Be It Enacted by the Legislature of the State of Florida: 7

Section 1. Subsection (28) of section 258.39, Florida 9
Statutes, is amended to read: 10
258.39 Boundaries of preserves. —The submerged lands 11
included within the boundaries of Nassau, Du val, St. Johns, 12
Flagler, Volusia, Brevard, Indian River, St. Lucie, Charlotte, 13
Pinellas, Martin, Palm Beach, Miami -Dade, Monroe, Collier, Lee, 14
Citrus, Franklin, Gulf, Bay, Okaloosa, Marion, Santa Rosa, 15
Hernando, and Escambia Counties, as hereinafter descri bed, with 16
the exception of privately held submerged lands lying landward 17
of established bulkheads and of privately held submerged lands 18
within Monroe County where the establishment of bulkhead lines 19
is not required, are hereby declared to be aquatic preser ves. 20
Such aquatic preserve areas include: 21
(28) Estero Bay Aquatic Preserve, the boundaries of which 22
are generally: All of those sovereignty submerged lands located 23
bayward of the mean high -water line being in Sections 13, 14, 24
15, 16, 17, 18, 21, 22, 23, 24, 25, 26, 27, 35, and 36, Township 25

46 South, Range 24 East; and in Sections 19, 20, 28, 29, and 34, 26
Township 46 South, Range 24 East, lying north and east of 27
Matanzas Pass Channel; and in Sections 19, 30, and 31, Township 28
46 South, Range 25 East; and in Sections 6, 7, 17, 18, 19, 20, 29
29, 30, 31, and 32, Township 47 South, Range 25 East; and in 30
Sections 1, 2, 3, 11, 12, 13, 14, 24, and 25, Township 47 South, 31
Range 24 East, in Lee County, Florida. Any and all submerged 32
lands conveyed by the Trustees of the Internal Improvement Trust 33
Fund prior to October 12, 1966, and any and all uplands now in 34
private ownership are specifically exempted from this preserve. 35

Any and all submerged lands theretofore conveyed by the Trustees 37
of the Internal Improvement Trust Fu nd and any and all uplands 38
now in private ownership are specifically exempted from this 39
dedication. 40
Section 2. This act shall take effect July 1, 2024. 41
