A bill to be entitled 1 
An act relating to affordable housing inclusionary 2 
housing ordinances; amending ss. 125.01055 and 3 
166.04151, F.S.; requiring, rather than authorizing, 4 
inclusionary housing ordinances to require developers 5 
to provide a specified number or percentage of 6 
affordable housing units; deleting the authorization 7 
for a developer to contribute to a housing fund or 8 
other alternatives in lieu of building affordable 9 
housing units; providing an effective date. 10

Be It Enacted by the Legislature of the State of Florida: 12 
 13 
 Section 1.  Subsection (2) of section 125.01055, Florida 14 
Statutes, is amended to read: 15 
 125.01055  Affordable housing. — 16 
 (2)  An inclusionary ho using ordinance must may require a 17 
developer to provide a specified number or percentage of 18 
affordable housing units to be included in a development or 19 
allow a developer to contribute to a housing fund or other 20 
alternatives in lieu of building the affordab le housing units. 21 
 Section 2.  Subsection (2) of section 166.04151, Florida 22 
Statutes, is amended to read: 23 
 166.04151  Affordable housing. — 24

 Section 3.  This act shall take effect July 1, 2024. 30
