A bill to be entitled 1 
An act relating to fees for the recordkeeping system 2 
for ephedrine and related compounds; amending s. 3 
893.1495, F.S.; requiring manufacturers of ephedrine 4 
or related compounds to pay a fee to operate the 5 
electronic recordkeeping system; providing for 6 
establishment of a fee schedule; providing penalties; 7 
providing an effective date. 8 
 9 
Be It Enacted by the Legislature of the State of Florida: 10 
 11 
 Section 1.  Paragraph (a) of subsection (10) and subsection 12 
(11) of section 893.1495, Florida Statutes, are amended, and 13 
paragraph (d) is added to subsection (5) of that section, to 14 
read: 15 
 893.1495  Retail sale of ephedrine and related compounds. — 16 
 (5) 17 
 (d)1.  Beginning on July 1, 2025, each manufacturer of 18 
ephedrine or related compounds sold in the state must, on a 19 
monthly basis, pay a fee to the administrator of the electronic 20 
recordkeeping system app roved by the Department of Law 21 
Enforcement under paragraph (b). The fee shall be used to 22 
support the operation of the system. 23 
 2.  The administrator shall set the fee level required for 24 
each manufacturer under subparagraph 1. 25

 3.  At the request of the Dep artment of Law Enforcement, 26 
each manufacturer shall provide written documentation 27 
demonstrating that it has paid the fees required under 28 
subparagraph 1. 29 
 (10)  This section does not apply to: 30 
 (a)  Licensed manufacturers manufacturing and lawfully 31 
distributing products in the channels of commerce , except 32 
manufacturers subject to the fee requirements in paragraph 33 
(5)(d). 34 
 (11)  Any individual who violates subsection (2), 35 
subsection (3), or subsection (4), or paragraph (5)(d) commits: 36 
 (a)  For a first offens e, a misdemeanor of the second 37 
degree, punishable as provided in s. 775.083. 38 
 (b)  For a second offense, a misdemeanor of the first 39 
degree, punishable as provided in s. 775.082 or s. 775.083. 40 
 (c)  For a third or subsequent offense, a felony of the 41 
third degree, punishable as provided in s. 775.082, s. 775.083, 42 
or s. 775.084. 43 
 Section 2. This act shall take effect July 1, 2025. 44
