2424 Be It Enacted by the Legis lature of the State of Florida: 11

2626 Section 1. This act may be cited as "Hillary's Law." 13
2727 Section 2. Subsection (3) of section 458.328, Florida 14
2828 Statutes, is renumbered as subsection (4), paragraph (e) of 15
2929 subsection (1) and subsection (2) are amended, a nd a new 16
3030 subsection (3) is added to that section, to read: 17
3131 458.328 Office surgeries. — 18
3232 (1) REGISTRATION.— 19
3333 (e)1. The department shall inspect a registered office at 20
3434 least annually, including a review of patient records, to ensure 21
3535 that the office is in compliance with this section and rules 22
3636 adopted hereunder unless the office is accredited by a 23
3737 nationally recognized accrediting agency approved by the board. 24
3838 The inspection may be unannounced, except for the inspection of 25

5151 an office that meets the descripti on of a clinic specified in s. 26
5252 458.3265(1)(a)3.h., and those wholly owned and operated 27
5353 physician offices described in s. 458.3265(1)(a)3.g. which 28
5454 perform procedures referenced in s. 458.3265(1)(a)3.h., which 29
5555 must be announced. 30
5656 2. The department must imme diately suspend the 31
5757 registration of a registered office that refuses an inspection 32
5858 under subparagraph 1. The office must close during such 33
5959 suspension. The suspension must remain in effect for at least 14 34
6060 consecutive days and may not terminate until the dep artment 35
6161 issues a written declaration that the office may reopen 36
6262 following the department's completion of an inspection of the 37
6363 office. 38
6464 3. As a condition of registration, each office must also 39
6565 be inspected by the Joint Commission on Accreditation of 40
6666 Healthcare Organizations (JCAHO) and conform to the JCAHO 41
6767 standards for a stand -alone ambulatory surgery center and meet 42
6868 any other requirements set by JCAHO. 43
6969 (2) STANDARDS OF PRACTICE. — 44
7070 (a) A physician may not perform any surgery or procedure 45
7171 identified in paragraph (1)(a) in a setting other than an office 46
7272 surgery setting registered under this section or a facility 47
7373 licensed under chapter 390 or chapter 395, as applicable. The 48
7474 board shall impose a fine of $5,000 per incident on a physician 49
7575 who violates this pa ragraph. 50

8888 (b) Office surgeries may not: 51
8989 1. Be a type of surgery that generally results in blood 52
9090 loss of more than 10 percent of estimated blood volume in a 53
9191 patient with a normal hemoglobin level; 54
9292 2. Require major or prolonged intracranial, intrathorac ic, 55
9393 abdominal, or joint replacement procedures, except for 56
9494 laparoscopic procedures; 57
9595 3. Involve major blood vessels and be performed with 58
9696 direct visualization by open exposure of the major blood vessel, 59
9797 except for percutaneous endovascular intervention; or 60
9898 4. Be emergent or life threatening. 61
9999 (c) A physician performing a gluteal fat grafting 62
100100 procedure in an office surgery setting shall adhere to standards 63
101101 of practice under this subsection and rules adopted by the board 64
102102 which include, but are not limite d to, all of the following: 65
103103 1. A physician performing a gluteal fat grafting procedure 66
104104 must conduct an in-person examination of the patient while 67
105105 physically present in the same room as the patient no later than 68
106106 the day before the procedure. 69
107107 2. Before a physician may delegate any duties during a 70
108108 gluteal fat grafting procedure, the patient must provide 71
109109 written, informed consent for such delegation. Any duty 72
110110 delegated by a physician during a gluteal fat grafting procedure 73
111111 must be performed under the direct supervision of the physician 74

127127 3. Fat may only be injected into the subcutaneous space of 78
128128 the patient and may not cross the f ascia overlying the gluteal 79
129129 muscle. Intramuscular or submuscular fat injections are 80

