3232 Section 1. Subsections (15), (16), and (17) of section 19
3333 491.003, Florida Statutes, as amended by section 42 of chapter 20

144144 social worker to an applicant whom the board certifies has met 95
145145 all of the following criteria: 96
146146 (d) Completed at least 2 years of clinical social work 97
147147 experience, which took place subsequent to completion of a 98
148148 graduate degree in social work at an institution meeting the 99

163163 equivalent who is a qualified supervisor as determined by the 102
164164 board. An individual who intends to practice in Florida to 103
165165 satisfy clinical experience requirements must register pursuant 104
166166 to s. 491.0045 before commencing practice. If the applicant's 105
167167 graduate program was not a program that which emphasized direct 106
168168 clinical patient or client health care services as described in 107
169169 subparagraph (c)2., the supervised experience requirement must 108
170170 take place after the applicant has completed a minimum of 15 109
171171 semester hours or 22 quarter hours of the coursework required. A 110
172172 doctoral internship may be applied toward the clinical social 111
173173 work experience requirement. A licensed mental health 112
174174 professional must be on the premises when clinical services are 113
175175 provided by a registered intern in a private practice setting. 114
176176 (3) MARRIAGE AND FAMILY THERAPY.—Upon verification of 115
177177 documentation and payment of a fee not to exceed $200, as set by 116
178178 board rule, the department shall issue a license as a marriage 117
179179 and family therapist to an applicant whom the board certifies 118
180180 has met all of the follow ing criteria: 119
181181 (d) Completed at least 2 years of clinical experience 120
182182 during which 50 percent of the applicant's clients were 121
183183 receiving marriage and family therapy services, which must be at 122
184184 the post-master's level under the supervision of a licensed 123
185185 marriage and family therapist with at least 5 years of 124
186186 experience, or the equivalent, who is a qualified supervisor as 125

200200 in Florida to satisfy the clinical experience requirements must 127
201201 register pursuant to s. 491.0045 before commencing practice. If 128
202202 a graduate has a master's degree with a major emphasis in 129
203203 marriage and family therapy or a closely related field which did 130
204204 not include all of the coursework required by paragraph (c), 131
205205 credit for the post-master's level clinical experience may not 132
206206 commence until the applicant has completed a minimum of 10 of 133
207207 the courses required by paragraph (c), as determined by the 134
208208 board, and at least 6 semester hours or 9 quarter hours of the 135
209209 course credits must have been c ompleted in the area of marriage 136
210210 and family systems, theories, or techniques. Within the 2 years 137
211211 of required experience, the applicant must shall provide direct 138
212212 individual, group, or family therapy and counseling to cases 139
213213 including those involving unmarrie d dyads, married couples, 140
214214 separating and divorcing couples, and family groups that include 141
215215 children. A doctoral internship may be applied toward the 142
216216 clinical experience requirement. A licensed mental health 143
217217 professional must be on the premises when clinica l services are 144
218218 provided by a registered intern in a private practice setting. 145

220220 For the purposes of dual licensure, the department shall license 147
221221 as a marriage and family therapist any person who meets the 148
222222 requirements of s. 491.0057. Fees for dual licensure may not 149

236236 (4) MENTAL HEALTH COUNSELING. —Upon verification of 151
237237 documentation and payment of a fee not to exceed $200, as set by 152
238238 board rule, the department shall issue a license as a mental 153
239239 health counselor to an appli cant whom the board certifies has 154
240240 met all of the following criteria: 155
241241 (c)1. Attained a minimum of an earned master's degree from 156
242242 a mental health counseling program accredited by the Council for 157
243243 the Accreditation of Counseling and Related Educational Progr ams 158
244244 which consists of at least 60 semester hours or 80 quarter hours 159
245245 of clinical and didactic instruction, including a course in 160
246246 human sexuality and a course in substance abuse. If the master's 161
247247 degree is earned from a program related to the practice of 162
248248 mental health counseling which is not accredited by the Council 163
249249 for the Accreditation of Counseling and Related Educational 164
250250 Programs, then the coursework and practicum, internship, or 165
251251 fieldwork must consist of at least 60 semester hours or 80 166
252252 quarter hours and meet all of the following requirements: 167
253253 a. Thirty-three semester hours or 44 quarter hours of 168
254254 graduate coursework, which must include a minimum of 3 semester 169
255255 hours or 4 quarter hours of graduate -level coursework in each of 170
256256 the following 11 content area s: counseling theories and 171
257257 practice; human growth and development; diagnosis and treatment 172
258258 of psychopathology; human sexuality; group theories and 173
259259 practice; individual evaluation and assessment; career and 174
260260 lifestyle assessment; research and program evaluat ion; social 175

