2929 Be It Enacted by the Legislature of the State of Florida: 16

3131 Section 1. Subsection (3) of section 403.7032, Florida 18
3232 Statutes, is amended, and subsection (6) is added to that 19
3333 section, to read: 20
3434 403.7032 Recycling. — 21
3535 (3) Each state agency, public institution of higher 22
3636 learning, community college, and state uni versity, including all 23
3737 buildings that are occupied by municipal, county, or state 24
3838 employees and entities occupying buildings managed by the 25

5151 Department of Management Services, must, at a minimum, annually 26
5252 report all recycled materials to the county using th e 27
5353 department's designated reporting format. Private businesses, 28
5454 other than certified recovered materials dealers, that recycle 29
5555 paper, metals, glass, plastics, textiles, rubber materials, and 30
5656 mulch may participate in the program in subsection (6) to 31
5757 annually report to the county the amount of materials that the 32
5858 businesses recycle, are encouraged to report the amount of 33
5959 materials they recycle to the county annually beginning January 34
6060 1, 2011, using the department's designated reporting format. 35
6161 Using the information provided, the department shall recognize 36
6262 those private businesses that demonstrate outstanding recycling 37
6363 efforts. Notwithstanding any other provision of state or county 38
6464 law, private businesses, other than certified recovered 39
6565 materials dealers, shall not be required to report recycling 40
6666 rates. Cities with less than a population of 2,500 and per 41
6767 capita taxable value less than $48,000 and cities with a per 42
6868 capita taxable value less than $30,000 are exempt from the 43
6969 reporting requirement specified in this s ubsection. 44
7070 (6) By July 1, 2026, the department shall develop and 45
7171 implement a comprehensive waste reduction and recycling plan 46
7272 based on recommendations from the department's "Florida and the 47
7373 2020 75% Recycling Goal -Final Report." 48
7474 (a) At a minimum, the comprehensive plan must: 49

8989 2. Establish a program to incentivize private businesses 52
9090 to recycle using the following guidelines: 53
9191 a. Private businesses shall recei ve 1 year off of a 54
9292 licensing fee specific to their business for a 15 percent 55
9393 increase in their recycling rate. 56
9494 b. Private businesses with an 80 percent recycling rate or 57
9595 higher shall receive 2 years off of a licensing fee specific to 58
9696 their business. 59
9797 c. Private businesses shall be encouraged to post a list 60
9898 of all recyclable materials within close proximity of each 61
9999 recycling bin at the private business. 62
100100 d. Private businesses shall be notified and educated about 63
101101 the program to give all private businesse s a fair opportunity. 64
102102 (b) Upon implementation of the comprehensive waste 65
103103 reduction and recycling plan, the department shall publish a 66
104104 list of all private businesses who have received an incentive 67
105105 from the program. 68
106106 Section 2. This act shall take effec t July 1, 2025. 69
