3131 Section 1. Paragraph (h) of subsection (2), subsection 18
3232 (3), and paragraph (d) of subsection (8) of section 121.0515, 19

5151 (3) CRITERIA.—A member, to be designated as a special risk 26
5252 member, must meet the following criteria: 27
5353 (a) Effective October 1, 1978, the member must be employed 28
5454 as a law enforcement officer and be certified, or required to be 29
5555 certified, in compliance with s. 943.1395; however, sheriffs and 30
5656 elected police chiefs are excluded from meeti ng the 31
5757 certification requirements of this paragraph. In addition, the 32
5858 member's duties and responsibilities must include the pursuit, 33
5959 apprehension, and arrest of law violators or suspected law 34
6060 violators; or as of July 1, 1982, the member must be an active 35
6161 member of a bomb disposal unit whose primary responsibility is 36
6262 the location, handling, and disposal of explosive devices; or 37
6363 the member must be the supervisor or command officer of a member 38
6464 or members who have such responsibilities. Administrative 39
6565 support personnel, including, but not limited to, those whose 40
6666 primary duties and responsibilities are in accounting, 41
6767 purchasing, legal, and personnel, are not included; 42
6868 (b) Effective October 1, 1978, the member must be employed 43
6969 as a firefighter and be certified, or required to be certified, 44
7070 in compliance with s. 633.408 and be employed solely within the 45
7171 fire department of a local government employer or an agency of 46
7272 state government with firefighting responsibilities. In 47

106106 custody, and physical restraint when necessary, of prisoners or 69

357357 1. The ability to qualify for the class of membership 236
358358 defined in paragraph (2)(h) occurs when two licensed medical 237
359359 physicians, one of whom is a prima ry treating physician of the 238
360360 member, certify the existence of the physical injury and medical 239
361361 condition that constitute a qualifying injury as defined in this 240
362362 paragraph and that the member has reached maximum medical 241
363363 improvement after August 1, 2008. The c ertifications from the 242
364364 licensed medical physicians must include, at a minimum, that the 243
365365 injury to the special risk member has resulted in a physical 244
366366 loss, or loss of use, of at least two of the following: left 245
367367 arm, right arm, left leg, or right leg; and: 246
368368 a. That this physical loss or loss of use is total and 247
369369 permanent, except if the loss of use is due to a physical injury 248
370370 to the member's brain, in which event the loss of use is 249
371371 permanent with at least 75 percent loss of motor function with 250

385385 b. That this physical loss or loss of use renders the 252
386386 member physically unable to perform the essential job functions 253

388388 c. That, notwithstanding this physical loss or loss of 255
389389 use, the individual can perform the essential job functions 256
390390 required by the member's new position, as provided in 257
391391 subparagraph 3. 258
392392 d. That use of artificial limbs is not possible or does 259
393393 not alter the member's ability to perform the essential job 260
394394 functions of the member's po sition. 261
395395 e. That the physical loss or loss of use is a direct 262
396396 result of a physical injury and not a result of any mental, 263
397397 psychological, or emotional injury. 264
398398 2. For the purposes of this paragraph, "qualifying injury" 265
399399 means an injury sustained in the lin e of duty, as certified by 266
400400 the member's employing agency, by a special risk member that 267
401401 does not result in total and permanent disability as defined in 268
402402 s. 121.091(4)(b). An injury is a qualifying injury if the injury 269
403403 is a physical injury to the member's ph ysical body resulting in 270
404404 a physical loss, or loss of use, of at least two of the 271
405405 following: left arm, right arm, left leg, or right leg. 272
406406 Notwithstanding any other provision of this section, an injury 273
407407 that would otherwise qualify as a qualifying injury is n ot 274
408408 considered a qualifying injury if and when the member ceases 275

423423 3. The new position, as described in sub -subparagraph 278
424424 1.c., that is required for qualification as a special risk 279
425425 member under this paragraph is not required to be a position 280
426426 with essential job functions that entitle an individual to 281
427427 special risk membership. Whether a new position as described in 282
428428 sub-subparagraph 1.c. exists and is available to the special 283
429429 risk member is a decision to be made solely by the employer in 284
430430 accordance with its hiring practices and applicable law. 285
431431 4. This paragraph does not grant or create additional 286
432432 rights for any individual to continued employment o r to be hired 287
433433 or rehired by his or her employer that are not already provided 288
434434 within the Florida Statutes, the State Constitution, the 289
435435 Americans with Disabilities Act, if applicable, or any other 290
436436 applicable state or federal law. 291
437437 (8) SPECIAL RISK ADMINIST RATIVE SUPPORT CLASS. — 292
438438 (d) Notwithstanding any other provision of this 293
439439 subsection, this subsection does not apply to any special risk 294
440440 member who qualifies for continued membership pursuant to 295
441441 paragraph (3)(k) (3)(j). 296

458458 121.021 Definitions. —The following words and phrases as 301
459459 used in this chapter have the respective meanings set forth 302
460460 unless a different meaning is plainly required by the context: 303
461461 (12) "Member" means any officer or employee who is covered 304
462462 or who becomes covered under this system in accordance with this 305
463463 chapter. On and after December 1, 1970, all new members and 306
464464 those members transferring from existing systems shall be 307
465465 divided into the following classes: "Special Risk Class," as 308
466466 provided in s. 121.0515; "Special Risk Administrative Support 309
467467 Class," as provided in s. 121 .0515(8); "Elected Officers' 310
468468 Class," as provided in s. 121.052; "Senior Management Service 311
469469 Class," as provided in s. 121.055; and "Regular Class," which 312
470470 consists of all members who are not in the Special Risk Class, 313
471471 Special Risk Administrative Support Clas s, Elected Officers' 314

473473 (15) "Special risk member" or "Special Risk Class member" 316
474474 means a member of the Florida Retirement System who meets the 317
475475 eligibility and criteria required under s. 121.0515 for 318

496496 Service Optional Annuity Program, or the State Community College 327

500500 investment plan unless employed in a position eligible for 331
501501 participation in the State University Sy stem Optional Retirement 332
502502 Program as provided in subsection (4) or the State Community 333
503503 College System Optional Retirement Program as provided in 334
504504 subsection (5). The renewed member must satisfy the vesting 335
505505 requirements and other provisions of this chapter. 336
506506 (a) A renewed member of the investment plan shall be 337
507507 enrolled in one of the following membership classes: 338
508508 1. In the Regular Class, if the position does not meet the 339
509509 requirements for membership under s. 121.0515, s. 121.053, or s. 340

517517 Section 4. The Legislature finds that a proper and 348
518518 legitimate state purpose is served when employees and retirees 349

532532 survivors, and beneficiaries of such employees and retirees, are 351
533533 extended the basic protections afforded by governmental 352
534534 retirement systems. These persons must be provided benefits that 353
535535 are fair and adequate and that are managed, administered, and 354
536536 funded in an actuarially sound manner as required by s. 14, 355
537537 Article X of the State Constitution and part VII of chapter 112, 356
538538 Florida Statutes. Therefore, the Legislature determines and 357
539539 declares that this act fulfills an important state interest. 358
540540 Section 5. This act shall take effect July 1, 2024. 359
