2525 Be It Enacted by the Legislature of the State of Florida: 12

2727 Section 1. Section 316.1922, Florida Statutes, is created 14
2828 to read: 15
2929 316.1922 Dangerous excessive speeding. — 16
3030 (1) A person commits dangerous e xcessive speeding if he or 17
3131 she operates a motor vehicle: 18
3232 (a) In excess of the speed limit by 50 mph or more. 19
33- (b) At 100 mph or more in a manner that threatens the 20
34-safety of other persons or property or interferes with the 21
35-operation of any vehicle. 22
36- (2) A person convicted of dangerous excessive speeding 23
37-shall be punished: 24
38- (a) Upon a first conviction, by imprisonment for up to 30 25
33+ (b) At 100 mph or more. 20
34+ (2) A person convicted of dangerous excessive speeding 21
35+shall be punished: 22
36+ (a) Upon a first conviction, by imprisonm ent for up to 90 23
37+days or by a fine of $500, or by both such fine and 24

51-days or by a fine of $500, or by both a fine and imprisonment. 26
52- (b) Upon a second or subsequent conviction, by 27
53-imprisonment for up to 90 days or by a fine of $1,000, or by 28
54-both such fine and imprisonment. A person convicted of a second 29
55-or subsequent violation of this section that occurs within 5 30
56-years after the date of a prior conviction for a violation of 31
57-this section shall h ave his or her driving privilege revoked for 32
58-at least 180 days but no more than 1 year. 33
59- Section 2. Subsection (2) of section 318.14, Florida 34
60-Statutes, is amended to read: 35
61- 318.14 Noncriminal traffic infractions; exception; 36
62-procedures. 37
63- (2) Except as provided in ss. 316.1001(2), 316.0083, 38
64-316.173, and 316.1896, any person cited for a violation 39
65-requiring a mandatory hearing listed in s. 318.19 or any other 40
66-criminal traffic violation listed in chapter 316 must sign and 41
67-accept a citation indicating a pro mise to appear. The officer 42
68-may indicate on the traffic citation the time and location of 43
69-the scheduled hearing . The officer and must indicate the 44
70-applicable civil penalty established in s. 318.18 , except for 45
71-infractions under s. 318.19(5) or s. 316.1926(2 ). For all other 46
72-infractions under this section, except for infractions under s. 47
73-316.1001, the officer must certify by electronic, electronic 48
74-facsimile, or written signature that the citation was delivered 49
75-to the person cited. This certification is prima f acie evidence 50

89- Section 3. Subsections (4) and (5) of section 318.19, 52
90-Florida Statutes, are amended, and subsection (6) is added to 53
91-that section, to read: 54
92- 318.19 Infractions requiring a mandatory hearing. —Any 55
93-person cited for the infractions listed in this section shall 56
94-not have the provisions of s. 318.14(2), (4), and (9) available 57
95-to him or her but must appear before the designated official at 58
96-the time and location of the scheduled hearing: 59
97- (4) Any infraction of s. 316.520(1) or (2); or 60
98- (5) Any infraction of s. 316.183(2), s. 316.187, or s. 61
99-316.189 of exceeding the speed limit by 30 mph or more ; or 62
100- (6) Any infraction of s. 316.1926(2) . 63
101- Section 4. This act shall take effect July 1, 2025. 64
