51	51	394.9088 Florida State Psychiatric Hospital. — 26
52	52	(1) This act may be cited as the "Florid a State 27
53	53	Psychiatric Hospital and Enhanced Admittance Programs Act." 28
54	54	(2)(a) The Legislature finds that it is essential to 29
55	55	address and provide comprehensive treatment for emotionally or 30
56	56	psychologically disturbed individuals who pose a threat to their 31
57	57	communities and society, with a specific focus on combatting and 32
58	58	deterring gun violence in this state. 33
59	59	(b) The purpose of this act is to establish the Florida 34
60	60	State Psychiatric Hospital which shall establish enhanced 35
61	61	admittance programs to ensure the safety o f communities, provide 36
62	62	necessary long-term treatment for individuals who present a 37
63	63	viable threat or danger, and serve as a model program for the 38
64	64	potential expansion of psychiatric hospitals in other areas of 39
65	65	the state. 40
66	66	(3)(a) The Florida State Psychiatri c Hospital is hereby 41
67	67	established in Chattahoochee. 42
68	68	(b) The hospital shall be equipped and staffed to provide 43
69	69	specialized care and treatment for emotionally or 44
70	70	psychologically disturbed individuals who pose a threat to their 45
71	71	communities and society. 46
72	72	(c) The hospital shall have a 600 bed, male and female 47
73	73	statewide program that serves residents of the state. 48
74	74	(4)(a) The Florida State Psychiatric Hospital shall 49
75	75	establish an admittance program for individuals who, according 50

88	88	to medical professionals' assessm ents, pose a threat to their 51
89	89	communities and society due to emotional or psychological 52
90	90	disturbances. 53
91	91	(b) The length of an individual's stay in the hospital 54
92	92	shall be determined by multiple health care practitioners and 55
93	93	based on the individual's condition and progress. 56
94	94	(5) The program's funding shall be derived from multiple 57
95	95	sources, including an individual's health insurance, state 58
96	96	funds, and federal grants, when applicable. 59
97	97	(6)(a) The Florida State Psychiatric Hospital and its 60
98	98	admittance program shall operate in conjunction with the Baker 61
99	99	Act, but shall offer extended treatment durations beyond a 24 -62
100	100	hour assessment period. 63
101	101	(b) If extended treatment goes beyond 30 days, a court 64
102	102	must consider permanent placement at the psychiatric hospital. 65
103	103	(7)(a) Upon release, individuals admitted under this 66
104	104	section are required to comply with protocols, including weekly 67
105	105	mandatory medical visits and appointments. 68
106	106	(b) Failure to comply with the prescribed protocols may 69
107	107	result in readmittance to the Florida State P sychiatric 70
108	108	Hospital. 71
109	109	(8) The program may not be used for individuals with 72
110	110	general psychological conditions or developmental disorders. The 73
111	111	program is reserved exclusively for individuals who pose a 74
112	112	viable threat or danger to their communities and society . 75

125	125	(9) The Department of Health, in conjunction with the 76
126	126	Department of Children and Families, shall jointly oversee the 77
127	127	implementation and administration of the program. 78
128	128	(10) If any provision of this act or its application to 79
129	129	any person or circumstance is held invalid, the invalidity does 80
130	130	not affect other provisions or applications of this act that can 81
131	131	be given effect without the invalid provision or application. 82
132	132	Section 2. This act shall take effect July 1, 2024. 83
