163-added to subsection (6) of that section, to read: 102
164- 409.906 Optional Medicaid services.—Subject to specific 103
165-appropriations, the agency may make payments for services which 104
166-are optional to the state under Title XIX of the Social Security 105
167-Act and are furnished by Medicaid providers to recipients who 106
168-are determined to be eligib le on the dates on which the services 107
169-were provided. Any optional service that is provided shall be 108
170-provided only when medically necessary and in accordance with 109
171-state and federal law. Optional services rendered by providers 110
172-in mobile units to Medicaid rec ipients may be restricted or 111
173-prohibited by the agency. Nothing in this section shall be 112
174-construed to prevent or limit the agency from adjusting fees, 113
175-reimbursement rates, lengths of stay, number of visits, or 114
176-number of services, or making any other adjustm ents necessary to 115
177-comply with the availability of moneys and any limitations or 116
178-directions provided for in the General Appropriations Act or 117
179-chapter 216. If necessary to safeguard the state's systems of 118
180-providing services to elderly and disabled persons an d subject 119
181-to the notice and review provisions of s. 216.177, the Governor 120
182-may direct the Agency for Health Care Administration to amend 121
183-the Medicaid state plan to delete the optional Medicaid service 122

237-provided under this program include treatme nt of the teeth and 152
238-associated structures of the oral cavity, as well as treatment 153
239-of disease, injury, or impairment that may affect the oral or 154
240-general health of the individual. However, Medicaid will not 155
241-provide reimbursement for dental services provided in a mobile 156
242-dental unit, except for a mobile dental unit: 157
243- (e) Owned by, operated by, or having a contractual 158
244-agreement with a health access setting as defined in s. 466.003 159
245-or a similar setting or program. 160
246- Section 2. Section 466.001, Florida Statute s, is amended 161
247-to read: 162
248- 466.001 Legislative purpose and intent. —The legislative 163
249-purpose for enacting this chapter is to ensure that every 164
250-dentist, dental therapist, or dental hygienist practicing in 165
251-this state meets minimum requirements for safe practice without 166
252-undue clinical interference by persons not licensed under this 167
253-chapter. It is the legislative intent that dental services be 168
254-provided only in accordance with the provisions of this chapter 169
255-and not be delegated to unauthorized individuals. It is the 170
256-further legislative intent that dentists , dental therapists, and 171
257-dental hygienists who fall below minimum competency or who 172
258-otherwise present a danger to the public shall be prohibited 173
259-from practicing in this state. All provisions of this chapter 174
260-relating to the practice of dentistry , dental therapy, and 175

275- Section 3. Subsections (5) a nd (6) of section 466.002, 178
276-Florida Statutes, are amended to read: 179
277- 466.002 Persons exempt from operation of chapter. —Nothing 180
278-in This chapter does not shall apply to the following practices, 181

280- (5) Students in Florida schools of dentis try, dental 183
281-therapy, and dental hygiene or dental assistant educational 184
282-programs, while performing regularly assigned work under the 185
283-curriculum of such schools or programs. 186
284- (6) Instructors in Florida schools of dentistry, 187
285-instructors in dental programs t hat prepare persons holding 188
286-D.D.S. or D.M.D. degrees for certification by a specialty board 189
287-and that are accredited in the United States by January 1, 2005, 190
288-in the same manner as the board recognizes accreditation for 191
289-Florida schools of dentistry that are not otherwise affiliated 192
290-with a Florida school of dentistry, or instructors in Florida 193
291-schools of dental hygiene , dental therapy, or dental assistant 194
292-educational programs, while performing regularly assigned 195
293-instructional duties under the curriculum of suc h schools or 196
294-programs. A full-time dental instructor at a dental school or 197
295-dental program approved by the board may be allowed to practice 198
296-dentistry at the teaching facilities of such school or program, 199

311-pertaining to the teaching permit and with the established rules 202
312-and procedures of the dental school or program as recognized in 203

