A bill to be entitled 1 
An act relating to liability on optional motor vehicle 2 
equipment; creating s. 768.0429, F.S.; defining the 3 
term "motor vehicle"; providing that there is no 4 
obligation or duty to retrofit a motor vehicle with 5 
component parts or equipment in certain circumstances; 6 
providing that certain evidence is inadmissible in 7 
civil litigation; providing applicability; providing 8 
an effective date. 9

Be It Enacted by the Legislature of the State of Florida: 11 
 12 
 Section 1.  Section 768.0429, Florida Statutes, is created 13 
to read: 14 
 768.0429  Duty of care and admissibility of evidence in 15 
certain motor vehicle accidents. — 16 
 (1)  For purposes of this section, the term "motor vehi cle" 17 
means a self-propelled vehicle not operated upon rails or 18 
guideway, but not including any bicycle, electric bicycle, 19 
motorized scooter, electric personal assistive mobility device, 20 
mobile carrier, personal delivery device, swamp buggy, or moped. 21 
 (2)  In any civil action where a motor vehicle is involved 22 
in an accident, there is no obligation or duty of care for an 23 
owner, lessor, or operator of the motor vehicle, or for a person 24 
renting the motor vehicle to another person, to retrofit the 25

vehicle with component parts or optional equipment, or to have 26 
selected component parts or optional equipment to be included on 27 
the vehicle, if such parts or equipment were not required by the 28 
Federal Motor Vehicle Safety Standards under 49 C.F.R. part 571 29 
applicable when the vehicle was manufactured or sold. Evidence 30 
related to such an alleged obligation or duty is inadmissible. 31 
 (3)  This section does not apply if the owner, lessor, or 32 
operator of the motor vehicle, or the person renting the motor 33 
vehicle to another p erson, fails to comply with a law or 34 
regulation issued after the vehicle was manufactured or sold 35 
requiring a mandatory recall or retrofit of the vehicle. 36 
 Section 2.  This act shall take effect July 1, 2024. 37
