A bill to be entitled 1 
An act relating to the Florida State Psychiatric 2 
Hospital; creating s. 394.9088, F.S.; providing a 3 
short title; providing legislative findings and 4 
intent; establishing the Florida State Psychiatric 5 
Hospital in a specified location to provide 6 
specialized care for specified individuals; requiring 7 
the hospital to establish an admittance program for 8 
specified individuals; providing requirements for 9 
length of an individual's stay; providing for funding; 10 
providing that the hospital and its admittance program 11 
operate in conjunction with specified laws; requiring 12 
a court to consider permanent placement under certain 13 
circumstances; providing for release protocols; 14 
prohibiting the program from being used for specified 15 
individuals; requiring the Department of Health, in 16 
conjunction with the Department of Children and 17 
Families, to jointly oversee the implementation and 18 
administration of the program; providing severability ; 19 
providing an effective date. 20

Be It Enacted by the Legislature of the State of Florida: 22 
 23 
 Section 1.  Section 394.9088, Florida Statutes, is created 24 
to read: 25

 394.9088  Florida State Psychiatric Hospital. — 26 
 (1)  This act may be cited as the "Florid a State 27 
Psychiatric Hospital and Enhanced Admittance Programs Act." 28 
 (2)(a)  The Legislature finds that it is essential to 29 
address and provide comprehensive treatment for emotionally or 30 
psychologically disturbed individuals who pose a threat to their 31 
communities and society, with a specific focus on combatting and 32 
deterring gun violence in this state. 33 
 (b)  The purpose of this act is to establish the Florida 34 
State Psychiatric Hospital which shall establish enhanced 35 
admittance programs to ensure the safety o f communities, provide 36 
necessary long-term treatment for individuals who present a 37 
viable threat or danger, and serve as a model program for the 38 
potential expansion of psychiatric hospitals in other areas of 39 
the state. 40 
 (3)(a)  The Florida State Psychiatri c Hospital is hereby 41 
established in Chattahoochee. 42 
 (b)  The hospital shall be equipped and staffed to provide 43 
specialized care and treatment for emotionally or 44 
psychologically disturbed individuals who pose a threat to their 45 
communities and society. 46 
 (c)  The hospital shall have a 600 bed, male and female 47 
statewide program that serves residents of the state. 48 
 (4)(a)  The Florida State Psychiatric Hospital shall 49 
establish an admittance program for individuals who, according 50

to medical professionals' assessm ents, pose a threat to their 51 
communities and society due to emotional or psychological 52 
disturbances. 53 
 (b)  The length of an individual's stay in the hospital 54 
shall be determined by multiple health care practitioners and 55 
based on the individual's condition and progress. 56 
 (5)  The program's funding shall be derived from multiple 57 
sources, including an individual's health insurance, state 58 
funds, and federal grants, when applicable. 59 
 (6)(a)  The Florida State Psychiatric Hospital and its 60 
admittance program shall operate in conjunction with the Baker 61 
Act, but shall offer extended treatment durations beyond a 24 -62 
hour assessment period. 63 
 (b)  If extended treatment goes beyond 30 days, a court 64 
must consider permanent placement at the psychiatric hospital. 65 
 (7)(a)  Upon release, individuals admitted under this 66 
section are required to comply with protocols, including weekly 67 
mandatory medical visits and appointments. 68 
 (b)  Failure to comply with the prescribed protocols may 69 
result in readmittance to the Florida State P sychiatric 70 
Hospital. 71 
 (8)  The program may not be used for individuals with 72 
general psychological conditions or developmental disorders. The 73 
program is reserved exclusively for individuals who pose a 74 
viable threat or danger to their communities and society . 75

 (9)  The Department of Health, in conjunction with the 76 
Department of Children and Families, shall jointly oversee the 77 
implementation and administration of the program. 78 
 (10)  If any provision of this act or its application to 79 
any person or circumstance is held invalid, the invalidity does 80 
not affect other provisions or applications of this act that can 81 
be given effect without the invalid provision or application. 82 
 Section 2.  This act shall take effect July 1, 2024. 83