314- Section 4. Section 466.003, Florida Statute s, is reordered 205

316- 466.003 Definitions. —As used in this chapter , the term: 207
317- (1) "Board" means the Board of Dentistry. 208
318- (2)(6) "Dental assistant" means a person, other than a 209
319-dental hygienist, who, under the supervision and authorizati on 210
320-of a dentist, provides dental care services directly to a 211
321-patient. This term does shall not include a certified registered 212
322-nurse anesthetist licensed under part I of chapter 464. 213
323- (3)(4) "Dental hygiene" means the rendering of 214
324-educational, preventive, and therapeutic dental services 215
325-pursuant to ss. 466.023 and 466.024 and any related extra -oral 216
326-procedure required in the performance of such services. 217
327- (4)(5) "Dental hygienist" means a person licensed to 218
328-practice dental hygiene pursuant to this chapter. 219
329- (5) "Dental therapist" means a person licensed to practice 220
330-dental therapy pursuant to s. 466.0225. 221
331- (6) "Dental therapy" means the rendering of services 222
332-pursuant to s. 466.0227 and any related extraoral services or 223
333-procedures required in the performance of such services. 224
334- (7)(2) "Dentist" means a person licensed to practice 225

348- (8)(3) "Dentistry" means the healing art which is 227
349-concerned with the examination, diagnosis, treatment planning, 228
350-and care of conditions within t he human oral cavity and its 229
351-adjacent tissues and structures. It includes the performance or 230
352-attempted performance of any dental operation, or oral or oral -231
353-maxillofacial surgery and any procedures adjunct thereto, 232
354-including physical evaluation directly rel ated to such operation 233
355-or surgery pursuant to hospital rules and regulations. It also 234
356-includes dental service of any kind gratuitously or for any 235
357-remuneration paid, or to be paid, directly or indirectly, to any 236
358-person or agency. The term "dentistry" shall also includes 237
359-include the following: 238
360- (a) The Taking of an impression of the human tooth, teeth, 239
361-or jaws directly or indirectly and by any means or method. 240
362- (b) Supplying artificial substitutes for the natural teeth 241
363-or furnishing, supplying, constructing, reproducing, or 242
364-repairing any prosthetic denture, bridge, appliance, or any 243
365-other structure designed to be worn in the human mouth except on 244
366-the written work order of a duly licensed dentist. 245
367- (c) The Placing of an appliance or structure in the human 246
368-mouth or the adjusting or attempting to adjust the same. 247
369- (d) Delivering the same to any person other than the 248
370-dentist upon whose work order the work was performed. 249
371- (e) Professing to the public by any method to furnish, 250

385-bridge, appliance, or other structure designed to be worn in the 252

387- (f) Diagnosing, prescribing, or treating or professing to 254

389-deficiency, injury, o r physical condition of the human teeth or 256
390-jaws or oral-maxillofacial region. 257
391- (g) Extracting or attempting to extract human teeth. 258
392- (h) Correcting or attempting to correct malformations of 259
393-teeth or of jaws. 260
394- (i) Repairing or attempting to repair caviti es in the 261
395-human teeth. 262
396- (9)(7) "Department" means the Department of Health. 263
397- (10)(8) "Digital scanning" means the use of digital 264
398-technology that creates a computer -generated replica of the hard 265
399-and soft tissue of the oral cavity using enhanced digital 266
400-photography, lasers, or other optical scanning devices. 267
401- (11)(9) "Direct supervision" means supervision whereby a 268
402-dentist diagnoses the condition to be treated, a dentist 269
403-authorizes the procedure to be performed, a dentist remains on 270
404-the premises while the procedures are performed, and a dentist 271
405-approves the work performed before dismissal of the patient. 272
406- (12)(11) "General supervision" means supervision whereby a 273
407-dentist authorizes the procedures which are being carried out 274
408-but need not be present when the authorized procedures are being 275

