23	23	Be It Enacted by the Legislature of the State of Florida: 10

25	25	Section 1. Subsection (12) of section 1009.26, Florida 12
26	26	Statutes, is amended to read: 13
27	27	1009.26 Fee waivers. — 14
28	28	(12)(a) A state university, a Florida College System 15
29	29	institution, a career center operated by a school district under 16
30	30	s. 1001.44, or a charter technical career center shall waive 17
31	31	out-of-state fees for students, including, but not limited to, 18
32	32	students who are undocumented for federal immigration purposes, 19
33	33	who meet the following conditions: 20
34	34	1. Attended a secondary school in this state for 3 21
35	35	consecutive years immediately before graduating from a high 22
36	36	school in this state; 23
37	37	2. Apply for enrollment in an institution of higher 24
38	38	education within 24 months after high school graduation; and 25

51	51	3. Submit an official Florida high school transcript as 26
52	52	evidence of attendance and graduation. 27
53	53	(b) Tuition and fees charged to a student who qualifies 28
54	54	for the out-of-state fee waiver under this subsection may not 29
55	55	exceed the tuition and fees charged to a resident student. The 30
56	56	waiver is applicable for 110 percent of the required credit 31
57	57	hours of the degree or certi ficate program for which the student 32
58	58	is enrolled. Each state university, Florida College System 33
59	59	institution, career center operated by a school district under 34
60	60	s. 1001.44, and charter technical career center shall report to 35
61	61	the Board of Governors and the St ate Board of Education, 36
62	62	respectively, the number and value of all fee waivers granted 37
63	63	annually under this subsection. By October 1 of each year, the 38
64	64	Board of Governors for the state universities and the State 39
65	65	Board of Education for Florida College System i nstitutions, 40
66	66	career centers operated by a school district under s. 1001.44, 41
67	67	and charter technical career centers shall annually report for 42
68	68	the previous academic year the percentage of resident and 43
69	69	nonresident students enrolled systemwide. 44
70	70	(c) A state university student granted an out -of-state fee 45
71	71	waiver under this subsection must be considered a nonresident 46
72	72	student for purposes of calculating the systemwide total 47
73	73	enrollment of nonresident students as limited by regulation of 48
74	74	the Board of Governors. In add ition, a student who is granted an 49
75	75	out-of-state fee waiver under this subsection is not eligible 50

88	88	for state financial aid under part III of this chapter and must 51
89	89	not be reported as a resident for tuition purposes. 52
90	90	(d) A state university, a Florida College System 53
91	91	institution, a career center operated by a school district under 54
92	92	s. 1001.44, or a charter technical career center shall, within 55
93	93	the nonresident student enrollment systemwide, prioritize the 56
94	94	enrollment of a veteran who is granted an out -of-state fee 57
95	95	waiver pursuant to the Congressman C.W. "Bill" Young Tuition 58
96	96	Waiver Act over a student who is granted an out -of-state fee 59
97	97	waiver under this subsection. 60
98	98	Section 2. If any provision of this act or its application 61
99	99	to any person or circumstance is held in valid, the invalidity 62
100	100	does not affect other provisions or applications of this act 63
101	101	which can be given effect without the invalid provision or 64
102	102	application, and to this end the provisions of this act are 65
103	103	severable. 66
104	104	Section 3. This act shall take effect July 1, 2025. 67