273273 and cultural foundations; substance abuse; and legal, ethical, 176
274274 and professional standards issues in the practice of mental 177
275275 health counseling. Courses in research, thesis or dissertation 178
276276 work, practicums, internships, or fieldwork may not be app lied 179
277277 toward this requirement. 180
278278 b. A minimum of 3 semester hours or 4 quarter hours of 181
279279 graduate-level coursework addressing diagnostic processes, 182
280280 including differential diagnosis and the use of the current 183
281281 diagnostic tools, such as the current edition of t he American 184
282282 Psychiatric Association's Diagnostic and Statistical Manual of 185
283283 Mental Disorders. The graduate program must have emphasized the 186
284284 common core curricular experience. 187
285285 c. The equivalent, as determined by the board, of at least 188
286286 700 hours of universi ty-sponsored supervised clinical practicum, 189
287287 internship, or field experience that includes at least 280 hours 190
288288 of direct client services, as required in the accrediting 191
289289 standards of the Council for Accreditation of Counseling and 192
290290 Related Educational Programs for mental health counseling 193
291291 programs. This experience may not be used to satisfy the post -194
292292 master's clinical experience requirement. 195
293293 2. Provided additional documentation if a course title 196
294294 that appears on the applicant's transcript does not clearly 197
295295 identify the content of the coursework. The documentation must 198
296296 include, but is not limited to, a syllabus or catalog 199
297297 description published for the course. 200

312312 been received in an institution of higher ed ucation that, at the 203
313313 time the applicant graduated, was fully accredited by an 204
314314 institutional accrediting body recognized by the Council for 205
315315 Higher Education Accreditation or its successor organization or 206
316316 was a member in good standing with Universities Canad a, or an 207
317317 institution of higher education located outside the United 208
318318 States and Canada which, at the time the applicant was enrolled 209
319319 and at the time the applicant graduated, maintained a standard 210
320320 of training substantially equivalent to the standards of 211
321321 training of those institutions in the United States which are 212
322322 accredited by an institutional accrediting body recognized by 213
323323 the Council for Higher Education Accreditation or its successor 214
324324 organization. Such foreign education and training must have been 215
325325 received in an institution or program of higher education 216
326326 officially recognized by the government of the country in which 217
327327 it is located as an institution or program to train students to 218
328328 practice as mental health counselors. The applicant has the 219
329329 burden of establishing that the requirements of this provision 220
330330 have been met, and the board shall require documentation, such 221
331331 as an evaluation by a foreign equivalency determination service, 222
332332 as evidence that the applicant's graduate degree program and 223
333333 education were equiva lent to an accredited program in this 224
334334 country. Beginning July 1, 2025, an applicant must have a 225

353353 (d) Completed at least 2 years of clinical experience in 232
354354 mental health counseling, which must be at the post -master's 233
355355 level under the supervision of a licensed mental health 234
356356 counselor or the equivalent who is a qualified supervisor as 235
357357 determined by the board. An individual who intends to practice 236
358358 in Florida to satisfy the clinica l experience requirements must 237
359359 register pursuant to s. 491.0045 before commencing practice. If 238
360360 a graduate has a master's degree with a major related to the 239
361361 practice of mental health counseling which did not include all 240
362362 the coursework required under sub -subparagraphs (c)1.a. and b., 241
363363 credit for the post-master's level clinical experience may not 242
364364 commence until the applicant has completed a minimum of seven of 243
365365 the courses required under sub -subparagraphs (c)1.a. and b., as 244
366366 determined by the board, one of which must be a course in 245
367367 psychopathology or abnormal psychology. A doctoral internship 246
368368 may be applied toward the clinical experience requirement. A 247
369369 licensed mental health professional must be on the premises when 248
370370 clinical services are provided by a registered intern in a 249

401401 (o) Failing to respond within 30 days to a written 268
402402 communication from the department or the board concerning any 269
403403 investigation by the departme nt or the board, or failing to make 270
404404 available any relevant records with respect to any investigation 271
405405 about the licensee's, registered associate's intern's, or 272
406406 certificateholder's conduct or background. 273
407407 (p) Being unable to practice the profession for which he 274
408408 or she is licensed, registered, or certified under this chapter 275

422422 physical condition or by reason of illness; drunkenness; or 277
423423 excessive use of drugs, narcotics, chemicals, or any other 278
424424 substance. In enforcing this paragraph, upon a finding by the 279
425425 State Surgeon General, the State Surgeon General's designee, or 280
426426 the board that probable cause exists to believe that the 281
427427 licensee, registered associate intern, or certificateholder is 282
428428 unable to practice the profession because of the reasons stated 283
429429 in this paragraph, the department shall have the authority to 284
430430 compel a licensee, registered associate intern, or 285
431431 certificateholder to submit to a mental or physical examination 286
432432 by psychologists, physicians, or other licensees under this 287
433433 chapter, designated by the department or board. If the licensee, 288
434434 registered associate intern, or certificateholder refuses to 289
435435 comply with such order, the department's orde r directing the 290
436436 examination may be enforced by filing a petition for enforcement 291
437437 in the circuit court in the circuit in which the licensee, 292
438438 registered associate intern, or certificateholder resides or 293
439439 does business. The licensee, registered associate intern, or 294
440440 certificateholder against whom the petition is filed may not be 295
441441 named or identified by initials in any public court records or 296
442442 documents, and the proceedings must shall be closed to the 297
443443 public. The department is shall be entitled to the summary 298
444444 procedure provided in s. 51.011. A licensee, registered 299

467467 (s) Delegating professional responsibilities to a person 310
468468 who the licensee, registered associate intern, or 311
469469 certificateholder knows or has reason to know is not qualified 312
470470 by training or experience to perform such responsibilities. 313
471471 (u) Failure of the licensee, registered associate intern, 314
472472 or certificateholder to maintain in confidence a communication 315
473473 made by a patient or client in the context of such services, 316
474474 except as provided in s. 491.0147. 317