421-performed. The authorized procedures may also be performed at a 276
422-place other than the dentist's usual place of practice. The 277
423-issuance of a written work authorization to a commercial dental 278
424-laboratory by a dentist does not co nstitute general supervision. 279
425- (13)(15) "Health access setting" means a program or an 280
426-institution of the Department of Children and Families, the 281
427-Department of Health, the Department of Juvenile Justice, a 282
428-nonprofit community health center, a Head Start c enter, a 283
429-federally qualified health center or look -alike as defined by 284
430-federal law, a school -based prevention program, a clinic 285
431-operated by an accredited college of dentistry, or an accredited 286
432-dental hygiene program in this state if such community service 287
433-program or institution immediately reports to the Board of 288
434-Dentistry all violations of s. 466.027, s. 466.028, or other 289
435-practice act or standard of care violations related to the 290
436-actions or inactions of a dentist, dental hygienist, or dental 291
437-assistant engaged in the delivery of dental care in such 292
438-setting. 293
439- (14)(10) "Indirect supervision" means supervision whereby 294
440-a dentist authorizes the procedure and a dentist is on the 295
441-premises while the procedures are performed. 296
442- (15)(12) "Irremediable tasks" are those intraoral 297
443-treatment tasks which, when performed, are irreversible and 298
444-create unalterable changes within the oral cavity or the 299
445-contiguous structures or which cause an increased risk to the 300

458-patient. The administration of ane sthetics other than topical 301
459-anesthesia is considered to be an "irremediable task" for 302
460-purposes of this chapter. 303
461- (16)(14) "Oral and maxillofacial surgery" means the 304
462-specialty of dentistry involving diagnosis, surgery, and 305
463-adjunctive treatment of diseases, injuries, and defects 306
464-involving the functional and esthetic aspects of the hard and 307
465-soft tissues of the oral and maxillofacial regions. This term 308
466-may not be construed to apply to any individual exempt under s. 309
467-466.002(1). 310
468- (17)(13) "Remediable tasks" are those intraoral treatment 311
469-tasks which are reversible and do not create unalterable changes 312
470-within the oral cavity or the contiguous structures and which do 313
471-not cause an increased risk to the patient. 314
472- (18)(16) "School-based prevention program" means 315
473-preventive oral health services offered at a school by one of 316
474-the entities described defined in subsection (13) (15) or by a 317
475-nonprofit organization that is exempt from federal income 318
476-taxation under s. 501(a) of the Internal Revenue Code, and 319
477-described in s. 501(c)(3) of the Internal Revenue Code. 320

496-provide administrative support to the councils and shall provide 327
497-public notice of meetings and agendas agenda of the councils. 328
498-Councils must shall include at least one board member , who shall 329

500-members. All council members shall be appointed by the board 331
501-chair. Council members shall be appointed for 4 -year terms, and 332

504- (a) A Council on Dental Hygiene shall be appointed by the 335
505-board chair and shall include one dental hygienist member of the 336
506-board, who shall chair the council, one dental member of the 337
507-board, and three dental hygienists who are actively engaged in 338
508-the practice of dental hygiene in this state. In making the 339
509-appointments, the chair shall consider recommendations from the 340
510-Florida Dental Hygiene Association. The council shall meet at 341
511-the request of the board chair, a majority of the members of the 342
512-board, or the council chair; however, the council must meet at 343
513-least three times a year. The council is charged with the 344
514-responsibility of and shall meet for the purpose of developing 345
515-rules and policies for recommendation to the board, which the 346
516-board shall consider, on matters pertaining to that part of 347
517-dentistry consisting of educational, preventive, or therapeutic 348
518-dental hygiene services; dental hygiene licensure, discipline, 349

