24	24	aliens who willfully submit false voter registration 11

26	26	such a registrant is an unauthorized alien; amending 13

28	28	unauthorized aliens who, knowing that they are not 15
29	29	qualified electors, willfully vote at any election and 16
30	30	for persons who aid or solicit another person who is 17

34	34	Be It Enacted by the Legislature of the State of Florida: 21

36	36	Section 1. Section 97.051, Florida Statutes, is amended to 23
37	37	read: 24
38	38	97.051 Oath upon registering. —A person registering to vote 25

51	51	must subscribe to the following oath: "I do solemnly swear (or 26
52	52	affirm) that I will protect and defend the Constitution of the 27
53	53	United States and the Constitution of the State of Florida, that 28
54	54	I am qualified to register as an elector under the Constitution 29
55	55	and laws of the State of Florida, and that all information 30
56	56	provided in this application is true. I have carefully reviewed 31
57	57	the instructions for completing the Florida Voter Registration 32
58	58	Application, and I further swear (or affirm) that I am a United 33
59	59	States citizen, and I understand that if I have provided false 34
60	60	information on this application I could be subject to criminal 35
61	61	penalties for perjury and that I may be fined, imprisoned, or, 36
62	62	if not a United States citizen, deported from or refused entry 37
63	63	into the United States. " 38
64	64	Section 2. Effective March 31, 2025, sec tion 104.011, 39
65	65	Florida Statutes, is amended to read: 40
66	66	104.011 False swearing; submission of false voter 41
67	67	registration information; prosecution prohibited. — 42
68	68	(1)(a) A person who willfully swears or affirms falsely to 43
69	69	any oath or affirmation, or willfully pr ocures another person to 44
70	70	swear or affirm falsely to an oath or affirmation, in connection 45
71	71	with or arising out of voting or elections commits a felony of 46
72	72	the third degree, punishable as provided in s. 775.082, s. 47
73	73	775.083, or s. 775.084. 48
74	74	(b) A person who commits a violation of paragraph (a) and 49
75	75	who is an unauthorized alien as defined in s. 908.111, or who 50

88	88	assists another in violation of paragraph (a) and has knowledge 51
89	89	that the registrant is an unauthorized alien as defined in s. 52
90	90	908.111, commits a felony of the second degree, punishable as 53
91	91	provided in s. 775.082, s. 775.083, or s. 775.084. 54
92	92	(2)(a) A person who willfully submits any false voter 55
93	93	registration information commits a felony of the third degree, 56
94	94	punishable as provided in s. 775.082 or s. 775.083. 57
95	95	(b) A person who commits a violation of paragraph (a) and 58
96	96	who is an unauthorized alien as defined in s. 908.111, or who 59
97	97	assists another in violation of paragraph (a) and has knowledge 60
98	98	that the registrant is an unauthorized alien as defined in s. 61
99	99	908.111, commits a felony of the second degree, punishable as 62
100	100	provided in s. 775.082, s. 775.083, or s. 775.084. 63
101	101	(3) A person may not be charged or convicted for a 64
102	102	violation of this section for affirming that he or she has not 65
103	103	been convicted of a felony or that, if convicted, he or she has 66
104	104	had voting rights restored, if such violation is alleged to have 67
105	105	occurred on or after January 8, 2019, but before July 1, 2019. 68
106	106	Section 3. Section 104.15, Florida Statutes, is amended to 69
107	107	read: 70
108	108	104.15 Unqualified electors willfully voting.— 71
109	109	(1) Whoever, knowing he or she is not a qualified elector, 72
110	110	willfully votes at any election is guilty of a felony of the 73
111	111	third degree, punishable as provided in s. 775.082, s. 775.083, 74

125	125	(2) A person who commits a violation of subsection (1) and 76
126	126	who is an unauthorized alien as defined in s. 908.111, or a 77
127	127	person who aids or solicits another to violate subsection (1) 78
128	128	with knowledge that such person is an unauthorized alien as 79
129	129	defined in s. 908.111, commits a felony of the second degree, 80
130	130	punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 81
131	131	Section 4. If any provision of this act or its 82
132	132	application to any person or circumstance is held invalid, the 83
133	133	invalidity does not affect other provisions or applicati ons of 84
134	134	this act which can be given effect without the invalid provision 85
135	135	or application, and to this end the provisions of this act are 86
136	136	severable. 87
137	137	Section 5. Except as otherwise expressly provided in this 88
138	138	act, this act shall take effect upon becoming a law. 89
