2323 Be It Enacted by the Legislature of the State of Florida: 10

2525 Section 1. Subsection (1) of sect ion 414.095, Florida 12
2626 Statutes, is amended to read: 13
2727 414.095 Determining eligibility for temporary cash 14
2828 assistance.— 15
2929 (1) ELIGIBILITY.—An applicant must meet the eligibility 16
3030 requirements of this section before receiving services or 17
3131 temporary cash assistan ce under this chapter, except that an 18
3232 applicant is shall be required to register for work and engage 19
3333 in work activities in accordance with s. 445.024, as designated 20
3434 by the local workforce development board, and may receive 21
3535 support services or child care as sistance in conjunction with 22
3636 such requirement. The department shall make a determination of 23
3737 eligibility based on the criteria listed in this chapter. The 24
3838 department shall monitor continued eligibility for temporary 25

5151 cash assistance through periodic reviews consistent with the 26
5252 food assistance eligibility process. Benefits may not be denied 27
5353 to an individual solely based on a felony drug conviction , 28
5454 unless the conviction is for trafficking pursuant to s. 893.135 . 29
5555 To be eligible under this section, an individual convicted of a 30
5656 drug felony must be satisfactorily meeting the requirements of 31
5757 the temporary cash assistance program, including all substance 32
5858 abuse treatment requirements. Within the limits specified in 33
5959 this chapter, The state opts out of the provision of Pub. L. No. 34
6060 104-193, s. 115, that eliminates eligibility for temporary cash 35
6161 assistance and food assistance for any individual convicted of a 36
6262 controlled substance felony. 37
6363 Section 2. This act shall take effect July 1, 2025. 38
