms and 28

55+ (b) "Owner" means a person who: 30
56+ 1. Holds the legal title to the land and facilities upon 31
57+which the enhanced firearms training facility w ill be licensed; 32
58+or 33
59+ 2. Holds a percentage interest in the agricultural land 34
60+and facilities that is equal to or greater than the other 35
61+persons who also hold a legal interest, if the legal title is 36
62+held in the name of two or more people. 37
63+ (3) To receive a license, the owner of an enhanced 38
64+firearms training facility must: 39
65+ (a) Complete and submit an application to the Department 40
66+of Agriculture and Consumer Services. 41
67+ (b) Have successfully passed a Level 2 background 42
68+screening as provided in s. 435.04(2). 43
69+ (c) Have no felony conviction. 44
70+ (d) Have successfully completed a chief range safety 45
71+officer training program approved by the Department of 46
72+Agriculture and Consumer Services. 47
73+ (e) Hold a class "K" firearms instructor license from the 48
74+Department of Agriculture and Consumer Services. 49
75+ (4) In addition to meeting the requirements of subsection 50

88-Fees for state and federal fingerprint processing and retention 51
89-shall be borne by the applicant. The state cost for fingerprint 52
90-processing shall be as provided in s. 943.053(3)(e). 53
91- (b) Not have been convicted of a felony. 54
92- (c) Successfully complete the National Rifle Association 55
93-Chief Range Safety Officer training p rogram or an equivalent 56
94-program conducted by a nationally recognized organization that 57
95-provides similar firearms training. 58
96- (d) Hold a valid class "K" firearms instructor license 59
97-issued by the department. 60
98- (3) In support of an owner's application submitted under 61
99-subsection (2), the owner may provide to the department a 62
100-written attestation from the sheriff who has jurisdiction over 63
101-the property on which the enhanced firearms training facility is 64
102-or will be located, if the sheriff, at his or her sole 65
103-discretion, agrees to provide such attestation, confirming that 66
104-the sheriff or his or her designee has: 67
105- (a) Visited the property and facilities on which the 68
106-enhanced firearms training facility is or will be loca ted. 69
107- (b) Determined that the property and facilities are large 70
108-enough and sufficient enough to be designated as an enhanced 71
109-firearms training facility. 72
110- (c) Determined that the property and facilities may 73
111-fulfill a public safety training need, includin g providing a 74
112-place for the sheriff or a law enforcement agency to provide 75

125-firearms or other training to the public, including such 76
126-training as authorized under s. 37, chapter 2023 –18, Laws of 77
127-Florida. 78
128- (4)(a) An enhanced firearms training facility licens e 79
129-issued by the department is valid for 12 months and must be 80
130-renewed annually by the owner to remain valid. 81
131- (b) The department must revoke the license of an enhanced 82
132-firearms training facility if the department determines that the 83
133-owner is no longer in compliance with the requirements listed in 84
134-paragraph (2)(b) or paragraph (2)(d). 85
135- (5) A sheriff, under an agreement with an enhanced 86
136-firearms training facility, may provide training for the school 87
137-guardian program under s. 30.15 at an enhanced firearms tr aining 88
138-facility. 89
139- (6) Notwithstanding any other law to the contrary, an 90
140-enhanced firearms training facility licensed by the department 91
141-is not subject to local government planning and zoning or public 92
142-works restrictions if the facility is located in an 93
143-unincorporated area of a county. 94
144- (7) The department may adopt rules to implement this 95
145-section. 96
146- Section 2. This act shall take effect July 1, 2024. 97
88+(3), the owner of an enhanced firearms training facility must 51
89+provide the Department of Agriculture and Consumer Services with 52
90+an affidavit from the sheriff who has jurisdiction of the 53
91+facility, attesting to the fact that the sheriff: 54
92+ 1. Has personally visited the land and facilities upon 55
93+which the enhanced firearms training facility will be licensed. 56
94+ 2. Has determined the land and facilities would fulfill a 57
95+public safety training need for which this section was created. 58
96+ 3. Has determined that the land and facilities are large 59
97+enough and sufficiently equipped to provide enhanced firearms 60
98+training. 61
99+ (5) An enhanced firearms training facility license must be 62
100+renewed annually and remains effective for 12 months or until 63
101+the department determines that the owner of the enhanced 64
102+firearms training facility is no longer in compliance with 65
103+paragraph (3)(c), paragraph (3)(d), or paragraph (3)(e). 66
104+ (6) An enhanced fir earms training facility may provide 67
105+training and certification for the guardian program under s. 68
106+30.15(1)(k). 69
107+ (7) The Department of Agriculture and Consumer Services 70
108+shall adopt rules to implement this section. 71
109+ Section 2. This act shall take effect July 1, 2024. 72
