2222 Be It Enacted by the Legislature of the State of Florida: 9

2424 Section 1. Paragraph (b) of subsection (1) of section 11
2525 252.38, Florida Statutes, is amended to read: 12
2626 252.38 Emergency management powers of political 13
2727 subdivisions.—Safeguarding the life and property of its citizens 14
2828 is an innate responsibility of the governing body of each 15
2929 political subdivision of the state. 16
3030 (1) COUNTIES.— 17
3131 (b)1. Each county emergency management agency created and 18
3232 established pursuant to ss. 252.31 -252.90 shall have a director. 19
3333 The director must meet the following minimum training and 20
3434 education qualifications : 21
3535 a. Fifty hours of training in business or public 22
3636 administration, business or public management, or emergency 23
3737 management or preparedness. A bachelor's degree may be 24
3838 substituted for this training requirement. 25

5151 b. Four years of verifiable experience in comprehensive 26
5252 emergency management services that includes improving 27
5353 preparedness for emergency and disaster protection, prevention, 28
5454 mitigation, response, and recovery, with direct supervisory 29
5555 responsibility for responding to at least 1 emergency or 30
5656 disaster. 31
5757 (I) A master's degree in emer gency preparedness or 32
5858 management, business or public administration, communications, 33
5959 finance, homeland security, public health, criminal justice, 34
6060 meteorology, or environmental science may be substituted for 2 35
6161 of the years of experience required in this sub -subparagraph but 36
6262 not for the required supervisory experience. 37
6363 (II) A valid accreditation as a Certified Master Exercise 38
6464 Practitioner through the Federal Emergency Management Agency, 39
6565 Certified Emergency Manager through the International 40
6666 Association of Emergency Managers, or Florida Professional 41
6767 Emergency Manager through the Florida Emergency Preparedness 42
6868 Association may be substituted for the requirements of this sub -43
6969 subparagraph. A certification used as a substitution for the 44
7070 requirements of this sub -subparagraph must be currently 45
7171 maintained in good standing at all times until the actual time 46
7272 and experience requirements satisfying this sub -subparagraph are 47
7373 met by the appointee. 48
7474 c. Completion of 150 hours in comprehensive emergency 49
7575 management training pr ovided through or approved by the Federal 50

125125 applicable, to serve at the pleasure of the appointing 76
126126 authority, in conformance with applicable resolutions, 77
127127 ordinances, and laws. 78
128128 3. A county constitutional officer, or an employee of a 79
129129 county constitutional officer, may be appointed as director 80
130130 following prior notification to the division. 81
131131 4. Each board of county commissioners shall promptly 82
132132 inform the division of the appointment of the director and other 83
133133 personnel. 84
134134 5. Each director has direct responsibility for the 85
135135 organization, administration, and operation of the county 86
136136 emergency management agency. The director shall coordinate 87
137137 emergency management activities, services, and programs within 88
138138 the county and shall serve as liaison to the division and other 89
139139 local emergency management ag encies and organizations. 90
140140 Section 2. A county emergency management director who does 91
141141 not satisfy the training or certification requirements of 92
142142 section 1 of this act as of July 1, 2024, shall have until June 93
143143 30, 2026, to complete such requirements. 94
144144 Section 3. This act shall take effect July 1, 2024. 95
