2222 Be It Enacted by the Legislatur e of the State of Florida: 11

2424 Section 1. Effective October 1, 2024, subsection (1) of 13
2525 section 2 and section 3 of section 3 of chapter 2005 -347, Laws 14
2626 of Florida, are amended to read: 15
2727 Section 2. (1) District created. —There is hereby created 16
2828 a special taxing fire protection and rescue service district 17
2929 incorporating lands in Santa Rosa County described in subsection 18
3030 (2) which shall be a public corporation having the powers, 19
3131 duties, obligations, and immunities herein set forth, under the 20
3232 name of the Avalon Beach-Mulat Fire Protection District and also 21
3333 known as the Avalon Fire/Rescue District with all the powers and 22
3434 duties specified in chapter 191, Florida Statutes, including the 23
3535 authority to levy and collect non-ad valorem and ad valorem 24
3636 assessments but not including the authority to assess and levy 25

4848 Section 3. Procedures for the levy and collection of non -27
4949 ad valorem assessments Ad valorem taxation.— 28
5050 (1) The district is authorized to levy and enforce non -ad 29
5151 valorem assessments in acco rdance with chapters 170, 189, 191, 30
5252 and 197, Florida Statutes, as amended from time to time board 31
5353 shall have the right, power, and authority to levy ad valorem 32
5454 tax millage within the district to provide funds for the 33
5555 purposes of the district . 34
5656 (2) The non-ad valorem assessments may be levied up to the 35
5757 following maximum amounts: 36
5858 (a) Two hundred fifty dollars for residential properties 37
5959 up to 1,600 square feet, with an additional $0.1544 per square 38
6060 foot in excess of 1,600 square feet. 39
6161 (b) Thirty dollars and 96 cents for vacant land. 40
6262 (c) Five hundred dollars for commercial properties up to 41
6363 950 square feet, with an additional $0.1544 per square foot in 42
6464 excess of 950 square feet. 43
6565 (d) Thirty dollars and 96 cents for unimproved acreage up 44
6666 to 3 acres, with an additional $10.32 per acre in excess of 3 45
6767 acres rate of taxation shall be fixed by a resolution of the 46
6868 board; however, the maximum millage proposed in the initial 47
6969 referendum shall not exceed 1 mill, unless increased by 48
7070 referendum pursuant to section 191 .009, Florida Statutes . 49
7171 Section 2. Notwithstanding s. 191.009, Florida Statutes, 50

8282 or any other provision of law, the Board of Commissioners of the 51
8383 Avalon Beach-Mulat Fire Protection District may adopt an initial 52
8484 levy of a non-ad valorem assessment, subj ect to the rate 53
8585 limitations set forth in section 1 of this act, by resolution 54
8686 pursuant to s. 191.011, Florida Statutes, adopted before July 1, 55
8787 2024, without the need for a referendum. Future non -ad valorem 56
8888 assessment rates are subject to s. 191.009, Florid a Statutes, 57
8989 and other applicable law. 58
9090 Section 3. Except as otherwise expressly provided in this 59
9191 act, this act shall take effect upon becoming a law. 60
