A bill to be entitled 1 
An act relating to medical cannabis cardholders from 2 
other states; amending s. 893.13, F.S.; exempting 3 
holders of medical cannabis cards from other states 4 
from provisions prohibiting bringing controlled 5 
substances into the state in certain circumstances; 6 
providing an effective date. 7 
 8 
Be It Enacted by the Legislature of the State of Florida: 9 
 10 
 Section 1.  Subsection (5) of section 893.13, Florida 11 
Statutes, is amended to read: 12 
 893.13  Prohibited acts; penalties. — 13 
 (5)  A person may not bring into this state any controlled 14 
substance unless the possession of such controlled substance is 15 
authorized by this chapter , obtained through another state's 16 
medical cannabis program when the person bringing in the 17 
cannabis holds a valid medical cannabis card from that state for 18 
that cannabis, or unless such person is licensed to do so by the 19 
appropriate federal agency. A person who violates this provision 20 
with respect to: 21 
 (a)  A controlled substance named or described in s. 22 
893.03(1)(a), (1)(b), (1)(d), (2)(a), (2)(b), or (2)(c)5. 23 
commits a felony of the second degree, punishable as provided in 24 
s. 775.082, s. 775.083, or s. 775.084. 25

 (b)  A controlled substance named or des cribed in s. 26 
893.03(1)(c), (2)(c)1., (2)(c)2., (2)(c)3., (2)(c)6., (2)(c)7., 27 
(2)(c)8., (2)(c)9., (2)(c)10., (3), or (4) commits a felony of 28 
the third degree, punishable as provided in s. 775.082, s. 29 
775.083, or s. 775.084. 30 
 (c)  A controlled substance name d or described in s. 31 
893.03(5) commits a misdemeanor of the first degree, punishable 32 
as provided in s. 775.082 or s. 775.083. 33 
 Section 2.  This act shall take effect upon becoming a law. 34
