206206 Section 1. (1) This act may be cited as the "Welcoming 133
207207 Florida Act." 134
208208 (2) It is the intent of the Legislature that the 135
209209 "Welcoming Florida Act" is centered on promoting the values that 136
210210 all Floridians share of fairness, safety, and prosperity. The 137
211211 Legislature finds that it is time to turn the page on policies 138
212212 that have failed the Florida economy and the millions of Florida 139
213213 families and return to values of treating everyone in our state 140
214214 with dignity and respect as contributing members of our society 141
215215 and economy, regardless of where they come from. This is a 142
216216 moment to open our arms to people who want to help build a 143
217217 brighter future together. The outcomes of recent legislation 144
218218 have been clearly and demonstrably harmful to Floridians and our 145
219219 economy. The state has an opportunity to embody our shared 146
220220 values while also putting the economic prosperity of our 147
221221 communities first. 148

428428 However, the department may waive the knowledge, endorsement, 283
429429 and skills tests for an applicant who is otherwise qualified , 284
430430 except for an applicant who provides proof of identity under s. 285
431431 322.08(2)(c)9.-18., and who surrenders a valid driver license 286
432432 from another state or a province o f Canada, or a valid driver 287
433433 license issued by the United States Armed Forces, if the driver 288
434434 applies for a Florida license of an equal or lesser 289
435435 classification. An applicant who fails to pass the initial 290
436436 knowledge test incurs a $10 fee for each subsequent t est, to be 291
437437 deposited into the Highway Safety Operating Trust Fund, except 292
438438 that if a subsequent test is administered by the tax collector, 293
439439 the tax collector shall retain such $10 fee, less the general 294
440440 revenue service charge set forth in s. 215.20(1). An app licant 295
441441 who fails to pass the initial skills test incurs a $20 fee for 296
442442 each subsequent test, to be deposited into the Highway Safety 297
443443 Operating Trust Fund, except that if a subsequent test is 298
444444 administered by the tax collector, the tax collector shall 299

459459 materials endorsement, pursuant to s. 322.57(1)(e), must pass 302
460460 the hazardous-materials test, upon surrendering his or her 303
461461 commercial driver license, if the person has not taken and 304
462462 passed the hazardous -materials test within 2 years before 305
463463 applying for a commercial driver license in this state. 306
464464 Section 5. Section 322.142, Florida Statutes, is amended 307
465465 to read: 308
466466 322.142 Color photographic or digital imaged licenses ; 309
467467 protection of personal information .β€” 310
468468 (1) The department shall, upon receipt of the required 311
469469 fee, issue to each qualified applicant for a driver license a 312
470470 color photographic or digital imaged driver license bearing a 313
471471 fullface photograph or digital image of the licensee. 314
472472 Notwithstanding chapter 761 or s. 761.05, the requirement for a 315
473473 fullface photograph or digital image of the licensee may not be 316
474474 waived. A space shall be provided upon which the licensee shall 317
475475 affix his or her usual signature, as required in s. 322.14, in 318
476476 the presence of an authorized agent of the department so as to 319
477477 ensure that such signature becomes a part of the license. 320
478478 (2) The department shall, upon receipt of the required 321
479479 fee, issue to each qua lified licensee applying for a renewal 322
480480 license in accordance with s. 322.18 a color photographic or 323
481481 digital imaged license as provided for in subsection (1). 324

496496 qualifications for the development and production of 327

498498 assure efficient and economical processing of such licenses in 329
499499 sufficient quantity and of acceptable quality to meet the 330
500500 requirements and intent of this section, and to ensure adequate 331
501501 service at a sufficient number of locations, at the lowest 332
502502 competitive sealed bid price. 333
503503 (4) The department may maintain a film negative or print 334
504504 file. The department shall maintain a record of the digital 335
505505 images and signatures image and signature of the licensees, 336
506506 together with other data required by the department for 337
507507 identification and retrieval. Reproductions from the file or 338
508508 digital record are exempt from the provisions of s. 119.07(1) 339
509509 and may be made and issued only for any of the following 340
510510 purposes: 341
511511 (a) For departmental administrative purposes .; 342
512512 (b) For the issuance of duplicate licenses .; 343
513513 (c) In response to law enforcement agency requests , except 344

949949 (b) If a contractor enters into a contract with a 636
950950 subcontractor, the subcontractor must provide the contractor 637
951951 with an affidavit stating that the subcontractor does not 638
952952 employ, contract with, or subcontract with an unauthorized 639
953953 alien. The contractor shall maintain a copy of such affidavit 640
954954 for the duration of the contract. 641
955955 (c)1. A public agency, contractor, or subcontractor who 642
956956 has a good faith belief that a person or an entity with which it 643
957957 is contracting has knowingly violated s. 448.09(1) shall 644
