2323 Be It Enacted by the Legislature of the State of Florida: 10

2525 Section 1. Subsections (2), (3), and (4) of section 12
2626 180.191, Florida Statutes, are renumbered as subsections (3), 13
2727 (4), and (5), respectively, subsection (1) is amended, and a new 14
2828 subsection (2) is added to that section, to read: 15
2929 180.191 Limitation on rates charged consumer outside city 16
3030 limits.— 17
3131 (1) Any municipality within this the state that operates 18
3232 operating a water or sewer utility outside of the boundaries of 19
3333 the such municipality shall charge consumers outside the 20
3434 boundaries rates, fees, and charges d etermined in one of the 21
3535 following manners: 22
3636 (a) It may charge the same rates, fees, and charges as 23
3737 consumers inside the municipal boundaries. However, in addition 24
3838 thereto, the municipality may add a surcharge of not more than 25

5151 25 percent of such rates, fee s, and charges to consumers outside 26
5252 the boundaries, except as provided in subsection (2) . Fixing of 27
5353 the such rates, fees, and charges in this manner does shall not 28
5454 require a public hearing except as may be provided for service 29
5555 to consumers inside the munic ipality. 30
5656 (b) It may charge rates, fees, and charges that are just 31
5757 and equitable and that which are based on the same factors used 32
5858 in fixing the rates, fees, and charges for consumers inside the 33
5959 municipal boundaries , except as provided in subsection (2) . In 34
6060 addition thereto, the municipality may add a surcharge not to 35
6161 exceed 25 percent of the such rates, fees, and charges for said 36
6262 services to consumers outside the boundaries. However, the total 37
6363 of all the such rates, fees, and charges for the services to 38
6464 consumers outside the boundaries may shall not be more than 50 39
6565 percent in excess of the total amount the municipality charges 40
6666 consumers served within the municipality for corresponding 41

9393 plant or sewer treatment plant located within the boundaries of 56

9797 Section 2. This act shall take effect July 1, 2025. 60
