Subsection (8) is added to section 626.171, 15 Florida Statutes, as amended by HB 989 or similar legislation, 16 2024 Regular Session, to rea d: 17 626.171 Application for license as an agent, customer 18 representative, adjuster, service representative, or reinsurance 19 intermediary.— 20 (8)(a) Cellular telephone numbers collected by the 21 department under subsection (2) are exempt from s. 119.07(1) and 22 s. 24(a), Art. I of the State Constitution. This exemption 23 applies to cellular telephone numbers held by the department 24 before, on, or after the effective date of this act. 25 CS/HB 991 2024 CODING: Words stricken are deletions; words underlined are additions. hb0991-01-c1 Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (b) This subsection is subject to the Open Government 26 Sunset Review Act in accor dance with s. 119.15 and shall stand 27 repealed on October 2, 2029, unless reviewed and saved from 28 repeal through reenactment by the Legislature. 29 Section 2. The Legislature finds that it is a public 30 necessity that all cellular telephone numbers collected by the 31 Department of Financial Services pursuant to s. 626.171(2), 32 Florida Statutes, be exempt from public records requirements. 33 The Legislature finds that the unintentional publication of such 34 information may subject the filer to identity theft, financia l 35 harm, or other adverse impacts. Without the public records 36 exemption, the effective and efficient administration of the 37 electronic filing system, which is otherwise designed to 38 increase the ease of filing records, would be hindered. For 39 these reasons, the Legislature finds that it is a public 40 necessity to exempt such information from public records 41 requirements. 42 Section 3. The Division of Law Revision is directed to 43 replace the phrase "the effective date of this act" wherever it 44 occurs in this act wit h the date this act becomes a law. 45 Section 4. This act shall take effect on the same date 46 that HB 989 or similar legislation takes effect , if such 47 legislation is adopted in the same legislative session or an 48 extension thereof and becomes a law. 49