532-recommendations of the council must shall be considered by the 351
533-board at its next regularly scheduled meeting in the same manner 352
534-in which it considers rule and policy recommendations from 353
535-designated subcommittees of the board. Any rule or policy 354
536-proposed by the board pertaining to the specified part of 355
537-dentistry identified defined by this subsection must shall be 356
538-referred to the council for a recommendation before final action 357
539-by the board. The board may take final action on rules 358
540-pertaining to the specified part of dentistry identified defined 359
541-by this subsection without a council recommendation if the 360
542-council fails to submit a recommendation in a timely fashion as 361
543-prescribed by the board. 362
544- (b) A Council on Dental Assisting shall be appointed by 363
545-the board chair and shall include one board member who shall 364
546-chair the council and three dental assistants who are ac tively 365
547-engaged in dental assisting in this state. The council shall 366
548-meet at the request of the board chair or a majority of the 367
549-members of the board. The council shall meet for the purpose of 368
550-developing recommendations to the board on matters pertaining to 369
551-that part of dentistry related to dental assisting. 370
552- (c) Effective 28 months after the first dental therapy 371
553-license is granted by the board, the board chair shall appoint a 372
554-Council on Dental Therapy, which must include one board member 373

847-therapist shall retain in her or his records any receipts, 570

849-the continuing educati on. Compliance with the continuing 572
850-education requirements is mandatory for issuance of the renewal 573
851-certificate. The board may excuse licensees, as a group or as 574

908- (e) Establish an administrative mechanism enabling the 607
909-board to verify compliance with training, education, experience, 608
910-equipment, or certification requirements of dentists, dental 609
911-therapists, dental hygienists, and dental assistants adopted 610
912-pursuant to this subsection. The board may charge a fee to 611
913-defray the cost of verifying compliance with requirements 612
914-adopted pursuant to this paragraph. 613
915- (4) A dentist, dental therapist, or dental hygienist who 614
916-administers or employs the use of any form of anesthesia must 615
917-possess a certification in either basic cardiopulmonary 616
918-resuscitation for health professionals or advanced cardiac life 617
919-support approved by the American Heart Association or the 618
920-American Red Cross or an equivalent agency -sponsored course with 619
921-recertification every 2 years. Each dental office that which 620
922-uses any form of anesthesia must have immediately available and 621
923-in good working order such resuscitative equipment, oxygen, and 622
924-other resuscitative drugs as are specified by rule of the board 623
925-in order to manage possible adverse reactions. 624
926- (5) A dental hygienist under the direct supervision of a 625

991-block anesthesia, soft tissue infiltration anesthesia, or both, 666
992-under the general supervision of a dentist, if she or he meets 667
993-the criteria described in subsection (6). 668
994- (8)(6) Any dental therapist or dental hygienist seeking a 669
995-certificate to administer local anesthesia must apply to the 670
996-department, remit an application fee, and submit proof of 671
997-successful completion of a course in the administration of local 672
998-anesthesia pursuant to su bsection (5). The board shall certify, 673
999-and the department shall issue a certificate to, any dental 674
1000-therapist or dental hygienist who fulfills the qualifications of 675

1018-authorized to administer local anesthesia . The board shall adopt 681
1019-rules necessary to administer subsections subsection (5), (6), 682

1021- (9)(7) A licensed dentist, or a dental therapist who is 684
1022-authorized by her or his supervising dentist, may operate 685
1023-utilize an X-ray machine, expose dental X-ray films, and 686
1024-interpret or read such films. Notwithstanding The provisions of 687
1025-part IV of chapter 468 to the contrary notwithstanding , a 688
1026-licensed dentist, or a dental therapist who is authorized by her 689
1027-or his supervising dentist, may authorize or direct a dental 690
1028-assistant to operate such equipment and expose such films under 691
1029-her or his direction and supervision, pursuant to rules adopted 692
1030-by the board in accordance with s. 466.024 which ensure that the 693
1031-said assistant is competent by reason of training and experience 694
1032-to operate the X-ray said equipment in a safe and efficient 695
1033-manner. The board may charge a fee not to exceed $35 to defray 696
1034-the cost of verifying compliance with requirements adopted 697
1035-pursuant to this section. 698

