A bill to be entitled 1 
An act relating to immigration enforcement assistance 2 
agreements; amending s. 908.11, F.S.; requiring each 3 
law enforcement agency operating a detention facility 4 
to enter into a specified agreement with the United 5 
States Immigration and Customs Enforcement; requiring 6 
certain law enforcement agencies to report specified 7 
information quarterly to the Department of Law 8 
Enforcement; providing an effective date. 9 
 10 
Be It Enacted by the Legislature of the State of Florida: 11 
 12 
 Section 1.  Subsection (2) of section 908.11, Florida 13 
Statutes, is renumbered as subsection (3) and amended, and a new 14 
subsection (2) is added to that section, to read: 15 
 908.11  Immigration enforce ment assistance agreements; 16 
reporting requirement. — 17 
 (2)  By January 1, 2026, each law enforcement agency 18 
operating a detention facility must enter into a written 19 
agreement with the United States Immigration and Customs 20 
Enforcement to participate in the im migration program 21 
established under s. 287(g) of the Immigration and Nationality 22 
Act, 8 U.S.C. s. 1357. This subsection does not require a law 23 
enforcement agency to participate in a particular program model. 24 
 (3)(2)  Beginning no later than October 1, 2022 , and until 25

the law enforcement agency enters into the written agreement 26 
required under subsection (1), Each law enforcement agency 27 
operating a county detention facility not in compliance with 28 
this section must notify the Department of Law Enforcement 29 
quarterly of the status of the required such written agreement 30 
and any reason for noncompliance with this section, if 31 
applicable. 32 
 Section 2. This act shall take effect July 1, 2025. 33
