25 | 25 | | Section 1. Paragraph (f) of subsection (3) of section 12 |

27 | 27 | | 409.979 Eligibility. — 14 |

28 | 28 | | (3) WAIT LIST, RELEASE, AND OFFER PROCESS. —The Department 15 |

29 | 29 | | of Elderly Affairs shall maintain a statewide wait list for 16 |

30 | 30 | | enrollment for home and community -based services through the 17 |

31 | 31 | | long-term care managed care program. 18 |
---|
32 | 32 | | (f) Notwithstanding this subsection, the following 19 |

33 | 33 | | individuals are afforded priority enrollment for home and 20 |
---|
34 | 34 | | community-based services through the long -term care managed care 21 |
---|
35 | 35 | | program and do not have to complete the screening or wait -list 22 |
---|
36 | 36 | | process if all other long -term care managed care program 23 |
---|
37 | 37 | | eligibility requirements are met: 24 |

38 | 38 | | 1. An individual who is 18, 19, or 20 years of age who has 25 |

59 | 59 | | Children and Families pursuant to the Adult Protective Services 34 |

60 | 60 | | Act, ss. 415.101-415.113, as high risk and who is placed in an 35 |

61 | 61 | | assisted living facility temporarily funded by the Department of 36 |

63 | 63 | | 4. An individual who has resided in a licensed assisted 38 |
---|
64 | 64 | | living facility in this state for at least 6 months, or for 30 39 |
---|
65 | 65 | | days following referral by the Department of Children and 40 |

66 | 66 | | Families, and who requires assistance with two or more 41 |
---|
67 | 67 | | activities of daily living. 42 |
