30- Section 1. Section 483.815, Flor ida Statutes, is amended 17
31-to read: 18
32- 483.815 Application for clinical laboratory personnel 19
33-license.— 20
34- (1) An application for a clinical laboratory personnel 21
35-license shall be made under oath on forms provided by the 22
36-department and shall be accompanied by pa yment of fees as 23
37-provided by this part. A license may be issued authorizing the 24
38-performance of procedures of one or more categories. 25

51- (2) An applicant who qualifies for licensure under s. 26
52-483.823(3) or (4), must provide proof of such compliance, and 27
53-pay the fees required under s. 483.807, to be deemed eligible 28

62-qualifications for licensure under this part to pe rform high 37
63-complexity testing as a technologist or technician in this 38
64-state. 39
65- (4) Except as otherwise provided in s. 483.812, a 40
66-technician applicant for licensure who satisfies the 41
67-requirements in 42 C.F.R. s. 493.1423 to perform moderate 42
68-complexity testing is deemed to have satisfied the minimum 43
69-qualifications for licensure under this part to perform moderate 44
70-complexity testing as a technician in this state. 45
71- Section 3. This act shall take effect July 1, 2025. 46
51+ (1) LICENSING.—The department shall provide biennial 26
52+licensure of all clinical laboratory personnel who the board 27
53+certifies have met the requirements of this part. The license of 28
54+any person who fails to pay a required fee or otherwise fails to 29
55+qualify within 60 days after the date of expiration of such 30
56+license shall be automatically canceled without notice or 31
57+further proceedings unless the individual has made application 32
58+for inactive status pursuant to s. 483.819. 33
59+ (2) EXAMINATIONS.—The department shall conduct 34
60+examinations required by board rules to determine in part the 35
61+qualification of clinical laboratory personnel fo r licensure. 36
62+The board by rule may designate a national certification 37
63+examination that may be accepted in lieu of state examination 38
64+for clinical laboratory personnel or public health scientists. 39
65+ (3) REGISTRATION OF TRAINEES. —The department shall provide 40
66+for registration of clinical laboratory trainees who are 41
67+enrolled in a training program approved pursuant to s. 483.811, 42
68+which registration may not be renewed except upon special 43
69+authorization of the board. 44
70+ (4) APPROVAL OF CURRICULUM IN SCHOOLS AND COLLE GES.—The 45
71+board may approve the curriculum in schools and colleges 46
72+offering education and training leading toward qualification for 47
73+licensure under this part. 48
74+ Section 2. Section 483.811, Florida Statutes, is repealed. 49

106+The purpose of this part is to protect the public health, 69
107+safety, and welfare of the people of this state from the hazards 70
108+of improper performance by clinical laboratory personnel. 71
109+Clinical laboratories provide essential services to 72
110+practitioners of the healing arts by furnishing vital 73
111+information that is essential to a determination of the nature, 74
112+cause, and extent of the condition involved. Unreliable and 75

125+inaccurate reports may cause unnecessary anx iety, suffering, and 76
126+financial burdens and may even contribute directly to death. The 77
127+protection of public and individual health requires the 78
128+licensure of clinical laboratory personnel who meet minimum 79
129+requirements for safe practice. The Legislature finds that 80
130+laboratory testing technology continues to advance rapidly. The 81
131+Legislature also finds that a hospital training program under 82
132+the direction of the hospital clinical laboratory director 83
133+offers an opportunity for individuals already trained in health 84
134+care professions to expand the scope of their careers. The 85
135+Legislature further finds that there is an immediate need for 86
136+properly trained personnel to ensure patient access to testing. 87
137+Therefore, the Legislature recognizes the patient -focused 88
138+benefits of hospital-based training for laboratory and 89
139+nonlaboratory personnel for testing within hospitals and 90
140+commercial laboratories and recognizes the benefits of a 91
141+training program approved by the Board of Clinical Laboratory 92
142+Personnel under the direction of the hos pital clinical 93
143+laboratory director. 94
144+ Section 5. Subsection (5) of section 483.803, Florida 95
145+Statutes, is amended to read: 96
146+ 483.803 Definitions. —As used in this part, the term: 97
147+ (5) "Clinical laboratory trainee" means any person having 98
148+qualifying education who is enrolled in a clinical laboratory 99
149+training program approved pursuant to s. 483.811 and who is 100

162+seeking experience required to meet minimum qualifications for 101
163+licensing in this state. Trainees may perform procedures under 102
164+direct and responsible su pervision of duly licensed clinical 103
165+laboratory personnel, but they may not report test results. 104
166+ Section 6. Subsections (1), (3), (8), and (9) of section 105
167+483.807, Florida Statutes, are amended to read: 106
168+ 483.807 Fees; establishment; disposition. — 107
169+ (1) The board shall establish, by rule, shall establish 108
170+fees to be paid for application, examination, reexamination, 109
171+licensing and renewal, registration, laboratory training program 110
172+application, reinstatement, and recordmaking and recordkeeping. 111
173+The board may also establish, by rule, a delinquency fee. The 112
174+board shall establish fees that are adequate to ensure the 113
175+continued operation of the board and to fund the proportionate 114
176+expenses incurred by the department in carrying out its 115
177+licensure and other related re sponsibilities under this part. 116
178+Fees must shall be based on departmental estimates of the 117
179+revenue required to implement this part and the provisions of 118
180+law with respect to the regulation of clinical laboratory 119
181+personnel. 120
182+ (3) The examination fee shall be in an amount which covers 121
183+the costs of obtaining and administering the examination and 122
184+shall be refunded if the applicant is found ineligible to sit 123
185+for the examination. The combined fees for initial application 124
186+and examination may not exceed $200 plus the actual per 125

199+applicant cost to the department for developing, administering, 126
200+or procuring the licensure examination. 127
201+ (8) The initial application fee for registration of a 128
202+trainee shall not exceed $20. 129
203+ (9) The initial application and renewal fee for appr oval 130
204+as a laboratory training program may not exceed $300. The fee 131
205+for late filing of a renewal application shall be $50. 132
206+ Section 7. This act shall take effect July 1, 2025. 133