131131 4. When the physician performing a gluteal fat grafting 82
132132 procedure injects fat into the subcutaneous space of the 83
133133 patient, the physician must use ultrasound gu idance, or guidance 84
134134 with other technology authorized under board rule which equals 85
135135 or exceeds the quality of ultrasound, during the placement and 86
136136 navigation of the cannula to ensure that the fat is injected 87
137137 into the subcutaneous space of the patient above the fascia 88
138138 overlying the gluteal muscle. Such guidance with the use of 89
139139 ultrasound or other technology is not required for other 90
140140 portions of such procedure. 91
141141 5. An office in which a physician performs gluteal fat 92
142142 grafting procedures must at all times maint ain a ratio of one 93
143143 physician to one patient during all phases of the procedure, 94
144144 beginning with the administration of anesthesia to the patient 95
145145 and concluding with the extubation of the patient. After a 96
146146 physician has commenced, and while he or she is engage d in, a 97
147147 gluteal fat grafting procedure, the physician may not commence 98
148148 or engage in another gluteal fat grafting procedure or any other 99
149149 procedure with another patient at the same time. 100

164164 member. As used in this subparagraph, the term "immediate family 103
165165 member" means a parent, spouse, child, or sibling. 104

167167 procedure after the consent has been signed, or after any 106
168168 sedative drugs are administered to the patient. 107
169169 (e) All health care professionals performing duties at a 108
170170 registered office must be: 109
171171 1. Licensed or certified, and may not perform surgeries or 110
172172 procedures outside the scope of his or her license or 111
173173 certification. 112
174174 2. Certified in advanced cardiac life support and maintain 113
175175 certification through continuing education every 2 years. 114
176176 (f) A registered office may only perform procedures or 115
177177 surgeries during regular office hours and must have: 116
178178 1. Appropriate staff on premis es for procedures and 117
179179 surgeries and administrative duties. 118
180180 2. On the premises at all times a functioning automated 119
181181 external defibrillator device as defined in s. 768.1325(2)(b) 120
182182 and all necessary critical care equipment and medications. 121
183183 3. Preoperative guidelines, intraoperative protocols, and 122
184184 postoperative recovery guidelines in place that meet the 123
185185 standards of any stand -alone ambulatory surgery center for each 124
186186 surgery and procedure, and any followup surgeries and 125

200200 4. A certified registered nurse anesthetist onsite, who is 127
201201 supervised by a board -certified anesthesiologist offsite, to 128
202202 properly administer and oversee anesthesia gases including 129
203203 nitrous oxide, sedatives, narcotic analgesics, intravenous local 130
204204 anesthetics, and the antidote to local anesthetic overdosage, 131
205205 which must be kept onsite and accessible during a procedure or 132
206206 surgery. 133
207207 5. Proper protocols in place for storing, accessing, 134
208208 administering, and dispensing sedatives and drugs listed in 135
209209 Schedule II, Schedule III , or Schedule IV of s. 893.03. 136
210210 (f)(d) If a procedure in an office surgery setting results 137
211211 in hospitalization, the incident must be reported as an adverse 138
212212 incident pursuant to s. 458.351 within 48 hours after its 139
213213 occurrence. If an adverse incident occurs due to a local 140
214214 anesthetic, all vials related to the local anesthetic and its 141
215215 constitution that were administered must be saved as evidence 142
216216 for the department and the sheriff's office or municipal police 143
217217 department. 144
218218 (g) A registered office having to under go any type of 145
219219 construction or refurbishment of its structure may not perform 146
220220 any surgeries or procedures in the building until completion of 147
221221 the construction or refurbishment. 148
222222 (h) An oversight committee shall be created by the 149
223223 department that oversees a ny violations of this section and 150

237237 (3) LIABILITY.—A physician must maintain medical 152
238238 malpractice insurance or provide proof of financial 153
239239 responsibility in an amount of at least $1 million. 154

437437 reports such violations to the department. 292
