Florida Senate - 2024 SB 538 By Senator Harrell 31-00752A-24 2024538__ 1 A bill to be entitled 2 An act relating to traveling across county lines to 3 commit criminal offenses; amending s. 843.22, F.S.; 4 deleting the definition of the term burglary; 5 providing for reclassification of grand theft or 6 forcible felony offenses if the person who commits the 7 offense travels with the intent to commit the offense 8 in a county other than the persons county of 9 residence; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1.Section 843.22, Florida Statutes, is amended to 14 read: 15 843.22Traveling across county lines with intent to commit 16 certain offenses a burglary. 17 (1)As used in this section, the term: 18 (a)county of residence means the county within this 19 state in which a person resides. Evidence of a persons county 20 of residence includes, but is not limited to: 21 (a)1.The address on a persons driver license or state 22 identification card.; 23 (b)2.Records of real property or mobile home ownership.; 24 (c)3.Records of a lease agreement for residential 25 property.; 26 (d)4.The county in which a persons motor vehicle is 27 registered.; 28 (e)5.The county in which a person is enrolled in an 29 educational institution.; and 30 (f)6.The county in which a person is employed. 31 (b)Burglary means burglary as defined in s. 810.02, 32 including an attempt, solicitation, or conspiracy to commit such 33 offense. 34 (2)If a person who commits a grand theft or a forcible 35 felony, as defined in s. 776.08, burglary travels any distance 36 with the intent to commit the offense burglary in a county in 37 this state other than the persons county of residence, the 38 degree of the offense burglary shall be reclassified to the next 39 higher degree. For purposes of sentencing under chapter 921 and 40 determining incentive gain-time eligibility under chapter 944, 41 an offense a burglary that is reclassified under this section is 42 ranked one level above the ranking specified in s. 921.0022 or 43 s. 921.0023 for the offense burglary committed. 44 Section 2.This act shall take effect upon becoming a law.
