26	26	Be It Enacted by the Legislature of the State of Florida: 13

28	28	Section 1. This act may be cited as the "Nonprofit 15
29	29	Agricultural Organization Health Coverage Act of 2024." 16
30	30	Section 2. Chapter 632, Florida Statutes, entitled 17
31	31	"Fraternal Benefit Societies," is retitled "Fraternal Benefit 18
32	32	Societies and Nonprofit Agricultural Organizations." 19
33	33	Section 3. Sections 632.601 through 632.638, Florida 20
34	34	Statutes, are designated as part I of chapter 632, Florida 21
35	35	Statutes" and entitled "Fraternal Benefit Societies." 22
36	36	Section 4. Part II of chapter 632, Florida Statutes, 23
37	37	consisting of section 632.701, Florida Statutes, is created to 24

53	53	624.4032 Nonprofit agricultural organization health 28
54	54	coverage.— 29
55	55	(1) The purpose of this section is to allow nonprofit 30
56	56	agriculture organizations to offer health coverage options to 31
57	57	their members. 32
58	58	(2) As used in this section, the term "nonprofit 33
59	59	agricultural organization" means an organization that: 34
60	60	(a) Is domiciled in this state. 35
61	61	(b) Is exempt from federal income tax under s. 501(c) of 36
62	62	the Internal Revenue Code. 37
63	63	(c) Was created primarily to promote programs for the 38
64	64	development of rural communities an d the economic stability and 39
65	65	sustainability of farmers in this state. 40
66	66	(d) Exists to serve its members beyond only offering 41
67	67	health coverage. 42
68	68	(e) Collects annual dues from its members. 43
69	69	(f) Was in existence before 1945. 44
70	70	(g) Is composed of members who are residents of the 45
71	71	majority of counties in this state. 46
72	72	(3) Notwithstanding any law to the contrary, the health 47
73	73	coverage provided by a nonprofit agricultural organization is 48
74	74	not insurance for purposes of the Florida Insur ance Code. 49
75	75	Section 5. This act shall take effect July 1, 2024. 50
