167167 Section 1. Paragraph (k) of subsection (1) of section 106
168168 30.15, Florida Statutes, is amended to read: 107
169169 30.15 Powers, duties, and obligations. — 108
170170 (1) Sheriffs, in their respective counties, in person or 109
171171 by deputy, shall: 110
172172 (k) Assist district school boards and charter school 111
173173 governing boards in complying with, or private schools in 112
174174 exercising options in, s. 1006.12. A sheriff must, at a minimum, 113
175175 provide access to a Chris Hixon, Coach Aaron Feis, and Coach 114
176176 Scott Beigel Guardian Program to aid in the prevention or 115
177177 abatement of active assailant incidents on school premises, as 116
178178 required under this paragraph. Persons certified as school 117
179179 guardians pursuant t o this paragraph have no authority to act in 118
180180 any law enforcement capacity except to the extent necessary to 119
181181 prevent or abate an active assailant incident. 120
182182 1.a. If a local school board has voted by a majority to 121
183183 implement a guardian program, the sheriff i n that county shall 122
184184 establish a guardian program to provide training, pursuant to 123
185185 subparagraph 2., to school district, charter school, or private 124

201201 b. A charter school governing board in a school district 128

205205 employees. If the county sheriff denies the request, the charter 132
206206 school governing board may contract with a sheriff that has 133

208208 charter school governing board must notify the superintendent 135
209209 and the sheriff in the charter school's county of the contract 136
210210 prior to its execution. 137
211211 c. A private school in a school district that has not 138

237237 as reimbursement for screening -related and training -related 152
238238 costs of any school district or charter school employee. 153
239239 d. The training program required in sub -subparagraph 2.b. 154
240240 is a standardized statewide curriculum, and each sheriff 155
241241 providing such training shall adhere to the course of 156
242242 instruction specified in that sub -subparagraph. This 157
243243 subparagraph does not prohibit a sheriff from providing 158
244244 additional training. A school guardian who has completed the 159
245245 training program required in sub -subparagraph 2.b. may not be 160
246246 required to attend another sheriff's training program pursuant 161
247247 to that sub-subparagraph unless there has been at least a 1 -year 162
248248 break in his or her appointment employment as a guardian. 163
249249 e. The sheriff conducting the training pursuant to 164
250250 subparagraph 2. for school district and charter school employees 165
251251 will be reimbursed for screening -related and training -related 166
252252 costs and for providing a one -time stipend of $500 to each 167
253253 school guardian who participates in the school guardian program. 168
254254 f. The sheriff may waive the training and screening -169
255255 related costs for a private school for a school guardian 170
256256 program. Funds provided pursuant to sub -subparagraph e. may not 171
257257 be used to subsidize any costs that have been waived by the 172
258258 sheriff. 173
259259 g. A person who is certified and in good standing under 174
260260 the Florida Criminal Justice Standards and Training Comm ission, 175

273273 who meets the qualifications established in s. 943.13, and who 176
274274 is otherwise qualified for the position of a school guardian may 177
275275 be certified as a school guardian by the sheriff without 178
276276 completing the training requirements of sub -subparagraph 2.b. 179
277277 However, a person certified as a school guardian under this sub -180
278278 subparagraph must meet the requirements of sub -subparagraphs 181
279279 2.c.-e. 182
280280 2. A sheriff who establishes a program shall consult with 183
281281 the Department of Law Enforcement on programmatic guiding 184
282282 principles, practices, and resources, and shall certify as 185
283283 school guardians, without the power of arrest, school employees, 186
284284 as specified in s. 1006.12(3), who: 187
285285 a. Hold a valid license issued under s. 790.06. 188
286286 b. Complete a 144-hour training program, consisting of 12 189
287287 hours of training to improve the school guardian's knowledge and 190
288288 skills necessary to respond to and de -escalate incidents on 191
289289 school premises certified nationally recognized diversity 192
290290 training and 132 total hours of comprehensive firearm safety and 193
291291 proficiency training conducted by Criminal Justice Standards and 194
292292 Training Commission-certified instructors, which must include: 195
293293 (I) Eighty hours of firearms instruction based on the 196
294294 Criminal Justice Stan dards and Training Commission's Law 197
295295 Enforcement Academy training model, which must include at least 198
296296 10 percent but no more than 20 percent more rounds fired than 199
297297 associated with academy training. Program participants must 200

318318 c. Pass a psychological evaluation administered by a 209
319319 psychologist licensed under chapter 490 and designated by the 210
320320 Department of Law Enforcement and submit the results of the 211
321321 evaluation to the sheriff's office. The Department of Law 212
322322 Enforcement is authorized to provide the sheriff's office with 213
323323 mental health and substance abuse data for compliance with this 214
324324 paragraph. 215
325325 d. Submit to and pass an in itial drug test and subsequent 216
326326 random drug tests in accordance with the requirements of s. 217
327327 112.0455 and the sheriff's office. 218
328328 e. Successfully complete ongoing training, weapon 219
329329 inspection, and firearm qualification on at least an annual 220
330330 basis. 221

