2222 Section 1. Paragraph (a) of subsection (2) of section 9
2323 1006.23, Florida Statutes, is amended to read: 10
2424 1006.23 Hazardous walking conditions. — 11
2525 (2) HAZARDOUS WALKING CONDITIONS. — 12
2626 (a) Walkways parallel to the road. — 13
2727 1. It shall be considered a hazardous walking condition 14
2828 with respect to any road along which students must walk in order 15
2929 to walk to and from school if there is not an area at least 4 16
3030 feet wide adjacent to the road, not including drainage ditches, 17
3131 sluiceways, swales, or channels, having a surface upon which 18
3232 students may walk without being required to walk on the road 19
3333 surface or if the walkway is along a limited access facility as 20
3434 defined in s. 334.03(12). In addition, whenever the road along 21
3535 which students must walk is uncurbed and has a posted speed 22
3636 limit of 50 miles per hour or greater, the area as described 23
3737 above for students to walk upon shall be set off the road by no 24
3838 less than 3 feet from the edge of the road. 25

5151 2. Subparagraph 1. does not apply when the road along 26

5353 a. Is a road on which the volume of traffic is less than 28
5454 180 vehicles per hour, per direction, during the time students 29
5555 walk to and from school; or 30
5656 b. Is located in a residential area and has a posted speed 31
5757 limit of 30 miles per hour or less. 32
5858 Section 2. This act shall take effect July 1, 2025. 33
