2323 Be It Enacted by the Legislature of the State of Florida: 10

2525 Section 1. Subsection (12) of section 1009.26, Florida 12
2626 Statutes, is amended to read: 13
2727 1009.26 Fee waivers. — 14
2828 (12)(a) A state university, a Florida College System 15
2929 institution, a career center operated by a school district under 16
3030 s. 1001.44, or a charter technical career center shall waive 17
3131 out-of-state fees for students, including, but not limited to, 18
3232 students who are undocumented for federal immigration purposes, 19
3333 who meet the following conditions: 20
3434 1. Attended a secondary school in this state for 3 21
3535 consecutive years immediately before graduating from a high 22
3636 school in this state; 23
3737 2. Apply for enrollment in an institution of higher 24
3838 education within 24 months after high school graduation; and 25

5151 3. Submit an official Florida high school transcript as 26
5252 evidence of attendance and graduation. 27
5353 (b) Tuition and fees charged to a student who qualifies 28
5454 for the out-of-state fee waiver under this subsection may not 29
5555 exceed the tuition and fees charged to a resident student. The 30
5656 waiver is applicable for 110 percent of the required credit 31
5757 hours of the degree or certi ficate program for which the student 32
5858 is enrolled. Each state university, Florida College System 33
5959 institution, career center operated by a school district under 34
6060 s. 1001.44, and charter technical career center shall report to 35
6161 the Board of Governors and the St ate Board of Education, 36
6262 respectively, the number and value of all fee waivers granted 37
6363 annually under this subsection. By October 1 of each year, the 38
6464 Board of Governors for the state universities and the State 39
6565 Board of Education for Florida College System i nstitutions, 40
6666 career centers operated by a school district under s. 1001.44, 41
6767 and charter technical career centers shall annually report for 42
6868 the previous academic year the percentage of resident and 43
6969 nonresident students enrolled systemwide. 44
7070 (c) A state university student granted an out -of-state fee 45
7171 waiver under this subsection must be considered a nonresident 46
7272 student for purposes of calculating the systemwide total 47
7373 enrollment of nonresident students as limited by regulation of 48
7474 the Board of Governors. In add ition, a student who is granted an 49
7575 out-of-state fee waiver under this subsection is not eligible 50

8989 not be reported as a resident for tuition purposes. 52
9090 (d) A state university, a Florida College System 53
9191 institution, a career center operated by a school district under 54
9292 s. 1001.44, or a charter technical career center shall, within 55
9393 the nonresident student enrollment systemwide, prioritize the 56
9494 enrollment of a veteran who is granted an out -of-state fee 57
9595 waiver pursuant to the Congressman C.W. "Bill" Young Tuition 58
9696 Waiver Act over a student who is granted an out -of-state fee 59
9797 waiver under this subsection. 60
9898 Section 2. If any provision of this act or its application 61
9999 to any person or circumstance is held in valid, the invalidity 62
100100 does not affect other provisions or applications of this act 63
101101 which can be given effect without the invalid provision or 64
102102 application, and to this end the provisions of this act are 65
103103 severable. 66
104104 Section 3. This act shall take effect July 1, 2025. 67
