354 | 354 | | crimes. This makes the cost of sexual offender victimization to 233 |

355 | 355 | | society at large, while incalculable, clearly exorbitant. 234 |
---|
356 | 356 | | (b) The high level of threat that a sexual predator 235 |
---|
357 | 357 | | presents to the public safety, and the long -term effects 236 |
---|
358 | 358 | | suffered by victims of sex offenses, provide the state with 237 |
---|
359 | 359 | | sufficient justification to implement a strategy that includes: 238 |
---|
360 | 360 | | 1. Incarcerating sexual predators and maintaining adequate 239 |
---|
361 | 361 | | facilities to ensure that decisions to release sexual predators 240 |
---|
362 | 362 | | into the community are not made on the basis of inadequate 241 |
---|
363 | 363 | | space. 242 |
---|
364 | 364 | | 2. Providing for specialized supervision of sexual 243 |
---|
365 | 365 | | predators who are in the community by specially trained 244 |
---|
366 | 366 | | probation officers with low caseloads, as d escribed in ss. 245 |
---|
367 | 367 | | 947.1405(7) and 948.30. The sexual predator is subject to 246 |
---|
368 | 368 | | specified terms and conditions implemented at sentencing or at 247 |
---|
369 | 369 | | the time of release from incarceration, with a requirement that 248 |
---|
370 | 370 | | those who are financially able must pay all or part of the costs 249 |
---|

395 | 395 | | for requiring sexual predators to register and for requiring 262 |
---|
396 | 396 | | community and public notification of the presence of sexual 263 |
---|
397 | 397 | | predators. 264 |

398 | 398 | | (d) It is the purpose of the Legislature that, upon the 265 |

399 | 399 | | court's written finding that an offender is a sexual predator, 266 |
---|
400 | 400 | | in order to protect the public, it is necessary that the sexual 267 |
---|
401 | 401 | | predator be registered with the department and that members of 268 |
---|
402 | 402 | | the community and th e public be notified of the sexual 269 |
---|
403 | 403 | | predator's presence. The designation of a person as a sexual 270 |
---|
404 | 404 | | predator is neither a sentence nor a punishment but simply a 271 |
---|
405 | 405 | | status resulting from the conviction of certain crimes. 272 |

651 | 651 | | any other law enforcement agency obtains info rmation which 434 |

652 | 652 | | indicates that an offender meets the sexual predator criteria 435 |

653 | 653 | | but the court did not make a written finding that the offender 436 |
---|
654 | 654 | | is a sexual predator as required in paragraph (a), the 437 |
---|
655 | 655 | | Department of Corrections, the department, or the law 438 |
---|
656 | 656 | | enforcement agency shall notify the state attorney who 439 |

657 | 657 | | prosecuted the offense for offenders described in subparagraph 440 |
---|
658 | 658 | | (a)1., or the state attorney of the county where the offender 441 |

805 | 805 | | to the department the name, address, and county of each 540 |
---|
806 | 806 | | institution, including each campus attended, and the sexual 541 |

807 | 807 | | predator's enrollment, volunteer, or employment status. The 542 |

809 | 809 | | Juvenile Justice shall promptly notify each institution of 544 |

1288 | 1288 | | (7) COMMUNITY AND PUBLIC NOTIFICATION. — 867 |

1356 | 1356 | | Corrections shall implement a system for verifying the addresses 911 |
---|
1357 | 1357 | | of sexual predators. The system must be consistent with the 912 |
---|
1358 | 1358 | | federal Adam Walsh Child Protection and Safety Act of 20 06 and 913 |
---|
1359 | 1359 | | any other federal standards applicable to such verification or 914 |
---|
1360 | 1360 | | required to be met as a condition for the receipt of federal 915 |
---|
1361 | 1361 | | funds by the state. The Department of Corrections shall verify 916 |
---|
1362 | 1362 | | the addresses of sexual predators who are not incarcerated but 917 |
---|
1363 | 1363 | | who reside in the community under the supervision of the 918 |
---|
1364 | 1364 | | Department of Corrections and shall report to the department any 919 |
---|

1472 | 1472 | | this state, and the personnel of those departments; an e lected 991 |

1473 | 1473 | | or appointed official, public employee, or school administrator; 992 |
