5151 394.9088 Florida State Psychiatric Hospital. — 26
5252 (1) This act may be cited as the "Florid a State 27
5353 Psychiatric Hospital and Enhanced Admittance Programs Act." 28
5454 (2)(a) The Legislature finds that it is essential to 29
5555 address and provide comprehensive treatment for emotionally or 30
5656 psychologically disturbed individuals who pose a threat to their 31
5757 communities and society, with a specific focus on combatting and 32
5858 deterring gun violence in this state. 33
5959 (b) The purpose of this act is to establish the Florida 34
6060 State Psychiatric Hospital which shall establish enhanced 35
6161 admittance programs to ensure the safety o f communities, provide 36
6262 necessary long-term treatment for individuals who present a 37
6363 viable threat or danger, and serve as a model program for the 38
6464 potential expansion of psychiatric hospitals in other areas of 39
6565 the state. 40
6666 (3)(a) The Florida State Psychiatri c Hospital is hereby 41
6767 established in Chattahoochee. 42
6868 (b) The hospital shall be equipped and staffed to provide 43
6969 specialized care and treatment for emotionally or 44
7070 psychologically disturbed individuals who pose a threat to their 45
7171 communities and society. 46
7272 (c) The hospital shall have a 600 bed, male and female 47
7373 statewide program that serves residents of the state. 48
7474 (4)(a) The Florida State Psychiatric Hospital shall 49
7575 establish an admittance program for individuals who, according 50

8888 to medical professionals' assessm ents, pose a threat to their 51
8989 communities and society due to emotional or psychological 52
9090 disturbances. 53
9191 (b) The length of an individual's stay in the hospital 54
9292 shall be determined by multiple health care practitioners and 55
9393 based on the individual's condition and progress. 56
9494 (5) The program's funding shall be derived from multiple 57
9595 sources, including an individual's health insurance, state 58
9696 funds, and federal grants, when applicable. 59
9797 (6)(a) The Florida State Psychiatric Hospital and its 60
9898 admittance program shall operate in conjunction with the Baker 61
9999 Act, but shall offer extended treatment durations beyond a 24 -62
100100 hour assessment period. 63
101101 (b) If extended treatment goes beyond 30 days, a court 64
102102 must consider permanent placement at the psychiatric hospital. 65
103103 (7)(a) Upon release, individuals admitted under this 66
104104 section are required to comply with protocols, including weekly 67
105105 mandatory medical visits and appointments. 68
106106 (b) Failure to comply with the prescribed protocols may 69
107107 result in readmittance to the Florida State P sychiatric 70
108108 Hospital. 71
109109 (8) The program may not be used for individuals with 72
110110 general psychological conditions or developmental disorders. The 73
111111 program is reserved exclusively for individuals who pose a 74
112112 viable threat or danger to their communities and society . 75

125125 (9) The Department of Health, in conjunction with the 76
126126 Department of Children and Families, shall jointly oversee the 77
127127 implementation and administration of the program. 78
128128 (10) If any provision of this act or its application to 79
129129 any person or circumstance is held invalid, the invalidity does 80
130130 not affect other provisions or applications of this act that can 81
131131 be given effect without the invalid provision or application. 82
132132 Section 2. This act shall take effect July 1, 2024. 83