1058- (11)(9) Any adverse incident that occurs in an office 709
1059-maintained by a dentist must be reported to the department. The 710
1060-required notification to the department must be submitted in 711
1061-writing by certified mail and postmarked within 48 hours after 712
1062-the incident occurs. 713
1063- (12)(10) A dentist practicing in this state must notify 714
1064-the board in writing by certified mail within 48 hours after any 715
1065-adverse incident that occurs in the dentist's outpatient 716
1066-facility. A complete written report must be filed with the board 717
1067-within 30 days after the incident occurs. 718
1068- (13)(11) Any certified registered dental hygienist 719
1069-administering local anesthesia must notify the board in writing 720
1070-by registered mail within 48 hours after any adverse incident 721
1071-that was related to or the result of the administration of local 722
1072-anesthesia. A complete written report must be filed with the 723
1073-board within 30 days after the mortality or other adverse 724

427+institution of the Department of Children and Families, the 282
428+Department of Health, the Department of Juvenile Justice, a 283
429+nonprofit community health center, a Head Start center, a 284
430+federally qualified health center o r look-alike as defined by 285
431+federal law, a school -based prevention program, a clinic 286
432+operated by an accredited college of dentistry, or an accredited 287
433+dental hygiene program in this state if such community service 288
434+program or institution immediately reports t o the Board of 289
435+Dentistry all violations of s. 466.027, s. 466.028, or other 290
436+practice act or standard of care violations related to the 291
437+actions or inactions of a dentist, dental hygienist, or dental 292
438+assistant engaged in the delivery of dental care in such 293
439+setting. 294
440+ (14)(10) "Indirect supervision" means supervision whereby 295
441+a dentist authorizes the procedure and a dentist is on the 296
442+premises while the procedures are performed. 297
443+ (15)(12) "Irremediable tasks" are those intraoral 298
444+treatment tasks which, when performed, are irreversible and 299
445+create unalterable changes within the oral cavity or the 300

463+specialty of dentistry involving diagnosis, surgery, and 306
464+adjunctive treatment of diseases, injuries, and defects 307
465+involving the functional and esthetic aspects of the hard and 308
466+soft tissues of the oral and maxillofacial regions. This term 309
467+may not be construed to apply to any individual exempt under s. 310
468+466.002(1). 311
469+ (17)(13) "Remediable tasks" are those intraoral treatment 312
470+tasks which are reversible and do not create unalterable changes 313
471+within the oral cavity or the contiguous structures and which do 314
472+not cause an increased risk to the patient. 315
473+ (18)(16) "School-based prevention program" means 316
474+preventive oral health services offered at a school by one of 317
475+the entities described defined in subsection (13) (15) or by a 318
476+nonprofit organization that is exempt from federal income 319

539+referred to the council for a recommendation before final action 358

541+pertaining to the specified part of dentistry identified defined 360
542+by this subsection without a council recommendation if the 361
543+council fails to submit a recommendation in a timely fashion as 362
544+prescribed by the board. 363
545+ (b) A Council on Dental Assisting shall be appointed by 364
546+the board chair and shall include one board member who shall 365
547+chair the council and three dental assistants who are ac tively 366
548+engaged in dental assisting in this state. The council shall 367

648+same as the passing score for the American Dental Licensing 431
649+Examination administered in this state. The applicant must have 432
650+completed the examination after October 1, 2011. This 433
651+subparagraph may not be given retroactive application. 434
652+ 2. If the date of an applicant's passing American Dental 435
653+Licensing Examination scores from an examination previously 436
654+administered in a jurisdiction other than this state under 437
655+subparagraph 1. is older than 365 days, such scores are 438
656+nevertheless valid for the purpose of licensure in this state, 439

851+education requirements is mandatory for issuance of the renewal 574

908+general anesthesia or sedation. 607
909+ (e) Establish an administrative mechanism enabling the 608
910+board to verify compliance with training, education, experience, 609
911+equipment, or certification requirements of dentists, dental 610
912+therapists, dental hygienists, and dental assistants adopted 611
913+pursuant to this subsection. The board may charge a fee to 612
914+defray the cost of verifying compliance with requirements 613
915+adopted pursuant to this paragraph. 614
916+ (4) A dentist, dental therapist, or dental hygienist who 615
917+administers or employs the use of any form of anesthesia must 616
918+possess a certification in either basic cardiopulmonary 617
919+resuscitation for health professionals or advanced cardiac life 618
920+support approved by the American Heart Association or the 619
921+American Red Cross or an equivalent agency -sponsored course with 620
922+recertification every 2 years. Each dental office that which 621
923+uses any form of anesthesia must have immediately available and 622
924+in good working order such resuscitative equipment, oxygen, and 623
925+other resuscitative drugs as are specified by rule of the board 624
926+in order to manage possible adverse reactions. 625