348348 the sheriff, and shall maintain documentation of weapon and 227
349349 equipment inspections, as well as the training, certification, 228
350350 inspection, and qualification records of each school guardian 229

352352 certified under this paragr aph may serve as a school guardian 231
353353 under s. 1006.12(3) only if he or she is appointed by the 232
354354 applicable school district superintendent, charter school 233
355355 principal, or private school head of school. 234
356356 3.a.(I) Within 30 days after issuing a school guardian 235
357357 certificate, the sheriff who issued the certificate must report 236
358358 to the Department of Law Enforcement the name, date of birth, 237
359359 and certification date of the school guardian. 238
360360 (II) By September 1, 2024, each sheriff who issued a 239
361361 school guardian certificate mus t report to the Department of Law 240
362362 Enforcement the name, date of birth, and certification date of 241
363363 each school guardian who received a certificate from the 242
364364 sheriff. 243
365365 b.(I) By February 1 and September 1 of each school year, 244
366366 each school district, charter scho ol, and private school must 245
367367 report to the Department of Law Enforcement the name, date of 246
368368 birth, and appointment date of each person appointed as a school 247
369369 guardian. The school district, charter school, and private 248
370370 school must also report to the Department of Law Enforcement the 249

385385 (II) By September 1, 2024, each school district, charter 252
386386 school, and private school must report to the Department of Law 253
387387 Enforcement the name, da te of birth, and initial and end -of-254
388388 appointment dates, as applicable, of each person appointed as a 255

390390 c. The Department of Law Enforcement shall maintain a list 257
391391 of each person appointed as a school guardian in the state. The 258
392392 list must include the name and certification date of each school 259
393393 guardian and the date the person was appointed as a school 260
394394 guardian, including the name of the school district, charter 261
395395 school, or private school in which the school guardian is 262
396396 appointed, any information provided pursuant to s. 1006.12(5), 263
397397 and, if applicable, the date such person separated from his or 264
398398 her appointment as a school guardian. The Department of Law 265
399399 Enforcement shall remove from the list any person whose training 266
400400 has expired pursuant to sub -subparagraph 1.d. 267
401401 d. Each sheriff must report on a quarterly basis to the 268
402402 Department of Law Enforcement the schedule for upcoming school 269
403403 guardian trainings, including the dates of the training, the 270
404404 training locations, a contact person to register for the 271
405405 training, and the class capacity. The Department of Law 272
406406 Enforcement shall publish on its website a list of the upcoming 273
407407 school guardian trainings. The Department of Law Enforcement 274
408408 must update such list quarterly. 275

421421 e. A sheriff who fails to report the infor mation required 276
422422 by this subparagraph may not receive reimbursement from the 277
423423 Department of Education for school guardian trainings. Upon the 278
424424 submission of the required information, a sheriff is deemed 279
425425 eligible for such funding and is authorized to continue to 280
426426 receive reimbursement for school guardian training. 281
427427 f. A school district, charter school, or private school 282
428428 that fails to report the information required by this 283
429429 subparagraph may not operate a school guardian program for the 284
430430 following school year, unl ess the school district, charter 285
431431 school, or private school has submitted the required 286
432432 information. 287
433433 g. By March 1 and October 1 of each school year, the 288
434434 Department of Law Enforcement shall notify the Department of 289
435435 Education of any sheriff, school district , charter school, or 290
436436 private school that has not complied with the reporting 291
437437 requirements of this subparagraph. 292
438438 h. The Department of Law Enforcement may adopt rules to 293
439439 implement the requirements of this subparagraph, including 294
440440 requiring additional report ing information only as necessary to 295
441441 uniquely identify each school guardian reported. 296

461461 students in any grade from voluntary prekindergarten through 304

466466 (b) A person who violates paragraph (a) commits a 309
467467 misdemeanor of the second degree, punishable as provided in s. 310
468468 775.082 or s. 775.083. A person who commits a second or 311
469469 subsequent violation commits a misdemeanor of the first degree, 312

509509 school governing board must ensure that instruction on the use 340
510510 of the mobile suspicious activity reporting tool known as 341
511511 FortifyFL is provided to students. The instruction must be age 342
512512 and developmentally appropriate and include the consequences for 343
513513 making a threat or false report as described in ss. 790.162 and 344
514514 790.163, respectively, involving school or school personnel's 345
515515 property, school transportation, or a school -sponsored activity. 346

759759 (a) School safety specialist. —Each district school 506
760760 superintendent shall designate a school safety specialist for 507

762762 administrator employed by the school district or a law 509

764764 the school district. Any school safety specialist designated 511
765765 from the sheriff's office must first be authorized and approved 512