988+ (c) The dental therapist possesses a valid certificate 663

990+ (7) A dental therapist providing services in a mobile 665
991+dental unit may administer local anesthesia, including intraoral 666
992+block anesthesia, soft tissue infiltration anesthesia, or both, 667
993+under the general supervision of a dentist, if she or he meets 668
994+the criteria described in subsection (6). 669
995+ (8)(6) Any dental therapist or dental hygienist seeking a 670
996+certificate to administer local anesthesia must apply to the 671
997+department, remit an application fee, and submit proof of 672
998+successful completion of a course in the administration of local 673
999+anesthesia pursuant to su bsection (5). The board shall certify, 674
1000+and the department shall issue a certificate to, any dental 675

1016+but is part of the dental therapist's or dental hygienist's 679
1017+permanent record and must be prominently displayed at the 680
1018+location where the dental therapist or dental hygienist is 681
1019+authorized to administer local anesthesia . The board shall adopt 682
1020+rules necessary to administer subsections subsection (5), (6), 683
1021+and (7) and this subsection. 684
1022+ (9)(7) A licensed dentist, or a dental therapist who is 685
1023+authorized by her or his supervising dentist, may operate 686
1024+utilize an X-ray machine, expose dental X-ray films, and 687
1025+interpret or read such films. Notwithstanding The provisions of 688
1026+part IV of chapter 468 to the contrary notwithstanding , a 689
1027+licensed dentist, or a dental therapist who is authorized by her 690
1028+or his supervising dentist, may authorize or direct a dental 691
1029+assistant to operate such equipment and expose such films under 692
1030+her or his direction and supervision, pursuant to rules adopted 693
1031+by the board in accordance with s. 466.024 which ensure that the 694
1032+said assistant is competent by reason of training and experience 695
1033+to operate the X-ray said equipment in a safe and efficient 696
1034+manner. The board may charge a fee not to exceed $35 to defray 697
1035+the cost of verifying compliance with requirements adopted 698
1036+pursuant to this section. 699

1055+subject to all laws and rules applicable to pharmacists and 706
1056+pharmacies, including, but not limited to, chapters 465, 499, 707
1057+and 893, and all applicable federal laws an d regulations, when 708

1059+ (11)(9) Any adverse incident that occurs in an office 710
1060+maintained by a dentist must be reported to the department. The 711
1061+required notification to the department must be submitted in 712
1062+writing by certified mail and postmarked within 48 hours after 713
1063+the incident occurs. 714
1064+ (12)(10) A dentist practicing in this state must notify 715
1065+the board in writing by certified mail within 48 hours after any 716
1066+adverse incident that occurs in the dentist's outpatient 717
1067+facility. A complete written report must be filed with the board 718
1068+within 30 days after the incident occurs. 719
1069+ (13)(11) Any certified registered dental hygienist 720
1070+administering local anesthesia must notify the board in writing 721
1071+by registered mail within 48 hours after any adverse incident 722
1072+that was related to or the result of the administration of local 723
1073+anesthesia. A complete written report must be filed with the 724
1074+board within 30 days after the mortality or other adverse 725

1099+and determine whether it involved conduct by a health care 738
1100+professional subject to disciplinary action, in which case s. 739
1101+456.073 applies. Disciplinary action, if any, shall be taken by 740
1102+the board under which the health care professional is licensed. 741
1103+ (17)(14) As used in subsections (11)-(16) (9)-(13), the 742
1104+term "adverse incident" means any mortality that occurs during 743
1105+or as the result of a dental procedure, or an incident that 744
